WHEREAS, John Doremus has petitioned the Board of County Conunissioners
of Garfield County, Colorado, for an exemption under C.R.S. (1973) Section
30-28-101 (10) (a)-(d) as amended, and the Subdivision Regulations of Garfield
Countyn Colorado, adopted September 1, 1972 and amended April 14, 1975,
Sections 1.02.17 (d) and 3.02.01, for the division of an eighteen (t8) acre
tract from a larger tract of 172 acres, more or less with said 172 acre
tract more particularly described as fol'lows:
The NE% ShI%, the SEk Nlfz and the South 880 feet, of even width'
of the NE% N|llk of Section 23, Township 7 South, Range 92 tdest
of the 6th P.M., together with all that part of the NEa of said
Section 23, described as fo'llows:
Beginning at a point whence the Quarter Corned between said

reserved to Prior grantees
IIHEREAS, the Petitioner has demonstrated to the satisfaction of the Board
of County Corrnissioners of Garfield county, colorado, that he desires said
exemption for the purpose of re-sale into sing'le-family residential acreage;
and,
IIHEREAS, the Petitioner has deononstrated to the satisfaction of the Board
of County Conmissioners of Garfie'ld County, Co1orado, that there is a.reasonab'le
probability of locating domestic water on each the said tracts, that there is
adequate ingress and egress to said tracts, that the Ioca'tion of septic tanks
wilI be permitted by the Colorado Department of Health, that the requested
division is in accordance with the general purposes and intent of the Subdivision
Regulations of the State of Colorado and the County of Garfie'ld and should,
therfore, be exempted from the definition of the terns "subdivision" and "subdivided
Iand" as set forth in C.R.S. (1973) Section 30-28-101 (10) (a)-(d) as amended;

from a larger tract of 772 acres, all hs is npre fu1ly described in the Petition
penaining hereto; and further that said exemption is conditional upon the

Petitioner obtaining a proper legal description for said eighteen (Lg) acre
tract prior to the conveyance thereof. A copy of the instrument of conveyance
when recorded shall be filed with this Regulation
