I. RELATIONSHIP TO THE COMPREHENSIVE PLAN
The site is located in the Subdivision, Central Water and Sewer
District, as designated on the Garfield County Comprehensive Plan
Management District Map.
II. DESCRIPTION OF THE PROPOSAL
A. Site Description: The site has slight to moderate slopes with
Mitchell Creek running along its eastern boundary. Land use on
the site is residential and agricultural, with adjacent land uses
primarily residential with some open space. Improvements on the
site include one single family residence and several barns and
sheds.
B. Project Description: The applicant proposes to divide the 18.63
acre parcel into two lots, 11 acres and 7.63 acres in size. The
existing dwelling will be located on the 11 acre parcel, while
the 7.63 tract is proposed to remain vacant until future
development of an additional single family residence.
III.MAJOR ISSUES AND CONCERNS
1. The application has been referred to the City of Glenwood Springs
with no comments received at this time.
2. A subdivision exemption was approved on the site in October,
1980, creating the existing 18 acre parcel and a separate 40 acre
tract. The 40 acre tract was subsequently developed into the
Mitchell Creek P.U.D., consisting of 23 single family lots. Lots
created within a subdivision do not count toward the total
allowable splits by exemption, as per Section 8.52(A) of the
Garfield County Subdivision Regulations.

3. Soils constraints on the site are slight for individual septic
systems and dwellings.
4. Compliance with County regulations
relating to driveway access
and flood plain regulations should be required.
IV. SUGGESTED FINDINGS
1. The proper posting and public notice was provided as required for
the meeting before the Board of County Commissioners.
2. That the meeting before the Board of County Commissioners was
extensive and complete, that all pertinent facts, matters and
issues were submitted and that all interested parties were heard
at that meeting.
3. That for the above stated and other reasons, the proposed
exemption is in the best interest of the health, safety, morals,
convenience, order, prosperity and welfare of the citizens of
Garfield County.
V. RECOMMENDATION
APPROVAL, with the following conditions:
1. That the following plat note be included on the Exemption plat:
That portions of the site are subject to 100 Year Flood
Plains. Any structure or improvements on the site are
required to comply with the Garfield County Flood Plain
Regulations.
2. That easements for waterlines and for access and maintenance of
the existing spring be included on the exemption plat. In
addition, each parcel shall receive a deeded interest in the
spring of no less than 5 gpm.
3. That the applicant shall apply for, and receive, driveway access
permits as required by the Garfield County Road and Bridge
Department.
4. That the applicant submit $200 in School Impact fees for the
creation of one new lot.
5. That all representations of the applicant, either within the
application or stated at the meeting before the Board of County
Commissioners, shall be considered conditions of approval.
