BEFORE THE BOARD OF COUNTY COMMISSIONERS OF
GARFIELD COUNTY, COLORADO
PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) §30 -28 -101(10)(a) -(d) as
amended, and §§2.02.01(d) and 3.01.01 of the Subdivision
Regulations of Garfield County, Colorado, adopted January 2,
1979, the undersigned petitioner respectfully requests the
Board of County Commissioners of Garfield County, Colorado,
to exempt by resolution the division of an approximately_480
acre tract of land into two tracts of
roximately 2.4 and
477.6 acres each, more or less, from the definitions of
"subdivision" and "subdivided land".
The basis upon which the exemption is requested is that
the subdivision falls within situation 6 of Garfield County
Resolution 80-65. Ownership for at least five years is
4 ;D
based upon the fact that the --acre parcel of concern
herein was granted to J. Gentry on April 7th, 1978.
The 2.4 acre tract will be sold and the remainder of
the 480 tract will be retained by Gentry.
The following exhibits are submitted in support of the
petition.

of the parcels.
B. Copy of deed to J. Gentry dated April 7,
1978.

Also attached to this petition is a check covering the
$53.00 fee for review of the petition. Full legal descrip-
tions and the $200.00 school fee shall be submitted after

SUBJECT: Letter of Feasibility for Sewage Disposal -J. Gentry Petition
for Subdivision Exemption
Based on the information received by this office and past experience
with sewage disposal facilities in the immediate area of the proposed
exemption, this office has determined and believes on-site sewage dis-
posal facilities to be both feasible and practical, commensurate with
both County and State regulations, provided proper permits are obtained
prior to construction.
It should be further noted that due to the known conditions, only the
following types of on-site sewage disposal systems would be acceptable,
provided unforseen problems are not encountered:

Dear Keith:
Enclosed is a request to subdivide a 480 acre tract into one
tract of 2.4 acres and another of 477.6 acres. The applicants have
informed me that there is an existing well on the 2.4 acre parcel
which has been there for over 50 years. They stated that a well
permit was not required back then. Is this correct? If so,
may they use this well to serve the 2.4 acre parcel?
