HomeMy WebLinkAbout2.0 Resolution• • BEFORE THE BOARD OF COUNTY COMMISSIONERS OF GARFIELD COUNTY, COLORADO RESOLUTION WHEREAS, Jake 0. Boyles, Evelyn Boyles, and Robert Murphy, have petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption under C.R.S. (1973) Section 30-28-101(10)(a) - (d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975, Sections 1.02.17 (d) and 3.02.01, for a change in boundary alignment on two (2) parcels of ground upon which a Senate Bill 35 exemption was previously granted in August of 1975. Said parcels of ground consist of 3.12 acres more or less, and more particularly described as follows: EXHIBIT A-1 A parcel of land situated in Lot 32 of Section 1, Township 7 South, Range 89 West of the Sixth Principal Meridian, lying Northerly of the Northerly right-of-way line of Colorado State Highway No. 82, said parcel of land is described as follows: Beginning at a point whence the North Quarter Corner of said Section 1 bears: North 126.00 feet and S. 87° 24' 00" W. 531.47 feet; thence South 291.80 feet to a point on the Norhterly right-of-way line of said highway; thence North 58° 10' 30" W. 93.93 feet along the Northerly right-of-way line of said highway; thence N. 600 00' 00" W. 162.46 feet along the Northerly right-of- way line of said highway; thence North 151.03 feet; thence N 870 24' 00" E 220.73 feet to the point of beginning. The above described parcel of land contains 1.11 acres, more or less EXHIBIT A-2 A parcel of land situated in Lot 32 of Section 1, Township 7 South, Range 89 West of the Sixth Principal Meridian, lying Southerly of the Northerly line of said Section 1, Northerly of the Northerly right-of-way line of Colorado State Highway No. 82 and Easterly of the Westerly line of said Lot 32, said parcel of land is described as follows: Beginning at the North Quarter Corner of said Section 1; thence N. 87° 24' 00" E. 531.47 feet along the Northerly line of said Section 1; thence South 126.00 feet; thence S. 870 24' 00" W. 220.73 feet; thence South 151.03 feet to a point on the Northerly right-of-way line of said highway; thence N. 60° 00' 00" W. 109.84 feet along the Northerly right-of-way line of said highway; thence N. 67° 11' 00" W. along the Northerly right-of-way line of said highway, 230.16 feet, more or less, to a point on the Westerly line of said Lot 32; thence N. 01° 31' 00" W. along the Westerly line of said Lot 32, 118.80 feet, to the North Quarter Corner of said Section 1, to the point of beginning. The above described parcel of land contains 2.00 acres, more or less. WHEREAS, the Petitioners have shown to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that they desire said exemption for the purpose of re -sale into single-family residential acreage, and WHEREAS, Petitioner has demonstrated to the satisfaction of the Board that there is a reasonable probability of locating domestic water on each tract, that there is adequate ingress and egress to said tracts, that the location of septic tanks will be permitted by the Colorado Department of Health, that the requested boundary adjustment is in accordance with the general purposes and intent of the subdivision regulations of the State of Colorado and the County of Garfield and that said boundary adjustment will actually restrict the density of housing within said area and should therefore be exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. (1973) Section 30-28-101 (10)(a) -(d) as amended; NOW THEREFORE, upon motion of � �� Cw� , seconded by(4014 and unanimously carried said acre tract of land is hereby exempted from such definition and transfer of said tract may be made by division into two tracts of 1.1 and 2.0 acres, more or less, as is more fully described in the Petition pertaining hereto. A copy of the instrument or instruments of conveyance when recorded shall be filed with this Resolution. Dated this day of January, A.D. 1976.
