RESOLUTION If
WHEREAS, VIRGINIA.ANNE CORDILL, has petitioned the Board of County Commissioners
of Garfield County, Colorado, for an exemption under C.R.S. (1973) Section 30-28-
101 (10) (a) - (d) as amended, and the Subdivision Regulations of Garfield County,
Colorado, adopted September 1, 1972 and amended April 14, 1975, Sections 1.02.
17 (d) and 3.02.01, for the division of an 8.1669 acre tract of land into two (2)
tracts of. 3.5 and 4.5 acres, more or less, and more particularly described as
follows:
A parcel of land in the S1 of the NW4 of the SW4 in Section 24,
Township 7 South, Range 88 West of the 6th Principal Meridian,
and more particularly described as follows:
Beginning at a point whence the corner common to Sections 23,
24, 25 and 26, said township and range, bears S. 89° 46' 39"
W. 858.44 feet and S. 00° 42' 47" W. 1298.60 feet; thence N.
000 34' 30" E. 651.48 feet; thence N. 890 40' 00" E. 546.06
feet; thence S. 000 34' 30" W. 652.01 feet; thence S. 890
46' 39" W. 546.06 feet to the point of beginning, containing
8.1669 acres, more or less.
WHEREAS, the Petitioner has shown to the satisfaction of the Board of County
Commissioners of Garfield County, Colorado that she desires said exemption for
the purpose of re -sale into single-family residential acreage; and,
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board
that there is a reasonable probability of locating domestic water on each of
said tracts, that there is adequate ingress and egress to said tracts, that the
location of septic tanks will be permitted by the Colorado Department of Health,
that the requested division is in accordance with the general purposes and intent
of the Subdivision Regulations of the State of Colorado and the County of
Garfield and should therefore, be exempted from the definition of the terms
"subdivision" and "subdivided land" as set forth in C.R.S. (1973) Section 30-
28-101 (10) (a) - (d) as amended;
NOW THEREFORE, upon motion of c I'7 S e seconded by
/t y9 )rz. and carried, said 8.1669 acre tract of land
is hereby exempted from such definition and transfer of said tract may be made
by division into two tracts of 3.5 and 4.5 acres, more or less, all as is more
fully described above. A copy of the instrument or instruments of
conveyance when recorded shall be filed with this Resolution.
