HomeMy WebLinkAbout1.0 ApplicationBEFORE THE BOARD OF COUNTY COMMISSIONERS OF GARFIELD COUNTY, COLORADO PETITION FOR EXEMPTION Pursuant to C .R.S. (1973) Section 30-28-lOl(lO)(a)-(d), as amended , and Section 8:00 , et. seq ., of the Subdivision Regulations of Garfield County, Co lorado, adopted April 23, 1984 , the undersigned Paul C. Cox , Calvin H. Cox and Marilyn Cox petition the Board of County Commissioners of Garfield County, Colorado, to exempt by Resolution the division of a 269 .13 acre tract of land into two (2) tracts of approximately 250.28 and 18.85 acres each, more or less , from the definitions of "subdi v ision" and "subdivided land" as the terms are used and defined in C .R.S. (1973) Section 30-28 -lOl(lO)(a)-(d) and the Garfield County Subdivision Regulations for the reasons stated below : SUBMITTAL REQUIREMENTS: An application which satisfies the review criteria must be submitted with all the following information: A. Sketch map at a minimum of 1" = 200' showing the legal description of the property, dimension and area of all lots or separate interests to be created , acce ss to a public right- of-way and an y proposed easements for drainage , irri gation , access or utilities . B. Vicinity map at a minimum scale of 1" = 2000 ' showing the general topographic and geographic relation of the proposed exemption to the surrounding area within two (2) miles, for which a copy of U .S.G .S . qu adrangle map may be used. C . Copy of the deed showing ownership by the applicant, or a letter from the property owner(s) if other than the applicant. D. Names and addresses of owners of record of land immediately adjoining and within 200 feet of the proposed exemption, mineral owners and lessees of mineral owners of record of the property to be exempted, and tenants of any structure proposed for conversion. E. Evidence of the soil types and characteri stics of each type. F . Proof of legal and adequate source of domestic water for each lot created, method of sewage disposal, and letter of approval of fire protection plan from appropriate fire district. G. If connection to a community of municip al water or sewer system is proposed, a letter from the governing body stating a willingness to serve . H. Narrative expla ining why exemption is bei ng requested. I. It shall be demonstrated that the parcel existed as described on January 1, 1973, or the parcel as it exists presently is one of not more than three parcels created from a larger parcel as it exists on January 1, 1973. These soils formed in al luvium and eolian material. Slope is 2 to 25 percent. The average annual precipitation is 15 to 18 inches, and the average annual air temperature is 40 to 44 degrees F. These soils are fine-loamy, mixed Typic Argiborolls . Typical pedon of Empedrado loam, 2 to 6 percent slopes, about 1 ,300 feet nort h and 1 ,600 feet east of the southwest corner of sec . 8, T. 7 S ., R. 88 W. A-0 to 5 inches; brown (7.5YR 4/2) loam, dark brown (1 OYR 3/2) moist; weak thick platy structure parting to weak fine granular; soft, very friable, slightly sticky and slightly plastic; mildly alka line ; clear smooth boundary. BA-5 to 14 inches; brown (7 .5YR 4/2) clay loam , dark brown (1 OYR 3/2) moist; weak medium subangular blocky structure; slightly hard, friable , sticky and slightly plastic; mildly alkaline; clear smooth boundary . Bt1-14 to 27 inches; brown (7.5YR 5/2) clay loam, brown (1 OYR 4/2) moist; moderate medium subangular blocky structure; hard, very firm , sticky and plastic; mildly alkaline; gradual smooth boundary. 812-27 to 40 inches ; brown (7 .5YR 5/4) clay loam, brown (7 .5YR 4/4) moist; moderate medium subangular blocky structure; very hard, very firm, very sticky and plastic; mildly alkaline; gradual wavy boundary. Bk-40 to 60 inches ; brown (7.5YR 5/4) clay loam, brown (7.5YR 4/4) moist; weak medium subangular blocky structure; hard, fi r m, very sticky and plastic ; secondary calcium carbonate in fine seams ; calcareous; moderately alkaline. The solum is 20 to more than 50 inches thick. Secondary lime is at a depth of 20 to 40 inches. The control section is 0 to 15 percent rock fragments. Hue generally is 1 OYR or 7.5YR, but some pedons have subhorizons with hue of 5YR. Etoe Series The Etoe series consists of deep, well drained soils on mountainsides . These soils formed in material derived from sandstone and shale. Slope is 15 to 50 . percent. The average annual precipitation is 18 to 20 inches, and the average annual air temperature is 38 to 40 degrees F. These soils are loamy-skeletal, mixed Typic Paleboralfs . 109 Typ ical pedon of Etoe loam, 15 to 50 percent slopes , about 2 ,200 feet south and 1 ,400 feet west of the northeast corner of sec. 6, T. 7 S ., R. 89 W. 0-1 inch to O; grasses, leaves, and twigs in various stages of decomposition. E1-0 to 8 inches; pinkish gray (7.5YR 6/2) loam, brown (7.5YR 4/2) moist; weak fine granular structure; soft, very friable, nonsticky and nonplastic; about 10 percent gravel ; slightly acid; clear wavy boundary. E2-8 to 24 inches; light brownish gray (1 OYR 6/2) extremely cobbly sandy loam, brown (1 OYR 5/3) moist; weak med ium subangular blocky structure; slightly hard, very friable, nonsticky and nonplastic; about 65 percent cobbles; slightly acid; clear wavy boundary . B/E-24 to 35 inches; brown (1 OYR 5/3) extremely cobbly sandy clay loam, dark brown (1 OYA 4/3) moist (B); light brownish gray (10YR 6/2) extremely cobbly sandy loam, brown (10YR 5/3) moist (E); weak medium subangular blocky structure; slightly hard , very friable, nonsticky and nonplastic ; about 65 percent cobbles; slightly acid; clear wavy boundary. Bt-35 to 60 inches; brown (7 .5YR 5/4) extremely stony sandy clay loam, darl< brown (7.5YR 4/4) moist; moderate medium subangular blocky structure; slig htly hard, friable, slightly sticky and slightly plastic; about 70 percent stones; thin nearly continuous clay films on sides of coarse fragments; slig htly acid . Som e pedons have a th in A horizon . Depth to the argillic horizon ranges from 30 to 40 inches. The E and 8/E horizons have hue of 1 OYA or 7.5YR . Evanston Series The Evanston series consists of deep, well drained soils on alluvial fans, terraces, and valley sides. These soils fo rmed in mixed alluvium. Slope is 1 to 65 percent. The average annual precipitation is 13 to 15 inches , and the average annual air temperature is 42 to 46 degrees F. These soils are fine -loamy, mixed Aridic Argiborolls . Typical pedon of Evanston loam, 6 to 25 percent slopes , about 1,200 feet south and 500 feet east of the northwest corner of sec. 26, T . 4 S., R. 86 W . A1-0 to 4 inches; brown (7 .5YR 5/2) loam, dark brown (7.5YR 3/2) moist; weak medium granular structure; slightly hard, very friable, nonsticky and nonplastic ; mildly alkaline; clear smooth boundary. A2-4 to 14 inches; brown (7 .5YR 5/2) loam , dark Aspen-Gypsum Area, Colorado . The northern portion of the 269.1 3 acre tract is adjacent to publi c lands administered by this office . Curren t uses on the ELM include wildlif e habitat, live stock grazing, and dispe r sed r e creation such as hunting. 1. Ownership of land adjace nt to ELM -administere d public land does not grant the adjacent landowner(s) any special righ ts or privileges for the use of the public lands . 2. Although the nearby public land has current permits for livestock grazing, the proposed 18.85 acre l ot does not lie adjacent to ELM. Under Colorado statutes, it i s a l andowner 's responsibili t y to construct, and maintain in good condition, a lawful fence protecting t heir property in order to recover any damages from trespass livestock. If a livestock fence i s not presently in place , a fence built along the private/ELM boundary is recommended to resolve this use conflict. The proponent should be aware of the locat ion of pro perty boundaries to ensure no encroachment occurs on public land. Sho uld any fence construction be considered along the private/ELM b o undary, the fence standards should allow for easy passage by big game. This office can provide additional information regarding fence standards upon reque s t. 3. Adjacent public lands are open to hunting and other dispersed recreation activities. The proponents should be aware that hunting and other recr e ation uses are allowed on ELM-administered land. 4 . Cox and Marilyn Cox respectfully petition the Board of County Commissioners for an exemption to create one (1) exempt lot consisting of approximately 18.85 acres along County Road 115 . A sketch map with vicinity map is enclo sed showing the lot proposed for subdivision exemption. By way of summary, Paul C. Cox and Cal vin H. Cox have owned the property since 1948. Calvin H. Cox in May, 1995, conveyed his half interest in th is property to himself and Marilyn Cox. The deeds evidencing their ownersh ip are enclosed with the application. Two subdivision exemptions for other parts of the property as it existed in 1973 have been sought prior to this application and were granted by Resolution Nos. 81 -191 and 94-098. The proposed exempt lot will be served by water from a well drilled under the provisions of C.R.S . 37 -92-602(1)(b)(Il)(A), whereby an owner of a tra ct of land 35 ac re s or more in size may obtain an exempt well permit for ordinary household purposes.
