Donlan respectfully petitions the Board of County Commissioners of Garlield County, Colorado, to exempt by Resolution the divisio n sf (2) l}tl acre tractsof land into 3 tracts of approximately - acres each, more or leSs, from the definitions o[ "subdivision" and "subdivicled land" as the termsare used and defined in C.R.S. Sketch map at a minimum scale of l"=200'showing the legal description o[the property, dimension and areaof all lotsorseparateinteresls to becreated, access to a public right-of-way, and any proposed easements for drainage, irrigation, access or utilities; B. Vicinity map at a minimum scale of l"=2000' showing the general topographic and geographic relation of the proposed exemption to the sttrrounding area within two (2)miles, forwhichacopy of U.S.G.S. quadrangle map maybeused. C. Copy of the deed showing ownership by the applicant, or a letter liom the property owner(s) if other than the applicant; and D. Names and addresses of omers of record of land immediately adjoining and within 200 feet otthe proposed exemption, mineral owners a ntl lessees of mineral owners of record of the property to be exempted, and tenanls of any structure proposed for conversion; and E. Evidence of the soil types and characteristics of each type; and F. Proof of legal and adequate source of domestic water for each lot created, method of sewage disposal, and letter of approval of l-rre protection plan from appropriate fire district; and G. If connection to a community of municipal water or sewer system is proposed, a letter from the governing body stating a willingness to serve; and H. Narrative explaining why exemption is being requested; and L It shall be demonstrated that the parcel existed as describetl tln January I , 1973 or the parcel as it exists presently is one of not more than thre,e parcels created lrom a larger parcel as it existed on January 1,1973. The majority of the property is located between the county road and main elk creek, with approx. 6 acres, west of the county road on the hillside. Vegetation varies considerably and the tracts are currently undeveloped. The property is in an area of rural residential and agricultural land uses; and the forest service administers significant lands east and west of the property. This petition is to further subdivide, by exemption, the 12.5 acre tracts into a total of 3 parcels, rangng in size between 6 and 9.8 acres. If approved, staffpresumes the parcels would be developed as residential sites. My research has concluded that the subject tracts were created by exempti onin 7916, from a 49 acre parcel that existed prior to January l, 1973. Resolution 76-6I created two, 72.5 acre parcels and a 20 acre parcel, thus, in the discretion of the Board, an additional parcel could be created. In fact, this application contemplates the impediment to joint use argument, where the 6 acre tract is being proposed due to the county road severing it from the balance of the property. I will note that the original resolution creating these parcels contains what I will call a condition of approval, noting "that said division will actually restrict the density of housing within said area and should therefore be exempted." Under the regulations and in the discretion of the Board an additional parcel could be approved, however, it would increase the residential density of the area. The property is zoned A/R/RD and all proposed lots are in excess of the 2 acre minimum lot size requirement. Main elk creek flows tkough the property; however, the floodplain is not mapped and, thus, the 1OO-year floodplain is indeterminate. In fact, I note that Resolution 76-61noted concern for the floodplain and its potential effects to the property. Section 6.04 of the zoning resolution provides authority in requiring subdivision applicants to complete floodplain studies, where none exist. I note this application is for an exemption; however, I suggest that this level of detail would be appropriate. Additionally, lot 3, the proposed 6 acre parcel west of the road, may have slope constraints in excess of 40Yo, which at this time is inconclusive that provisions of Section 5.04.02 of the zorung resolution can be met. I suggest that any approval, without explicit determination that these provisions can be met, would be premature. In terms of water supply, two wells are contemplated to serve the 3 lots; one of these wells would be shared among two lots and the other well used individually. Both wells were originally permitted by the State. Well #1 was drilled to a depth of 103 feet and produced 15 gpm in a test of unknown duration. Likewise, the other well was drilled to 83 feet, which produced 20 gpm in a test of unknown length. Water samples from both wells have been analyzed, and determined to be within state limits, for the tested analytes. oo I have discussed the wells and permits with the Division of water resources, who suggests that administration of one ofthe wells would be required. This administration would likely take the form of a full augmentation plan, since the property is in the West Divide Water Conservancy District Area B, and water from regional reservoirs cannot be used for year-round augmentation purposes. I note that an approved augmentation plan would require involvement of engineers and attorneys and would obviously be a lengthy and time-consuming process. Indiy[$ual sewage disposal systems would be utilized for wastewater treatment and according to the fores\service, the soils are classified as Fluvaquents and Sinkson channery loam. According to the forest service, Fluvaquents are subject to flooding during spring runoffand after severe thunderstorms and are considered unsuited for almost all other uses. The Sinkson soil has very little analyical information. I have cross-referenced this information with the Soil conservation service soils information and the soils would be classified as Torrifluvents and Ascalon-Pena complex. The Torrifluvents would generally coincide with the soils east of the county road and carry the caveat that community development is very limited by flooding, the seasonal high water table and variable texture. The Ascalon-Pena soil is considered to have moderate to severe constraints to building site development and ISD systems due to slope and large stones. Access to the parcels would be from county road 243, which for its initial 5 miles is chip/seal surfaced, becoming an improved, gravel-surfaced road in the vicinity of the subject property. I would contemplate that a driveway to lot 3 would necessitate a cut into the hillside west of the county road, likely creating increased erosion, potentially impacting the county road. The applicant has notified the new castle fire protection district, who has been remiss in providing a response. Staffsuggests that if the board is entertaining approval, the board require response from the district. We have received comments from a neighbor to the north of the subject property stating objections based on driveway intersections, and potential for sewage contamination to the creek. The forest service has commented noting that forest service lands are managed and utilized for a wide range of uses including habitat, grazing,logging and recreation. The comprehensive plans in effect for this general portion of the county do not address the subject property. In my opinion if the comp plan were extended to this area, the property, given its location, would fall into two districts. District F, which would contemplate the floodplain of main elk creek and district E, which would consider the constraints imposed by the slopes west of the county road.
