J. Colohan Use of A parcel of land situated in the NW 1/4 SW 1/4 Section 34, T7S, R96W; located approximately 5.5 miles west of Parachute on the south side of the Colorado River, adjacent to county Rds. 300 and 339, in the vicinity of the new Una Bridge. The site consists mining area, all 500+ acre ranch. None None of a 3.7 acre as part of a large county Roads 300 and 339. A/R/RD A/R/RD and P.U.D. I. RELATIONSHIP TO THE COMPREHENSIVE PLAN The site is not classified by the Comprehensive Plan Management District Map. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The site is located in a rural portion of the country, with land uses in the vicinity including ranching, several single family dwellings, open space, an existing gravel pit, and a proposed industrial park, P.U.D. B. Project Description: The applicant proposes to develop the 3.7 acre site for the extraction of rip-rap and large rock, with no crushing or mixing plant involved with the operation. Approximately 3 acres of land will be mined to depths as much as 40 ft. III.MAJOR ISSUES AND CONCERNS 1. The mine site is immediately adjacent to County Rd. 300 and both north and south of county Rd. 339. Traffic on both roadways should remain unobstructed at all times, with appropriate signage and maintenance as per county Road and Bridge Department recommendations. 2. Due to the potential for damage to county Rds. 300 and 339 from mining and hauling operations, a road reclamation bond should be required. The county Road and Bridge Department recommends an $8000 bond for the approximately one mile of county roads involved. -1- 3. The applicant is required to obtain State approval through the Colorado Mined Land Reclamation Board for this operation, to include posting a mine reclamation bond. Any county approval should be conditional on the applicant submitting proof of MLRB approval and compliance. IV. SUGGESTED FINDINGS 1. That proper public notice was provided as required by law for the hearing before the Board of County Commissioners. 2 . That the hearing before the Board of county commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearing. 3. That for the above stated and other reasons, the proposed special use is or is not consistent with the best interests of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield county. RECOMMENDATION 1. 2. 3. 4. 5 • All representations of the applicant, either within the application, or stated before the Board of county Commissioners, shall be considered conditions of approval unless stated otherwise by the Board. M( 10 ; "f'C;: i,. ,~ '.- The applicant, or operator, shall notify the County RoTIJd and Bridge Department prior to becoming active on the site. In addition, the applicant shall provide ongoing maintenance to county Roads 300 and 339 under supervision of the county Road and Bridge Supervisor, including but not limited to, maintaining these roads in not less than their original condition, and dust control measures as needed. The applicant shall submit and keep active during operation, an $8000 bond to ensure compliance with Condition i2. The applicant shall obtain road cut permits and post traffic signs as required by the county Road and Bridge Department. The applicant shall submit proof of approval the Colorado Mined Land Reclamation Board extraction operation, to include reclamation by the MLRB. and compliance from for the proposed bonding as required 6. The applicant shall have 120 days from the date of the Resolution of Conditional Approval to meet all conditions set forth in the Resolution.
