As we discusSJd earlier this week, it appears that your gravel pit approval has expired. Based
on the information in the file, your conditional approval expired in October of 1987.
It appears that your intent lo put your application in an inactive status had a different
interpretation in terms of the County regulations and Colorado Mined Land Reclamation
Division regulations. Inactive status in Garfield County would be the equivalent of
withdrawing the application. To reactivate the application, it will be necessary to take the
application through the same review process after submitting what is essentially a new
application form with the current submittal requirements. I am enclosing an application form.

There has been over $1,500 expended on this effort to date, and the poten-
tial for the site is dependent upon the amount of appropriate construction
in that vicinity in the next few years .

This is in reference to the Special Use PerKit Application of
William J, Colohan, Resolution No. 86-115, with Conditional
Approval dated 20th October 1986.
It is requested that the Conditional Approval for this Special
Use Permit be extended for an additional 120 days.
The reason for request for this extension is that additional
restriction for the type of rock required for construction now
underway in DeBeque Canyon have been included that will entail
more time to determine if our operation will satisfy those re-
quirements on an economically competitive basis. Specifically,
the new Colorado State Highway contract requires that all rip
rap material to be used on this project is required to have
at least one fractured face to each rock. This adds another
unplanned dimension in our operational requirements.
Consequently, additional time is needed to ensure that these
new conditions can be satisfactorily resolved.

Enclosed is Application for Special Use Permit and approp-
riate plans, maps and exhibits. The purpose for this permit
is for a Mined Land Permit (Limited Impact Permit (110)} to
be authorized by the Mined Land Reclamation Board of Colorado.
The land to be used for this mining operation is adjacent
to the New Una Bridge construction site all of which is south
of the roads extending from that bridge.
Material to be mined will be rip rap and rock. There will
be no crushing or mixing plant at this mining operation.
The land will be reclaimed to an agricultural status.
Justification for this permit is threefold. First, it will
improve and repair some 700 feet of destabilized bank above
these two roads. Second, it will reclaim the lands scarred
and damaged and left unreclaimed by El Dorado Construction
Company during their period of construction on the Una Bridge
project. And third, it is evidently the last source of ac-
ceptable material for rip rap from west of Parachute along
Interstate 70 to Palisade, the lands in between being predom-
inantly sandstone and shale rock.
It is felt that the costs of repair to do what is necessary
to properly reclaim this land, if done by Garfield County,
would far exceed $500. Therefore, it is requested that the
fee of $500 for the Special Use Permit Fee, if granted, be
waived.

Pursuant to the requirement of the Colorado Mined Land Reclamation Act* to
inform counties and certain municipalities of mining and reclamation permit
applications filed with this office, please know that William J. Colohan has
filed to conduct surface mining at or near Section 34.0, Township 7.Q S, Range
96.0 W, 06th Prime Meridian. The applicant proposes to reclaim the site for
general agriculture.
The Mined Land Reclamation Board must deny a permit for any proposed mining
operation which would be in violation of zoning, subdivision regulations or
any master plan for extraction (See C.R.S. 34-32-115(4)(e)). Similarly, the
Board cannot grant a permit for a new mining operation if the operator's
reclamation plan for an area is inconsistent with an adopted plan by any
county, city and county, city, or town unless a prior declaration of intent to
change or waive the prohibition is obtained by the applicant from the affected
government subdivisions (See C.R.S. 34-32-109(8)). Please return the enclosed
form to provide this critical information.
The applicant is required to place a copy of the application for public
inspection with the Clerk of the county in which the proposed mine is
situated. This is intended to provide the application for public review and
comment. Please note that it is not intended to be made a part of public
record by recording.
The Board is tentatively scheduled to consider this application on
December 19, 1986.
