Dear Mr. Collins, By direction of the Garfield County Board of County Commissioners in the local verification hearing held on August 6th, 2012 which was continued to September 10, 2012, we have done an investigation of your OPCO located at 4501 County Road 233, Silt, CO. The purpose of this letter is to provide you with a formal determination of the land use status of your property related to the OPCO. More specifically, this letter shall serve as a determination that memorializes the uses and/ or structures on your property that were in operation as of June 21, 2010 as legal non -conforming uses related to the OPCO. 1) The garage containing 1,800 sq. ft. which was constructed under building permit #7333 and received approval of its final inspection on 2/11/2002 (as evidenced in Exhibits A, C and a) may continue to be used as a garage as it was permitted. However, as the Board of County Commissioners has allowed you to continue to grow medical marijuana inside the structure via the local verification process, the structure itself shall be required to be modified as a commercial structure requiring a new building permit. 2) The County has evidence of a permitted septic system that may or may not be operational related to the garage structure. This will require field verification that it is properly permitted and installed. 3) The greenhouse: if the greenhouse structure located on the same property is being used to grow medical marijuana, it shall be removed or the medical marijuana shall be removed from the structure. By our evidence, this structure did not exist on the property prior to June 21, 2010 when the Board of County Commissioners put the moratorium in place via Resolution 2010-48 which prohibited the construction and use of new medical marijuana facilities. In fact, the attached photos dated April 29, 2011 do not show any greenhouse on the property. Additional photos taken on June 15th, 2011 and June 17°, 2011 show the construction in progress of the greenhouse as evidenced in Exhibits E, F, and G (approximately 1 -year after the moratorium was put in place). To reiterate, the Board of County Commissioners specifically did not approve the use of the greenhouse for growing medical marijuana in the local verification process. If the greenhouse is being used for private use only with no OPCO activity, it could be classified as an exempt agricultural building which does not require land use or building permits and may be allowed to remain as is. This office will contact you within 30 days of this Tetter to set up a site visit to field verify the use of the greenhouse. As with any legal non -conforming use and/ or structure, your existing operation cannot be expanded beyond its current existence as documented by the attached photographs taken on April 29, 2011 as provided for in Exhibits A, 8, C and D. This prohibition of expansion is more explicitly set out in the County's Unified Land Use Resolution of 2008, as amended and partially restated here: SECTION 10-101 APPLICABILITY. The regulatory provisions of this Article shall apply to all permitted land use, including divisions of land and signs, that do not conform to the applicable use regulations of this Code as a result of either the adoption or amendment of this Code, or a final administrative or judicial decision precluding the County from enforcing this Code specific to o use on the basis of estoppels, (aches, or waiver, SECTION 10-102 CONTINUATION OF NONCONFORMING LAND USE. A nonconforming land use may be continued and normal or routine maintenance shall be permitted, in compliance with the regulatory provisions of this Article. A. Nonconforming Structure: Unless otherwise prohibited by the provisions of this Article, a nonconforming structure may continue to be occupied. B. Nonconforming Use: Unless otherwise prohibited by provisions of this Article, a nonconforming use may be continued and normal or routine maintenance of the structure containing a nonconforming use shall be permitted. Normal or routine maintenance shall include any maintenance or repair which does not impermissibly enlarge or alter the structure containing a nonconforming use, in compliance with the provisions of Section 10- 103, Enlargement or Alteration of a Nonconforming Land Use. As you are aware, no additional approvals can be provided to you to eliminate the non- conforming status of your operation as the subject property is in the Rural zone district which prohibits OPCOs. PS Form 31300, August ?[]OG This letter confirms that on August 6, 2012, the Board of County Commissioners, as the Local Licensing Authority, provided local verification to the Medical Marijuana Enforcement Division for Green Natural Solutions, Inc.'s Optional Premises Cultivation Operation (OPCO). You obtained local verification, in part, because you were operating in unincorporated Garfield County prior to the June 21, 2010 moratorium. Because your OPCO was in place prior to the amendments to the Unified Land Use Resolution (ULUR), your OPCO may be a pre-existing, nonconforming use of the land. Please contact the Garfield County Community Development Department to confirm your pre- existing nonconforming status and to address the necessary building and other structure -related permits. Please contact Gale Carntoney, Code Enforcement Officer, within 45 days to set up a time for an inspection of your OPCO.
