(Assessor's Parcel No. 2181-172-00-086) In accordance with and pursuant to provisions of the Garfield County Land Use and Development Code. as amended, and Resolution No. 2015-07 of the Board of County Commissioners of Garfield County, State of Colorado, the following activity is hereby authorized by Land Use Change Permit: A Booster Compressor located on a 1.48 acre site within a 1,400 acre parcel known as the WPX KP24-8 Booster Compressor (operated by WPX Energy Rocky Mountain UC) as shown on the Site Plan Attached as Exhibit "A" (GAPA-8028) This Administrative Land Use Change Permit Is Issued subject to the condttlons contained In Resolution No. 2015-07 and set forth in Exhibit "811 and shall be valid only during compliance with such conditions and other applicable provisions of the Garfield County Land Use and Development Code, as amended, Building Code, and other regulations of the Board of County Commissioners of Garfield County, Colorado. That all representations made by the Applicant in the application shall be conditions of approva1 unless specifically altered by the conditions of approval. 2. That the WPX Energy KP24-8 .Booster .Compressor shall be operated in accordance with all applicable Federal, State, and local -regulations governing the operation of this type of facility . 1 3. Prior to issuance of the Land Use Change Permit, the Applicant shall provide a copy of the Road Use and Maintenance Agreement demonstrating ongoing maintenance commitments for the acc;ess road consl~tent wlth the Application submittals and roadway assessment by the Fox Engineering Solutions Inc. including but not limited to dust control, snow removal, and upkeep of the driving surface and drainage improvements. Waivers from Section 7-107 Roadway Standards regarding right of way width, lane width, cross section details, and curve radius are approved pursuant to · the Fox Engineering SoJutlons Inc. report. 4. Prior to Issuance of the Land Use Change Permit, the Applicant shall provide a copy of the Emergency Response Plan applicable to the site including current contact Information for the Colorado River Fire and Rescue District and provisions regarding field or wildland fire prevention and emergency shutdown - ·of the facility. 5. Prior to issuance of the Land Use Change Permit, the Applicant shall provide confirmation that the site ls covered under an. existing COGCC reclamation plan aod bond. 6. The facility shall maintain compliance with the Light lndustria1 COGCC Noise Standards/Regulations. Prior to issuance of the Land Use Change Pennft the Applicant shall provide written corroboration of the COGCC extrapolation fonnula finding the site will be in compliance with the Light Industrial standards. If future compliance 'Issues are identifled, the Appllcant shall provide noise. mitigation In order to achieve compliance along with a technical evaluation by a qualified professional to conflnn compliance. 7. The facility shall maintain compliance with CDPHE Storm Water Management Permits. Drainage and Grading Plans, SPCC Plans and Reclamation Plans for the site. ExhibitB (page2of2) 8. The Applicant shall maintain all required COGCC and BLM permits and forms for the facility and shall comply with all best management practices, conditions of approval and requirements of said permits and forms. 9. The Applicant shall maintain all required CDPHE air quality permits for the facility. 1 o. The Applicant shall comply with the referral comments from Colorado Parks and Wiidiife (CPW) Including recommendations regarding scheduling of daily maintenance operations during winter months. 11. That upon completion of the installation of the compressor the Applicant shall contact the Colorado River Fire and Rescue District to schedule a final Inspection and site visit with the fire crew for pre--planning purposes. 12. The Applii;:ant shall apply for and obtain any building permits as required for the proposed compressor building. 13. The Applicant shall continue weed management on the site in compliance with existing plans and shall monitor and treat any Jointed Goatgrass that may be identified on the site .
