STATE OF COLORADO )SS county of Garfield ) At a commissioners Meeting Room the 20th regular meeting of the Board of county for Garfield County, Colorado, held at the Commissioners' at the Garfield County courthouse in Glenwood Springs on day of October A.D. 19~, there were present: Larry Schmueser , Commissioner Chairman Robert Richardson , Commissioner Flaven J _ Cerise (absent) , Commissioner Don Deford I county Attorney Mildred Alsdorf , Clerk of the Board Chuck Deschenes , County Administrator when the following proceedings, among others were had and done, to-wit: RESOLUTION NO. 86-115 A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT APPLICATION BY W. J. COLOHAN. WHEREAS, the Board of county Commissioners of Garfield county, Colorado, has received application from W. J. colohan for a Special Use permit for the extraction of natural resources on the following described tract of land: See Exhibit A {in the State of Colorado and the county of Garfield); and WHEREAS, the Board held a public hearing on the 13th day of October, 1986, upon the question of whether the above-described Special Use permit should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said Special Use permit; and WHEREAS, produced at determination the Board on the the aforementioned of fact: basis of substantial competent hearing, has made the evidence following 1. 2. That proper publication and public notice was provided as required by law for the hearing before the Board of county commissioners. That the hearing before the Board of County commissioners was extensive and complete, that all periinent facts, matters and issues were submitted and that all interested parties were heard at that hearing. 3. For the above stated and other reasons, the proposed use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield county. NOW, THEREFORE, BE IT RESOLVED by the Board of county commissioners of Garfield county, Colorado that the Special Use permit be and hereby is authorized permitting the use of the above described tract of land for the extraction of natural resources upon the following specific conditions: 1. All representations of the application, or stated before the shall be considered conditions otherwise by the Board. applicant, either within the Board of County commissioners, of approval unless stated -· 2. The applicant, or operator, shall notify the County Road and Bridge Department prior to becoming active on the site. In addition, the applicant shall provide ongoing maintenance during operations, anc at completion of operations, to County Roads 300 and 339 under supervision of the County Road and Bridge Supervisor, including, but not limited to, maintaining these roads in not less than their original condition, and dust control measures as needed. 3. The applicant shall submit and keep active during operation, an $8000 bond to ensure compliance with Condition #2. 4. The applicant shall obtain road cut permits and post traffic signs as required by the County Road and Bridge Department. 5 • The applicant shall submit proof of approval the Colorado Mined Land Reclamation Board extraction operation, to include reclamation by the MLRB. and compliance from for the proposed bonding as required 6. The applicant shall have 120 days from the date of the Resolution of conditional Approval to meet all conditions set forth in the Resolution. The Special Use permit shall be issued when all conditions are met and shall expire 120 days after issuance unless use has commenced. Dated this 20th day of October , A.D. 1986. ( ( EXHIBIT A LEGAL DESCRIPTION UNA RANCH PIT A parcel of land located in the Northwest One-Quarter of the Southwest One- Quarter of Section 34, Township 7 South, Range 96 West of the Sixth Principal Meridian, Garfield County Colorado. Said parcel is more partic- ularly described as follows: Beginning at a point from which a stone found in place and set for the West One-Quarter Corner Section 34 bears N 13°24'40" W 572.12 feet distant; thence N 38°35'37'' E 200.00 feet; thence N 62"08'36'' E 145.65 feet; thence N 80°21'46" E 365.90 feet to a point on the southerly right of way of Garfield County Road No. 300; thence following said southerly right of way the following courses and distances: 1. S 76°18'00'' E 219.90 feet 2. 141.00 feet on the arc of a curve to the right having a radius of 522.59 feet, the chord of which bears S 68"34'15" E 140.57 feet 3. S 60°50'30" E 106.22 feet 4. 20.01 feet on the arc of a curve to the left having a radius of 205.00 feet, the chord of which bears S 63°38'15" E 20.00 feet thence leaving said southerly right of way S 23°33'59" W 150.00 feet; thence N 62°34'23'' W 192.20 feet; thence N 74°19'28'' W 233.28 feet; thence S 80°18'05'' W 317.77 feet; thence S 61°11'00'' W·ll7.92 feet; thence S 34°06'31'' W 143.51 feet; thence N 51°24'23'' W 150.00 feet to the point of beginning. Said parcel contains 3.749 acres, more or less. All as part of a 500+ acre parcel described in Book 675, Pages 348-356.
