DIRECTOR DETERMINATION - Floodplain Development Permit

Dear Michael,
This letter is provided regarding the Director Determination of a request for a Floodplain.
Development Permit for the above referenced project. This request is to allow for:
• The construction of a 12" water line, a 12" steel gas line and a 12" irrigation line
under Divide Creek, commencing at the southwestern intersection of County
Roads 311 and 335. Due to the difficulties of boring under the creek bed
construction will require a temporary diversion channel and open cut ditch to
place these pipelines within Divide Creek's floodway/floodplain and adjacent
wetlands.
The Director hereby approves the permit subject to the following conditions:
1. All representations of the applicant within the application shall be considered
conditions of approval unless otherwise modified by the Director Determination.
2. No alterations of the floodplain may be made other than the specific
improvements noted in the application and shown on drawings provided by
Daniel J. Cokely, P.E., of Schmueser, Gordon and Meyer (SGM) as labeled
"Divide Creek Temporary Diversion Plan" and surveys provided by River Valley
Surveying attached hereto as Exhibit A.
3. All new construction or substantial improvements shall be designed (or modified)
and adequately anchored to prevent flotation, collapse or lateral movement of the
stnicture resulting from hydrodynamic and hydrostatic loads, including the effects
of buoyancy.
4. All new construction or substantial improvements shall be constructed with
materials resistant to flood damage.

5. All new construction or substantial improvements shall be constructed by
methods and practices that minimize flood damage.
6. Regulated wetlands shall be restored to preconstruction. conditions.
7. Construction and reclamation shall adhere to all conditions of Garfield County
grading permit, GRAD -6-10-1611.
8. Applicant shall obtain and provide a ixtpy of a Utility Permit from Garfaeld
County Road and Bridge to the Building and Planning Department prior to
construction.
9. Construction shall adhere to any recommendations/requirements from the
County's consulting engineer if any are made.
10. Applicant shall provide a security in the amount of $14, 625 for rcvcgetation of
disturbed site and forward all noxious weed held surveys to the County
Vegetation Management Department upon completion of survey.
11. Applicant will adhere to the Weed Management Plan submitted with the grading
permit in particular removal of all Tamarisk and Russian Knapweed in the
construction area.
Notice will be provided to the Board of County Commissioners pursuant to §4-104B.
regarding "Reconsideration of Director's Decision or Call-up by the Board of County
Commissioners". A call-up would require that the Board file a written request within 10
days of this decision. You will be contacted if a written request is made for
reconsideration.
If no call-up for Board review if requested, the Land Use Change Permit to allow for
development within the floodplain will be issued with the above conditions.
