APPLICANT:Mary Donlan LOCATION:Two tracts of land located within Section 26, T4S, RglW of the 6th P M; located approximately six (6) miles north of New Castle along County Road243. SITE DATA:25 Acres +/- WATER:Individual/Shared Wells SEWER:Individual Sewage Disposal Systems (ISDS) ACCESS:Direct access to County Road 243 EXISTING ZONING:A/R/RD ADJACENT ZONING:North; South: A/R/RD East; West: O/S (USFS) I. RELATIONSHIP TO THE COMPREHENSIVE PLAN The subject tract is located in an Unclassified District, as designated by the Garfield County Comprehensive Plan's Management Districts Map (1981;1984 Plans). II. DESCRIPTION OF THE PROPOSAL A.Site Description: The subject property consists of two (2) parcels, each 12.5 acres in size, located approximately six (6) miles north (straight line distance) of New Castle, along County Road 243. A small portion of the tract is located west of the county road, with the balance ofthe property located between the road and Main Elk Creek. The property is currently undeveloped and vegetation varies widely. See vicinity map, page (O -l o C Proposal: The applicant proposes to divide, by exemption, two (2),12.5 acre tracts into a total of three (3) parcels of 6.0, 7.4 and 9.8 acres each, more or less. Staff presumes that, if approved, each parcel would be developed as single-family homesites. See sketch map, page Itr. MAJOR ISSUES AND CONCERNS Subdivision Regulations: Section 8.52 (A) of the Garfield County Subdivisron Regulations states that "No more thon a total of four (4) lots, parcels, interests or dtvelling units will be creqtedfrom any porcel, as that parcel was described in the records of the Garfield County Clerk and Recorder's Office on January I , I97 3. In order to qualifyfor exemption, the parcel as it existed on January l, 1973, must have been larger than 35 acres in size at that time and not part of a recorded subdivision; however, any parcel to be divided by exemption that is split by a public right-of-way (State or Federal higlrway, County road or railroad), preventing joint use of the proposed tracts, and the division occurs along the public right-of-way, such parcels thereby created may, in the discretion of the Board, not be considered to have been created by exemptionwith regard to thefour (4) lot, parcel, interest or dwelling unit limitation otherwise applicable. For the purposes of definition, all tracts of land 35 acres or greater in size, created after January l, 1973, will count as parcels of land creqted by exemption since January I , I97 3;" The subject tracts were originally part of a 49 acre tract dating to August, 1952. as evidenced by the deed recorded in Book 265 atPage 408. See deed, page Y ln 1976, the parent tract was granted an exemption creating^two (2) 72.5 acre parcels and a parcel of 20 acres. See Resolution 7 6-61. pages V ' / O Based on this analysis and in the discretion of the Board, a fourth parcel could be created that would comply with Section 8:52 (A) of the Subdivision Regulations. It appears the application contemplates the impediment to joint use criteria where County Road 243 creates a natural division. Either way, if approved, staff recommends that the plat contain a note that no further divisions by exemption be allowed. Staff notes that Resolution 76-61 contains an apparent condition of approval "that said division will actually restrict the density of housing within said area and should therefore be exempted. . ." Although the earlier analysis determines that an additional exemption parcel may be created; if approved, the residential density of the area would be increased, contrary to the original, approval rationale. B Zoning'. The subject parcels are located within the A/R/RD zone district and all proposed lots are in excess of the 2.0 acre minimum lot size requirement. Main Elk Creek flows through the eastern portion of the parcels, the floodplain of which created some original concern, as discussed within Resolution 76-61. The floodplain for this portion of Main Elk has not been officially mapped and is therefore indeterminate. Staffhas visited the site and does have some floodplain concern for the development of the eastern portion of the property. Section 6.04 of the Zoning o A Z. oo C Resolution provides explicit authority directing a "subdivision" applicant to prepare the requisite floodplain studies, where none previously exist. Staff acknowledges the distinction between a subdivision and an exemption from subdivision, but suggests that it is appropriate to require this level of detail. Slope of proposed Lot 3 appears to be an issue, whereby a significant portion of the proposed lot is in excess of 40oh. A letter contained within the application suggests that the requirements of Section 5.04.02 of the Zoning Resolution can be met. See letter, page / / Staffrecommends that it is premature to grant approval of an exemption without a determination that Section 5.04.02 can be met. Water Supply: The three (3) parcels would be served by two (2) wells. One well would be used individually and the other well would be shared among two (2) of the parcels, howeveq it is not specified which of these wells would be shared. The State had originally permitted the wells; however, it appears that both permits have expired. See permits, pages /L-/\ Well #1 was completed to a depth of 103 feet and determined to produce at least l5 gpm, during a test of unspecified length. Well#2 was completed to a depth of 83 feet with production determined to be 20 gpm, also during a test of unknown lengh. Water samples from both wells were analyzed and determined to be within limits suggested by the Colorado Department of Health. See pump test and related information, pages l+. /-l As mentioned, one of the wells is proposed to be shared among two (2) of the lots. Based on the pump test results, staff suggests that well #2 be the shared well since it has a greater production rate, suggesting better capacity. Regardless of which well is shared, staffwould contemplate the necessity of crossing the county road with the supply line. This should be coordinated with the Road and Bridge Department, who may require the issuance of a permit. Additionally, the shared well would require the drafting and review of a well sharing declaration. Staffs chief concern with the water supply is that both wells were originally permitted for household-use only, within [] single family dwelling. This situation would require the issuance of a new well permit for the proposed, third lot, or an amended well permit, if the well is to be shared. Discussions with the Division of Water Resources has confirmed that any new well or amended permit would require a court approved augmentation plan, since the property is in the West Divide Water Conservancy District, Area "B." The augmentation plan would likely require the involvement of attorneys and engineers and the eventual construction of an augmentation pond, which would obviously be a very time-intensive, costly process. Soils/Sewer: The method of wastewater treatment is proposed to be the use of individual sewage disposal systems (ISDS). According to the Forest Service Soils Map, the soils are classified as Fluvaquents and Sinkson channery loam. Fluvaquents D -3 oo E are subject to flooding during spring runoffand after severe thunderstorms and are considered to be "unsuited for almost all other uses." Very little analytical information has been provided for the Sinkson soil. The Forest Service classifications correspond, generally, with the Soil Conservation Service (SCS) classifications of Torrifluvents and the Ascalon-Pena complex, respectively. The Ascalon-Pena soil is considered to have moderate to severe constraints for both building site development and the use of ISD systems, generally due to slope and large stones. Likewise, the SCS states that, for the Torrifluvent soils, "community development is very limited by flooding, the seasonal high water table, and variable texture. Onsite investigation is necessary." Access: Access to all proposed lots would be directly from County Road 243, which is gravel-surfaced in this location. The initial five (5) miles of the county road is chip- seal surfaced, grading to an improved, gravel road for its remaining length. A driveway to proposed Lot 3 would likely require a significant cut into the slope west of the county road, likely resulting in increased rates of erosion, potentially impacting the road. Fire Protection: The applicant has notified the New Castle Fire Protection District of her intent; however, at this time, no response from the District has been provided. Prior to any approval, staff recommends the District acknowledge the exemption request and provide information that the property is within its response area and that service would be provided. Comments Received. The Planning Department has received comment from Cherry Talbott, who states she has objections to the exemption petition related to driveway intersections and the potential for sewage contamination of Main Elk Creek. See letter, page /4 F G The Forest Service has submitted a letter noting that adjacent lands are managed for a wide range ofuses including wildlife habitat, cattle grazing,logging and recreation. See letter."p uge | 1 H.Comprehensive Plan: The subject land is not classified within either of the existing Comprehensive Plans in effect for this area of the County. However, given its location, staff suggests that the land, if classified, would have carried two (2) classifications. First, due to the potential floodplain issues, portions of the land east ofthe county road would have been designated District F - River/Floodplain Severe Environmental Constraints. Second, due to the slope west of the county road, the property likely would have carried the District E - Rural Aress/Severe-fuIoderate Envir onmenta I C onstroint s. StaffComment: The necessity of a State approved water augmentation plan places approval of this petition in a precarious situation. The plan would likely be very I 4 o costly and time-consuming; however, approval of the petition should not occur without approval of the plan. Additionally, the exemption process is generally appropriate for lands with little or no impediments to development. The floodplain and slope issues, as detailed herein, are serious enough to require additional, detailed analysis, which should be accomplished prior to even conditional approval of the Board. Additionally, staffsuggests that in approving the original exemption creating these tracts, the previous Board acted judiciously in stating the exemption would "actually restrict the density of housing within said area. . ." Staffsuggests that the insight used then is still appropriate today. Finally, staff contemplates that if the Comprehensive Plan had covered this area of the County, the land would have been designated within the Severe category - lands generally unsuitable for development. TV. SUGGESTED FINDINGS 1 That proper posting and public notice was provided as required for the meeting before the Board of County Commissioners. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3 That for the above stated and other reasons, the proposed exemption is not in the best interest ofthe health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V.
