Gale Carmoney, CFM Garfield County Building and Planning Dept 108 8th Street, Suite 201 Glenwood Springs CO 81601 RE: Antero Resources — Divide Creek Floodplain Development Permit Applications FDPA 6644 and 6645 Revised Submittal Dear Gale: June 16, 2011 i(ECE q I s JUN 2 0 2011 GARFELD COUNTY BUILDUUIC= A PLANNING At the request of Garfield County, Resource Engineering, Inc. (RESOURCE) reviewed the revised submittal for Antero Resources Corporation Floodplain Development Permit Applications for Divide Creek on the Simonson and Dixon Water Foundation properties. The revised submittal proposed to modify the temporary Divide Creek water bypass structure from an open channel to a pipeline. The proposed modification is shown on sheet 2 of 8 titled, "Divide Creek Temporary Diversion Plan" prepared by Schmueser Gordon Meyer dated May 27, 2011. The proposed plan is to install two 16 inch steel pipelines in the creek bed and to flume over the gas line trench. A steel plate headwall would be constructed at the inlet to the twin 16 inch pipes. The headwall would span the width of the Divide Creek channel bed to collect all flow in the creek. ANALYSIS The Lower Divide Creek floodplain is mapped by FEMA on FIRM Panel No. 080205 11110 dated August 2, 2006. There is no floodway delineation for Divide Creek. The floodplain is Area A with no base flood elevations. The proposed temporary by-pass pipeline will be located in the creek channel, which is the floodway for Divide Creek. Section 7-701 of the GARCO Unified Land Use resolution prohibits any fill or construction within the floodway. However, the proposed pipeline will be temporary and constructed after snowmelt runoff at low flow during irrigation season (irrigation ditches divert all flow on Divide Creek and lower Divide Creek has very little flow). The potential for large flows would come from an intense rainfall event. In the event of a 100 year rainfall runoff flow, the temporary by-pass pipeline would not result in damage to the Simonson House or any other structure downstream. The Simonson house is upstream and significantly higher in elevation than the by-pass pipeline headwall. The headwall would cause additional water to flow in the overbank area on the Simonson and Dixon Water Foundation properties. These overbank flows would return to the original floodplain at the County Road. Any potential increased flood impacts would be contained to the Applicants' properties and would not impact structures. Gale Carmoney From: Mike Markus (mmarkus@7o oaconsufting.com] Sent: Friday, May 20, 2011 4:22 PM To: Gale Carmoney Cc: Lorne Prescott, Dan Cokley Subject: Proposed revision to temporary diversion channel - Divide Creek (Antero) Attachments: Divide Creek Pipe Diversion Concept.pdf; dividecreek Plan (2) Stamped.pdf Gale, As we discussed over the phone, Antero is proposing revising the temporary diversion to a piped diversion. I appreciate your consideration and understanding of the situation. Per your request, here is information regarding the proposed revision, which is being proposed due to several factors: • Size, scope, construction complexity and variables with the channel diversion due to higher than normal springtime flows. You and f have discussed this issue previously and this has become a significant issue. • Schedule factors which have pushed construction to a summer timeframe and much lower anticipated flows that will enable safer and more reliable piped diversion • The piped diversion will most likely disturb less area than the channel diversion, but definitely not a larger disturbed area • The plan is to use two 16" pipes with a headwall to channel the water into the pipes and across the open cut trench to be located downstrearn Attached please find both the proposed revision to the temporary diversion plan, along with a copy of the currently approved plan. We would like to get your feedback on this proposed revision. We would appreciate consideration of this change as administrative, and within the parameters of the currently approved permit. If further review by the County's consulting engineer is required, Dan Cokley of SGM would like to have a preliminary discussion of issues that they may have so that he can address those in the revised design. As you indicated during our telephone conversation you indicated that GARCO has some options regarding the use of a consulting engineer and that this would be considered in order to turn around the review time as quickly as possible. We would certainly appreciate that consideration. Thank you for your consideration in this matter. Please contact me should you have any questions. The submittal was found to be thorough and well organized. The following comment was generated: • The Applicant requests that a waiver be granted from providing a floodway analysis and a floodway impact report. The reason being that the construction intends to restore the post - construction floodplain to match the existing conditions and therefore there will be no impacts to the floodplain. This waiver will need to be granted by the BoCC; but if it is granted, it should be with the condition that the as -built construction matches the existing conditions. Otherwise a floodway analysis and floodway impact report will be necessary. As -built drawings should be provided to the County for verification within two weeks of returning flows into the reconstructed Divide Creek. If existing conditions are not matched, analysis and impact reports should be provided to the County within 30 days for review. Feel free to call if you have any questions or comments. Please label major landmarks such as the Colorado River and Divide Creek, county roads in the vicinity, 1-70 and the Town of Silt to accommodate a reviewer that may not be familiar with the project site. Response 2: The Vicinity Map included within this response package includes the requested information. Comment 3: Although the WestWater Engineering Report includes the wetland delineation, it is placed on a low quality aerial that makes it difficult to locate the subject stream or any topographical features. Please delineate the wetland areas and vegetation features of significance clearly on 826 2116 Road TEL 970.263.7800 Grand Junction, CO 81505 FAX 970.263.7456 www.oaconsulting.corn the site plan or accompanying exhibit. Further, although the approximate floodplain is shown on the site pian, the Divide Creek channel is not clearly delineated. Response 3: An aerial photograph depicting the wetlands area is included in this response package, the wetlands area is depicted on the accompanying plans as appropriate. The Divide Creek channel is more clearly defined. Comment 4: One drawing in the submittal indicates the presence of a Qwest fiber optic line. It is not clear where this line is located and if it crosses the creek in the same vicinity of the proposed pipeline crossing. Response 4: The Site Plan and Sheet 1 of the "12" Pipeline As -Built and Plan & Profile enclosed within this response package depicts the location of the existing Qwest fiber optic line. This line continues northerly across County Road 311. Comment 5: Please indicate the subject property zone district. Response 5: The Garfield County rural zoning designation has been added. Comment 6: In accordance with ULUR 4-501 staff is recommending the Director waive the requirement of Me inclusion of water surface elevations and a floodway boundary as the proposed pipelines will be constructed below grade, the water course will not be permanently altered and the stream bed will be restored to its existing condition. Response 6: Acknowledged, no response required. Comment 7: The channel of the watercourse should be more clearly delineated on the site plan and any related plans or drawings. Response 7: The site plan and all related drawings have been revised to clearly delineate the channel of the water course. Comment 8: Floodplain Overlay: Construction Specifications- The submitted profiles are generally acceptable with the exception of inconsistencies as described in the General Note below. Please include a stream diversion plan and details stamped by a Colorado Registered Professional Engineer. Plans should include proper CMP sizing, appropriate BMPs and detailed restoration and revegetation plans for the stream banks which may include additional stabilization methods as indicated in the submitted grading permit application. Response 8: A "Divide Creek Temporary Diversion Plan" (three sheets) is included in this response package. Comment 9: Floodplain Overlay: Floodway Analysis -1n accordance with ULUR 4-501 staff is recommending the Director waive the requirement of a detailed hydraulic analysis as the subject water course will not be permanently altered and there will be no structures built at or above existing grade. Response 9: Acknowledged, no response required. Comment 10: Please include an opinion from a Colorado Registered Engineer that the proposed encased water line and steel gas pipeline with proposed cover- is adequate to resist flotation, collapse or lateral movement from hydrodynamic or hydrostatic loads. Response 10: Please refer to the email from Dan Cokley, P.E. Comment 11: Letter of Authorization- The Statement of Authority for the Dixon Water Foundation needs to be recorded. The Statement of Authority for Simonson property needs to be signed and recorded and the payment agreement for Simonson also need to be signed. Response 11: The recorded Statement of Authority for Dixon Water Foundation and signed authorizations from Jeff Simonson are enclosed. Per telephone conversation with Gale Carmoney on February 16th, 2010 it was acknowledged that a Statement of Authority for the Simonson property is not required as the property is held by an individual. Comment 12: General Note -Several of the exhibits contain inconsistent information. Although it is inferred throughout the application documents that the proposed pipelines will have a minimum of 5 feet of cover, the narratives in various exhibits indicate the trench will be dug only 5 feet deep. Other exhibits indicate the proposed pipelines will be placed at 4 feet bury depth. The WestWater Engineering report indicates distinctions between the two proposed water pipelines (such as HOPE vs. poly and one with a 16" encasement) and the grading permit application calls the water lines "twin". All of these inconsistencies should be corrected. Response 12: The plans enclosed within this response package accurately reflect the proposed details of the project. The proposed pipelines will be placed at a five (5) feet bury depth. Additional Information — Grading Permit Antero is currently in discussion with Andy Schwaller, Garfield County Building Official, regarding the necessity of a possible amendment of the current grading permit (GRAD -6-10- 1611) associated with the construction of the pipeline.
