DONLAN have petitioned the Board of County Corrm'issioners of Garfield County, Colorado, for an exemption under C.R.S. (1973) Section 30-28-l0l (.I0) (a) - (d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1,1972 and amended April 14, 1975, Sections 1.02.17 (d) and 3.02.01, for the division of a 20.68 acre tract of land into three parcels of 7 acres, 7 acres, and 6.68 acres, more or less, and more parti cu'larly descri bed as fol I ows : A parcel of'land situated in the Nt^l%Nhlk and in the SW%NL.I%of Section 17, Township 7 South, Range 87 West of theSixth Principal Meridian, iying Souther'ly of the Southertyright-of-way line of a 60 foot-road right-of-way, Westerl!of the Easterly lines of said Nt^l%NW% and Sl^I%Nl,lLq dnd No_rtherly of the Southerly line of said SW%Nl,,lk, said parcelof land is described as follows: Beginning at a pornt on the Southerly right-of-way line ofsaid road whence the Section Corner common to Sections 7,8,.l7, and lB in said township and range bears: N. 59o 2.l, 43" l^I. 1521.62 feet; thence s. 00o lg,03,,t,l. 1g2l.ll feetalong the Easterly lines of said NW%NW% and SW%Nll% to apoint on the Southerly line of said SIdkNll%, thence N. 88o43' 37" }'l. 468.01 feet along the Southerly 'lf ne of said Sl'lkNl'lk; thence N. 00o 49' 39" E. ?027.78 feet to a point onthe Southerly right-of-way line of said road; thence 59.53feet ajgltg the arc of a curve to the right, having a radiusof 39t.81 feet, the chord of which beari: S. 74o-OBr 55'rE. 59.47 feet; thence S. 690 41, 45,,E. 213.93 feet along the Southerly right-of-way line of said road; thence 169-.44fqe! along the arc of a curve to the left, having a radiusof 447.81 feet, the chord of which bears: S. 800 3Bt 06,' E.. 168.43 feet; thence N. 8Bo 3I , 3.|,, E. 25.I0 feet alongthe Southerly right-of-way line of said road to a point - on the Easterly line of said NW%NW%, the point of beginning. The above described parcel of tand contains 20.68 acres, more or less. WHEREAS, the Petitioners have shown to the satisfaction of the Board of County Commissioners of Garfield County, Co'lorado, ,f,u, they desire said exemption for the purpose of re-sale into single-family residential acreagei and, WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board that there is a reasonable probability of locating domestic water on each of said tracts, that there is adequate ingress and egress to said tracts, that the location of septic tanks will be permitted by the Colorado Department of Health, that the requested division is in accordance with the genera'l purposes and intent of the Subdivision Regulations of the State of Colorado and the County of Garfield .L o) and should, therefore, be exenrpted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. (1973) Sectiron 30-28-'l0l (.I0) (a) - (d) as amended; NOI.I THEREF0RE, uPon motion of F/a ,4/\4r..,-'-*seconded by , and camied, said 20.68 acre tract of land is hereby exempted from such de finition and transfer of said tract may be made by division into three parcels of 7 acres, 7 acres, and 6.68 acres, more or less, alI as is more fully described above and further that a proper'lega1 description be prepared prior to the conveyance of said tracts.
