PRACTICAL LOCATION: Intersection of CR 300 and SH 6 southwest of Parachute TYPE OF APPLICATION: Amended Special Use Permit (Major Impact) DATE: February 26, 2015 I. GENERAL PROJECT DESCRIPTION Applicants seek to amend approvals granted by the Board of County Commissioners for Extraction, Processing, and Material Handling of Natural Resources as documented in Resolution 2005-15. Specifically this resolution permitted a hot mix asphalt batch plant to be located within the Una Gravel Pit. Conditions of approval included road issues related to CR 300 and the intersection of SH 6, as well as an expiration date of the permit of December 2004. Specific conditions of approval that are requested to be removed include: 4. A new driveway access shall be constructed that is a minimum of 80 -feet wide to allow for trucks to turn in and out of the location without damaging the shoulder of the road. 5. At the time that improvements are made to County Road 300 the Applicant shall construct an asphalt mat the width of the driveway extending into the location for 20 -feet and a depth of 4 -inches attached to the paved edge of the existing road. There is a possibility that CR 300 will be under reconstruction and coordination between all companies will be needed. 6. The Applicant shall install a stop sign to be placed at the entrance to CR 300 as required by the MUTCD (Manual on Uniform Traffic Control Devices). The stop sign will be the high visibility type and a minimum of 36 -inches by 36 -inches. 1 7. The Applicant shall install two (2) signs stating that trucks will be turning, to be placed 300 -feet north on the west side of CR 300 and 300 -feet south on the east side of CR 300. These signs will be installed as required by the MUTCD (Manual on Uniform Traffic Control Devices). These signs will be the high visibility type and a minimum size of 36 -inches by 36 -inches. 10. The Applicant shall not operate this temporary SUP past December 1, 2004 All conditions above related to traffic signs and driveway improvements have been completed by the Applicant. Elam Construction was recently awarded the 1-70 overlay of asphalt in DeBeque Canyon and seeks to place the portable asphalt batch plan within the existing Una Gravel Pit. The project will commence in April 2015 with paving proposed to occur between July and mid- September. The application will seek waiver of the standard in Section 7-1001 H. which requires hours of operation to be limited to Monday through Saturday 7 a.m. to 7 p.m. 'or as approved by the decision-making authority'. The overlay project (CDOT) requires that the activities occur at night therefore hours of operation will be Sunday through Friday 6 p.m. to 6 a.m. Minor modifications are proposed to the site plan to locate the plant centrally within the pit area to minimize potential impacts to adjacent properties and to better allow for truck flow through the site. The applicants seek this approval without expiration with an allowance to permit temporary asphalt batch plant operations at this site for a period not to exceed 120 -days annually. This would be restricted to use of asphalt produced for `public' projects only — typically federal, state and local road overlay projects. Due to the issues requested to be amended the Director has determined that the proposed amendment constitutes a Major Modification and stipulates the submittal requirements contained below. II. DBA GRAND JUNCTION CONCRETE PIPE CO. HOT MIX ASPHALT PLANT AT UNA GRAVEL PIT March 2015 INTRODUCTION The Una Gravel Pit was permitted by Garfield County and the Colorado Division of Reclamation, Mining and Safety during the 1980's. Originally, most of the sand and gravel resource removed from the site was use in the construction of Interstate 70. Since that time, gravel from this site has been used for a multitude of projects, both public and private. Elam Construction, Inc. dba Grand Junction Pipe and Supply Company of Grand Junction is the current operator of the Una Gravel Pit. The site consists of 223.13 acres 4.5 miles southwest of Parachute, southeast of the intersection of US Highway 6 and 24 and County Road 300 in Garfield County. A Special Use Permit was granted in early 2004 and formalized by the issuance of Resolution 2005-15 to allow a temporary, portable hot mix asphalt plant at the Una Gravel Pit. This request to amend this Garfield County Special Use Permit has two objectives described below: Temporary use of asphalt plant within permitted boundary of Una Gravel Pit. This request is for intermittent use on a continuing basis for the life of the gravel pit not exceeding 120 working days per calendar year. Night time operations (job Specific). A request for a waiver to Section 7-1001 H, Hours of Operation is included in this application for night time operations. The incentive for amending this Special Use Permit is that Elam Construction, Inc. was recently the successful low bidder on a Colorado Department of Transportation (CDOT) overlay project on 1-70. CDOT has recently begun specifying night work on its publically funded projects in an effort to increase safety, avoid traffic conflicts and overall improved project efficiency. The Una Gravel Pit, located at the western portion of Garfield County makes sense to be utilized for asphalt paving projects, such as the CDOT project discussed, in addition to supplying gravel products. This narrative, along with the accompanying maps and other attached information will provide sufficient data to assess the merits of the requested amendments to the afore mentioned Special Use Permit. 1 EXISTING ACTIVITIES EXISTING LAND USE - The site is irregular in shape and is approximately 4,250 feet in length north/south, and 3,580 feet at its widest east/west point. The primary present use is a sand and gravel pit Ground cover ranges between non-existent (in areas where overburden has been removed to expose gravel) to natural grasses, forbs, and shrubs. The main channel of the Colorado River forms the properties southerly boundary. The topography of the site generally slopes to the river at a rate of one percent. EXISTING ZONING - Review of the Garfield County Zoning Map, reveals that all of the subject property is zoned R (Rural). SURROUNDING LAND USE - The surrounding land uses in the vicinity of the subject property are considered to be "low" intensity. Predominant use adjoining the site is: range land and industrial activities associated with the oil field industry. Other nearby uses include: moderate sized properties consisting of grazing and pasture land, some with single family residences. Nearby uses adjacent to the Colorado River consists of wildlife habitat. All of the property surrounding the subject site is privately owned. MINING ACTIVITIES - The Site Plan Map, included at the end of this Narrative depicts the current permit boundary, mining areas, site features, and the location of other uses ancillary to the operation. Current operations, which include mining and crushing or processing of the aggregate are limited to the hours of 7:00 A.M. to 7:00 P.M., Monday through Saturday. Setbacks, as approved in the original mining plan, between the mining area and the permit boundary have been maintained to protect the integrity of the adjoining land. The sand and gravel mining process will be conducted using loaders, and/or excavators. Blasting of the resource is not necessary. Haul trucks will transport the resource to the nearby crushing and screening area located adjacent to each of the phased extraction areas, or the ultimate delivery site. The crushed and screened material will then be loaded, transported and stockpiled nearby CRUSHING AND STOCKPILE ACTIVITIES -•The excavated gravel resource is crushed and stockpiled according to size in an area near the extraction site. Since a portable crusher is used, the location of the crushing operation changes as the mining proceeds across each of the mining areas. Crushing apparatus will be operated under the stipulations contained within the Construction (Air) Permit issued by the Colorado Department of Public Health and Environment, Air Pollution Control Division. HAUL ROAD -Private drive access to the site is gained from County Road 300 which is in good repair and affords excellent access to US Highway 6 and 24 and 1-70. The alignment of the haul route on site may vary as mining and crushing activities progress across the site. 2 WATER INFORMATION- The predominant drainage course found in the vicinity is the Colorado River, which forms the southerly permit boundary. All of the land within the permit boundary and surrounding areas are within the 100 year flood plain. Mining is conducted in a manner that will not increase the discharged amount of surface stormwater runoff above historic flows. Any storm water runoff entering the site will be captured within the pit area. In order to maintain the quality of any surface stormwater, which crosses any exposed ground areas, a Storm Water Management Plan (SWMP), has been prepared and implemented for this site. A key element of the plan calls for grading the area in a manner that will not allow the discharge of any silt laden storm water from the property in the event of a storm. Thus, eliminating any stormwater discharges from the disturbed areas of the site. Water is used on site when necessary to control dust in the mining area, during crushing operations, and on haul roads. A Substitute Water Supply Plan, for the Una Gravel Pit has been obtained from the Office of the State Engineer. The plan calls for the replacement of depleted water to the river system resulting from losses at the site with leased Wolford Mountain Reservoir water. 3 PROPOSED ACTIVITIES With this land use application to Garfield County, a portable hot mix asphalt plant is proposed to be erected within the Una Gravel Pit site on an intermittent basis. Asphalt production is seasonal and normally occurs between the months of April and October. A typical layout for an asphalt plant can be found at the end of this narrative. Although the actual location of the asphalt plant will change as mining progress across the property, the general location of the asphalt plant is anticipated to be in the west central portion of the site. In the 2004 Use Permit, the asphalt plant was located near the site entrance off County Road 300. Any asphalt plant that operates in the State of Colorado must meet or exceed all State emission requirements. A Construction (air) Permit, for the hot mix asphalt plant that will occupy the site, has been obtained from the Colorado Department of Public Health and Environment. Components associated with the asphalt plant include: control house, liquid asphalt and diesel fuel storage, air emission controls (bag house), aggregate feed bins, mixer drum, conveyors, lime silo, truck loading equipment, power supply (generator), quality control or lab trailer and storage silo. TRAFFIC ANALYSIS By analyzing asphalt plant production levels, available trucks, and the location of the facility in respect to the trade area, traffic projections can be made. The follow assumptions are used in estimating traffic projections: The average number of employees working at the asphalt plant is 5. Two types of trucks may be used for hauling asphalt: 10 yard dump trucks with a capacity of 14 tons and 24 ton capacity belly dump trucks. The type of truck used to haul asphalt is job dependent. However, it is anticipated that a major percentage of the loads will use 24 ton capacity belly dump trucks. Normal hours of operation are usually between daylight and dark, Monday through Saturday. However, with this application is a waiver request for night time operations that is discussed in a later section. By using the above listed assumptions the following traffic projections can be made for the asphalt plant: 1. Maximum daily truck round trips per day: 110 2. The Applicant shall not operate this temporary SUP past December 1, 2004 All conditions above related to traffic signs and driveway improvements have been completed by the Applicant. 5 WAIVER OF STANDARDS REQUEST This section requests a waiver to Section 7-1001 H of the Garfield County Land Use Development Code. Specifically, this section of the LUDC addresses hours of operation. The LUDC states "Any activity that will generate noise, odors, or glare beyond the property boundaries will be conducted between the hours of 7:00 a.m. to 7:00 p.m. Monday through Saturday, or as approved by the decision-making authority." As mentioned above, the Colorado Department of Transportation has begun requiring work performed as part of their publically funded projects be performed during the hours of 6 pm to 6 am. This is done in an effort to increase safety, avoid traffic conflicts and overall improved efficiency. Work is not allowed on weekends. CDOT has specified for the recently awarded DeBeque Canyon project that work be performed weekly commencing at 6 pm to 6 am, Sunday evening to Friday morning. Evening work for this project is not limited to asphalt paving. The scope of this particular project includes removal and replacement of the concrete median barrier, replacement of guardrail, milling of existing asphalt surface within travel lanes and placement of new asphalt in travel lanes. In addition to asphalt production, night work specific to the referenced CDOT project will include material delivery and removal to the Una Pit. The duration of this CDOT project associated with the waiver request is from mid-April through October of 2015. Night operations discussed in this waiver will be in addition to the normal day activities. There will be no mining or crushing activities allowed during night operations. WORKSITE LIGHTING During night time operations, as with any industrial operation, employee safety is of utmost importance. To this regard, lighting of work areas is a crucial component of the night time work site to ensure this safety. Portable light plants are typically utilized to aid in providing this safe environment. A typical light plant will have a mast height of 25 feet and will be comprised of four adjustable lights. The individual light are directed towards the specific works areas. With this careful positioning of individual portable light plants and the directional adjustment of individual lights, the opportunity for fugitive light to escape the property. An example of a typical lighting plan is included at the end of this narrative. NOISE By locating the asphalt plant in the central regions of the site, and behind finished product stockpiles, noise levels at the property boundary can be minimized. The operator has demonstrated that they can comply with the standards set forth by the State of Colorado at other locations in which they have operated the portable asphalt plants, including evening hours. Night time operations have occurred in Eagle County (2014) and Pitkin County (2012). During these night operations, noise levels were monitored with no exceedance over the 50 dB(A) threshold mandated by state statute. 6 HOT MIX ASPHALT PLANT TYPICAL NIGHT LIGHTING Portable light plants will be erected and the individual lights positioned to achieve a safe work environment for employees. The portable light plants will be positioned around the asphalt plant, similar to the lighting plant below. In this example, five light plants are positioned around the asphalt plant for adequate lighting. The individual lights will be aimed generally downward towards the ground (approximately 20° below horizontal), lighting the work area surrounding the asphalt plant. With proper positioning and adjustment, the actual light is confined to the work area as shown on the figure below. As soon as practical after the sun goes down, the light pattern will be visually inspected and adjustments made to the individual lights as required. Once the required plant lighting has been achieved, an off-site inspection will occur to make adjustments to the individual lights, if needed, to further reduce or eliminate any offsite fugitive lighting. The off-site inspection will occur at locations near surrounding residential dwellings. Vehicle traffic will be entering and exiting the site during night operations. Primarily trucks used to haul the hot mix asphalt.
