Pursuant to Lg73 C.R.S. 38-28-101 and the Garfield
County Subdivision Regulations, 3s amended, JOHN DOREMUS, by his
attorney, Thomas w. stuver, resPectfully submits this Request for
Sketch plan Review and Exemption of a proposed division of prop-
erty located in Garfield County which would result in the creatio
of four tracts of land each of which would be less than 35 acres'
and petitions the board to exempt the division of these tracts fr
the provisions of the Garfield County Subdivision regulations oth
wise pertaining.

r) The Petitioner is Lhe owner of ilne E\ NEu, Section
11, Township 5 South, R'ange 92 West of the 6th P.M. comprising
80.3I acres more or 1ess. This parcel is designated "subject
property" on the VICINITY MAP submitted herewith.
2) It is the intention of the Petitioner to divide the
subject property into four parcels comprising approximately 20
acres each for sale for single family residential purposes ' The
four parcels are designated as 1 through 4 on the SKETCH PLAN MAP
submitted herewith.

5) The source of domestic water for the four single
family dwelling units proposed for the subject property is to be
individual wells situated on each 20 acre tract. Individual
treatment systems situated on each tract and approved by the
Garfield county Environmental Health office are proposed as the
means of sewage disposal. An analysis of the potential domestic
water supply and report on percolation tests indicating feasibil-
ity of individual sewage treatment systems is submitted herewith'
6) Access to the tracts is via county Road 226 whi-ch i
contiguous with a portion of the northerly boundary line of the
subject property. Access for the indivdiual tracts will be pro-
vided by private easement as shown on the SKETCH PLAI{ MAP submitt
herewith. The easement is designed to not exceed an B% maximum
grade.
7) A soils map and soil interpretations from the
National Cooperative Soil Survey are submitted herewith' The pro-
posed development is not inconsistent with the natural topograohy'
soil drainage, and other physical characteristics of the subject

Dear Mr. Stuver,
At your request, we have investigated the domestic water supply
potential and the adequacy of Ieach fields for four - 20 acre tracts
of land located in the E* of the NE* of Section 11, T 5 S, R 92 W, of
the 6th p.M. in Garfield County. Thi s proposed 80 acre subdivision is
now owned by John N. Stern. The land was previously a part of the
Rapasard i Ranch .
DOMESTIC WATER SUPPLY
No central water supply systems currently exist near the proposed
development. lt is proposed that the four lots will be served by
domest'ic wel ls. According to a recent State Engineerts Office tabula-
tion of wells drilled in the area, there are 18 wells within a radius
of 5 miles. These wells are listed in Table 1'
The subdivision I ies on Cretaceous Mancos Shale which normal ly yields
very little water and what water it does yield is known for its poor
qrri ity. Underlying the Mancos Shale is the Dakota Formation which often
jo.s proauce adequaie water for domestic wel ls. For geologic information
in the area we have referred to Colorado School of Mines Quarterly Publi-
cation, volume 71, No. 1, January, 1976, "Coa1 Deposits of the carbondale,
Grand Hogback and Southein Danforth Hi I ls Coal Fields, Eastern Piceance
Basin, Colorado'r.
It is our opinion that there is a reasonable chance of drilling
individual domestic wells on the land to meet the domestic needs of the
proposed four lots. Our experience wi th the groundwater section of the
it"i. Engineerrs 0ffice indicates that they would issue exemPt domestic
wel I permi ts for this particular area.
PERCOLATION TESTS
0n September 1Oth and 11th, 1976, three percolation tests were made
on this tract of land under my supervision. The percolation tests were
conducted in accordance with the "Manual of Septic Tank Practiceil
prepared by the U.S. Department of Health, Education and Welfare, Public
Health Service Publ ication, No. 526, Revised, 1967. This procedure is

WHEREAS, John Doremus has requested the Board of
County Commissioners of Garfield County, Colorado for an exemp-
rion from Lg13 C.R.S. 38-28-101 and the Garfield County Subdivisi
Regulations for the division of his property in t.lne EZ NEL,
Sectionll,Tovrnship5South,Rangeg2Westofthe6thP.M.in
Garfield county into four tracts, each of which will be approxi-
mately 20 acres in area, and which are more fully described on
the SKETCI{ PLAN MAP submitEed with the Request for Review and
Exemption, and
WHEREAS,thePetitionerhasshowntothesatisfaction
of the Board of county commissioners, Garfield county' colorado'
thattheexemptionrequestedisforthepurposeofresaleinto
single family residential acrea1e' and
WHEREAS,thePetitionerhasdemonstratedtothesat-
isfactionoftheBoardthatthereisreasonableprobabilitythat
thefourtractscanbeadequatelyservedwithdomesticwater;
that there is adequate access to the tracts via existing CountY
Road and a private easement to be constructed will comply with
state of colorado and Garfield county standards and that the
requested exemption is in accord with the general purposes and

Dear Mr. Stuver,
At your request, we have investigated the domestic water supply
potential and the adequacy of leach fields for four - 20 acre tracts
of land located in the E* of the NE* of Section 11, T 5 S, R !2 W, of
the 5th p.H. in Garfield County. This proposed B0 acre subdivision is
now owned by John N. Stern. The land was previously a part of the
Rapasard i Ranch.
DOMESTIC WATER SUPPLY
No central water supply systems currently
development. lt is proposed that the four Iots
domestic wel ls. According to a recent State En
tion of wells drilled in the area, there are 1
of 6 mi les. These wel ls are I isted in Table I.

The subdivision I ies on Cretaceous Mancos Shale which normal ly yields
very little water and what water it does yield is known for its Poor
qr"i ity. Underlying the Mancos Shale is the Dakota Formation which often
ioes pioauce adequ"i" *"t.r for domestic wells. For geologic information
in the area we have referred to Colorado School of Mines Quarterly Publi-
cation, Volume 71, No. 1, January, 1976, "Coal Deposits of the Carbondale,
Grand Hogback and Southern Danforth Hi I ls Coal Fields, Eastern Piceance
Basin, Colorado".
It is our opinion that there is a reasonable chance of drilling
individual domestic wells on the land to meet the domestic needs of the
proposed four Iots. Our experience with the groundwater section of the
St"t. Engineer's Office indicates that they would issue exempt domestic
well permits for this particular area.
PERCOLATION TESTS
0n September 1Oth and llth, 1976, three percolation tests were made
on this tract of land under my supervision. The percolation tests were
conducted in accordance with the "Manual of Septic Tank Practiceil
prepared by the U.S. Department of Health, Education and Welfare, Public
Health Service Publ ication, No. 526, Revised, 1967. This procedure is

accepted by the Garfield county Sanitarian for deterrnining the adequacy

accepted rate of I inch per hour that is required by the Garfield County
planning and Zoning Regulations ("subdivision Regulations of Garfield
