I. RELATIONSHIP TO THE COMPREHENSIVE PLAN:
District C (Rural Areas with Minor Environmental Constraints)
II. STAFF COMMENTS:
1. The applicant has owned this parcel approximately 15 months. They
qualify for the 10 acre split as applied for, as they are conveying the
tract to a daughter. However, the applicant does not qualify for the two
additional lot splits.
2. The Kuhns received approval to split the property into two parcels of
10 acres and 30 acres in January of 1983 with the following conditions:
A. Only one new 10 acre parcel would be created for conveyance to a
child (40 acres to be split into 2 tracts of 10 and 30 acres
each). The additional 15 acre parcel is not allowable through
this procedure.
B. Should the Board of County Commissioners wish to approve this
request, the following should be included in the legal
descriptions of the parcels:
1. Maintenance easements to the well from each parcel;
2. Conveyance of a minimum of 5 gpm of water to each parcel;
3. Access easements for each parcel;
C. The applicant must submit a $200.00 (per each new lot) school
assessment fee to the Planning Division prior to signing of the
exemption resolution.
III. RECOMMENDATION:
Approval with the following conditions:
1. Only one new 10 acre parcel be created for conveyance to a child.
2. That a 5000 gallon water storage tank be installed with:
A. Maintenance easements to the storage tank and a well site for
both parcels on the plat.
3. Access easements described on the plat.
4. The applicant must submit a $200.00 school assessment fee to the
Development Department prior to the signing of the exemption
resolution.
5. The applicant must submit a $1,000.00 contribution to the County Road
and Bridge fund for the Silt Bridge.
