The conditions under which the approval was based are as follow: 1. That all representations of the applicant, either within the application or stated before the Board of County Commissioners, shall be considered conditions of approval. 2. The Special Use Permit shall be issued when all conditions of approval are met and shall expire 360 days after issuance, unless the operation has commenced. 3. That all construction be in accordance with the engineering specifications and comply with the provisions of the Army Corps of Engineers nationwide permits for this type of floodplain/wetland development. 4. That the compaction of the fill material shall be field verified by the applicant's engineer, as it is being placed, and the engineer shall provide an "as -built" elevation certificate upon completion. 5. That the total cubic amount of fill material placed in the floodplain shall not exceed the total amount of cubic material excavated from the floodplain. 6. The owner of the tract shall be responsible for the control of all noxious weeds. 7. The approved hours of the hauling operation shall be from 8:00 a.m. to 5:00 p.m., Monday thru Friday. 8. McCafferty Garfield County Planner 109 8th Street, Suite 303 945-8212/285-7972 Glenwood Springs, Colorado 81601 • • Rudd Floodplain SUP 9/9/96 The subject tract is approx. 11.7 acres in size, located southeast of the interstate 70 rest area, south of the town of rifle, west of CR 320. The tract is relatively level and fully contained within the floodplain of the Colorado river. It appears the dominant vegetation is weeds with a few cottonwoods scattered around the tract. The applicant is requesting the issuance of a special use permit to allow the excavation of river gravels and the placement of fill within the regulated floodplain of the river. There is no intention of selling the materials as they would be used to elevate a portion of the subject tract out of the 100 -year floodplain, as well as an adjacent tract also owned by the applicant. A pit would be excavated in an area of approx. 3 acres to a depth of approx. 20 feet and an access road across a wetland would also be developed with the installation of a 24 inch culvert. The proposed operation has been identified within the 100 -year floodplain of the Colorado river and section 6.00 of the zoning resolution requires an approved special use permit for any development within the floodplain. The purpose of this review is to assure compliance with applicable regulations as well as review technical information. The floodway and flood fringe areas have been determined and it appears the area proposed for development is located entirely within the flood fringe. //The purpose of this review is to determine the following criteria: assure that all permits have been issued by the appropriate agencies; To determine that building sites will be reasonably safe from flooding and that structures are incompliance with certain standards for construction; ‘/To determine if the development is within the floodway; T9 assure that adjacent communities and governmental agencies have been notified of any proposed .G+atercourse alteration or relocation; and To assure the carrying capacity of the altered or relocated watercourse is maintained. Consistent with these requirements the following information has been submitted: / ✓ The applicant has consulted with a wetlands delineator and the army corps of engineers and have determined that wetlands on the property are largely being avoided. The corps has recently issued a nationwide general permit for this operation; Presently, no building sites are proposed. This application is to allow the excavation and fill of an area that would later be developed. Upon the certification of a Colorado professional engineer that the area has been elevated above the 100 -year floodplain, then no future floodplain special use ,permits would be required. This certification may require the creation and adoption of an updated /floodplain map for the affected area; The floodplain study concluded the only affected portion of the floodplain would be the flood fringe; No watercourse relocation or alteration is proposed; and, finally, Technically, it should be a requirement that the amount of fill placed in the floodplain does not exceed 110,,,s tl7 S�(Ed F 6Ao �� � ,fo g L • 0 the amount of material excavated from the floodplain. This provision would help to ensure that the carrying capacity of the 100 -year flood would be maintained. The applicant has a similar operation within the jurisdiction of the city of rifle. Staff notes that city regulations requires the verification of the compaction of the fill, as it is being placed. The county has no similar regulation and staffwould recommend that the applicant's engineer provide this service, as well as provide an as built elevation certificate upon completion. Concerning mineral rights, staff originally had some concern that the applicant had the legal right to use the gravel in this operation. I have discussed the operation with the applicant's agent and with the county attorney and it appears that the applicant does have the legal right to use the gravel resource.
