PLANNING At the request of Garfield County, Resource Engineering, Inc. (RESOURCE) reviewed the revised submittal for Antero Resources Corporation Floodplain Development Permit Applications for Divide Creek on the Simonson and Dixon Water Foundation properties. The revised submittal proposed to modify the temporary Divide Creek water bypass structure from an open channel to a pipeline. The proposed modification is shown on sheet 2 of 8 titled, "Divide Creek Temporary Diversion Plan" prepared by Schmueser Gordon Meyer dated May 27, 2011. The proposed plan is to install two 16 inch steel pipelines in the creek bed and to flume over the gas line trench. A steel plate headwall would be constructed at the inlet to the twin 16 inch pipes. The headwall would span the width of the Divide Creek channel bed to collect all flow in the creek. ANALYSIS The Lower Divide Creek floodplain is mapped by FEMA on FIRM Panel No. 080205 11110 dated August 2, 2006. There is no floodway delineation for Divide Creek. The floodplain is Area A with no base flood elevations. The proposed temporary by-pass pipeline will be located in the creek channel, which is the floodway for Divide Creek. Section 7-701 of the GARCO Unified Land Use resolution prohibits any fill or construction within the floodway. However, the proposed pipeline will be temporary and constructed after snowmelt runoff at low flow during irrigation season (irrigation ditches divert all flow on Divide Creek and lower Divide Creek has very little flow). The potential for large flows would come from an intense rainfall event. In the event of a 100 year rainfall runoff flow, the temporary by-pass pipeline would not result in damage to the Simonson House or any other structure downstream. The Simonson house is upstream and significantly higher in elevation than the by-pass pipeline headwall. The headwall would cause additional water to flow in the overbank area on the Simonson and Dixon Water Foundation properties. These overbank flows would return to the original floodplain at the County Road. Any potential increased flood impacts would be contained to the Applicants` properties and would not impact structures. The bypass pipeline should be in place for the minimum time necessary to complete the pipeline construction under Divide Creek. I appreciate your consideration and understanding of the situation, Per your request, here is information regarding the proposed revision, which is being proposed due to several factors: • Size, scope, construction complexity and variables with the channel diversion due to higher than normal springtime flows. You and I have discussed this issue previously and this has become a significant issue. • Schedule factors which have pushed construction to a summer timeframe and much lower anticipated flows that will enable safer and more reliable piped diversion The piped diversion will most likely disturb less area than the channel diversion, but definitely not a larger disturbed area • The plan is to use two 16" pipes with a headwall to channel the water into the pipes and across the open cut trench to be located downstream Attached please find both the proposed revision to the temporary diversion plan, along with a copy of the currently approved plan. We would like to get your feedback on this proposed revision. We would appreciate consideration of this change as administrative, and within the parameters of the currently approved permit. If further review by the County's consulting engineer is required, Dan Cokrey of SGM would like to have a preliminary discussion of issues that they may have 50 that he can address those in the revised design. As you indicated during our telephone conversation you indicated that GARCO has some options regarding the use of a consulting engineer and that this would be considered in order to turn around the review time as quickly as possible. Although the WestWatcr Engineering Report includes the wetland delineation, It is placed on a low quality aerial that makes it difficult to locate the subject stream or any topographical features. Please delineate the wetland areas and vegetation features of significance dearly on the site plan or accompanying exhibit. Further, although the approximate floodplain is shown on the site plan, the Divide Creek channel is not clearly delineated, f. One drawing in the submittal indicates the presence of a Qwest fiber optic line. It is not clear where this line is located and if it crosses the creek in the same vicinity of the proposed pipeline crossing. i. Please indicate the subject property zone district. ULUR 4-503 Description of Submittal Requirements for Land Use in Floodplain Overlay District A. Floodplain Overlay: Site Plan 1-2. In accordance with ULUR 4-501 staff is recommending the Director waive the requirement of the inclusion of water surface elevations and a floodway boundary as the proposed pipelines will be constructed below grade, the water course will not be permanently altered and the stream bed will be restored to its existing condition. 3. The channel of the watercourse should be more clearly delineated on the site plan and any related plans or drawings. C. Floodplain Overlay: Construction Specifications- The submitted profiles are generally acceptable with the exception of inconsistencies as described in the General Note below. Please include a stream diversion plan and details stamped by a Colorado Registered Professional Engineer. Plans should include proper CMP sizing, appropriate BMPs and detailed restoration and revegetation plans for the stream banks which may include additional stabilization methods as indicated in the submitted grading permit application. E. Floodplain Overlay: Floodway Analysis -In accordance with ULUR 4-501 staff is recommending the Director waive the requirement of a detailed hydraulic analysis as the subject water course will not be permanently altered and there will be no structures built at or above existing grade. 2 ULUR 7-701 Standards Within Floodplain Overlay G. General Standards- Please include an opinion from a Colorado Registered Engineer that the proposed encased water line and steel gas pipeline with proposed cover is adequate to resist flotation, collapse or lateral movement from hydrodynamic or hydrostatic loads. Other Information Letter of Authorization - The Statement of Authority for the Dixon Water Foundation needs to be recorded. The Statement of Authority for Simonson property needs to be signed and recorded and the payment agreement for Simonson also need to be signed. General Note -Several of the exhibits contain inconsistent information. Although it is inferred throughout the application documents that the proposed pipelines will have a minimum of 5 feet of cover, the narratives in various exhibits indicate the trench will be dug only 5 feet deep. Other exhibits indicate the proposed pipelines will be placed at 4 feet bury depth. The WestWater Engineering report indicates distinctions between the two proposed water pipelines (such as HOPE vs. poly and one with a 16" encasement) and the grading permit application calls the water lines "twin". All of these inconsistencies should be corrected. Please note that if the application is not complete, the Director shall inform the applicant of the deficiencies in writing and shall take no further action on the application until the deficiencies are remedied. The deficiencies have been indicated above. If the applicant fails to correct the deficiencies within sixty (60) calendar days, the application shall be considered withdrawn and returned to the applicant. Nothing to be alarmed about. I can revise the memo if you need that. 2) As l said in the memo refer to Section 12-103 D. 2 of the Unified Land Use Resolution 2008. That is the position we are taking. There are issues pertaining to the same pipeline that is associated with this floodplain application. We are not going to issue a floodplain development permit until the other issue is resolved. Please refer to front page of October 6, Post Independent if you have not heard about recent events. 3) and 4) As I mentioned on the phone yesterday, whether you reference to Section 4-104 (A) (4)- Administrative review process or if you [oak at 4-111 (A)(4) Development in the 100 year flood plain, both state the same thing "the applicant shall mail written notice by certified mail, return receipt requested, to the owners of record of all property adjacent to the property within 200 ft radius ...."
