HomeMy WebLinkAbout3.0 Correspondenceoo MEMORANDUM TO: Board of Counfy Commissioners FROM: Planning Departmen t(l/\ R-E: Burris Subdivision Bxemption (Continued from 1115196) DATE: Febmary 8, 1996 As you recall, the Board continued the Burris petition for an exemption from the definition of subdivision to allow the applicant time to demonstrate an adequate, physical supply of water. The actual instnrctions given to the applicant by the Board on how the demonstration of the physical water supply could be made were somewhat ambiguous. Staff originally sent the applicant a letter indicating that, at a minimum, the existing well be pump tested for 24 hours, with the results and other supporting information attached for review by the Plaruring Department. Discussions with the applicant, as well as checking my notes of the meeting, give no indication that was the requirement made by the Board. Due to this confusion, staffhas listened to the audio tapes made during the meeting. There is considerable discussion regarding the physical supply from the existing well, but no standards are specified to the applicant as to the exact criteria he should submit. It appears, from listening to the tapes, the Board desired that the applicant submit a copy of the original well test report, which is attached for your review, and that the applicant also submit an opinion from the person who conducted the original pump test that this well is indicative of the water yield that could reasonably be expected from the other wells. At no time does the Board specify that the applicant complete the items listed in the letter sent by the Planning Department. Therefore, it would appear that a copy of the well test report and an opinion fiom the person conducting the original well test should be sufficient proof of an adequate, physical water supply. Attached for your review are copies of the letter sent to the applicant, after the meeting was continued, and the results of the original well test report on the applicant's existing well. Burris, Jr LOCATION:A tract of land located in Section 17, T65, R92W of the 6th P.M.; north of CR 346; approximately 1.5 miles southwest of Silt. SITE DATA;26 acres Well Individual sewage disposal systems (ISDS) Direct access to CR 3a6 (fufle-Silt Road) NT WATER SEWER: ACCESS: EXISTING ZONING: AD.IACENT ZONING:North - East - West: A/[ South: A/R/RD I. REI.ATIONSHIP TO THE COMPREHENSIYE PLAN The subject property is located in District D - Rural AreasAvloderate Environmental Constraints as designated by the Garlield County Comprehensive Plan's Management Districts Map II. DESCRIPTION OF THI PROPOSAL A Site Description: The26 acre propefty is located south of Interstate 70 and north of CR 346, approximately 1.5 miles southwest of Silt The property lies within the Colorado River Valley and a portion of the designated floodplain runs through the northern portion of the tract. The Last Chance irrigation ditch_splits the property into northern and southern sections. See vicinity map, pug. .L Adjacent Land t ]ses: Land uses in the area are predominantly agricultural; however, the area is transitioning from agriculture to single family residential. ProFrosal. The appticant intends to divide, by exempti on, a 26 acre tract into four (4) parcels of 2.0, 2.0,6.9 and 16.2 acres each, more or less. An existing, single family residence would occupy the 6.9 acre parcel and the remaining parcelywould eventually be developed as single family homesites. See sketch map, page -b--- D History of the Parcel: The subject property was originally part of a larger, 680 acre tract that was split into fwo (2) parcels by CR 346, creating a 600 acre parcel and an 80 acre parcel. ln 1977, the 80 acre parcel was later divided by a condemnation process, obtaining a right-of-way for Interstate 70, This created the subject tract of land consisting of approximat ely 26 acres, which, due to the right-of-way splits, appears to be eligible for the creation of up to four (a) additional parcels. The applicant purchased the property not knowing that the property was not legally created and, in an effort to secure a water supply (well) for the 26 acre tract, the applicant requested an exemption, which was approved (Resolution 92-009). a B C -l - IIL o o MAJOR ISSUES AND CONCERNS A. Suhdivision Regulations: Section 8:52 of the Garfield County Subdivision Regulations states that "y'y'o more than a total of four (4) lots, parcels, interests or rhvelling unit.s will be u'eutedfrom any parcel, as that parcel was described in the records of the Garfteld County Clerk arul Recorder''s Office on January I, 1973, and i,s ttol a porr of a recorcled ,subdivision; however, any parcel to be divided by exemptiott that is split by a public righro/-way (State or l"ederal highway, County road or. railroacl) or notural /eofitre, preventing joirtt use of the proposed tracts, and rhe tlivision occurs along the public right-of-way or natural fedture, such parcels thereby created rnay, in lhe cliscretion of the Board, not be consirlered lo have been crealecl by exemptiort with regcu'd to the four (4) lot, parcel, interest or etwelling unit li m itat i on o the rwi se apP I icab le ; " The applicant has submitted deeds and a narrative discussing the exemption request, r". pug.r 'l- tb It appears that, given the history of the parcel, the26 acres in queition dasiri.t of an approximately 80 acre parcel, created prior to January l, l973,by the County Road 346 ROW. ln 1977, the subject parcel was created by the condemnation process that procured a ROW for I-70. The applicant has demonstrated, through numerous discussions, that no other splits or exemptions have been granted prior to this application. Therefore, it appears this request is consistent with Section 8.52 of the Subdivision Regulations. B. Zoning'. The subject property is within the A/I zone district which specifies a minimum lot size of two (2) acres. All proposed lots are consistent with this minimum requirement. C. WatEr: The applicant has applied to the West f)ivide Water Conservancy District tbr water lea5e contracts that would provide a legal source of water. See applications on pages ll - t 3 . Upon issuance of these contracts, it is staffs understanding that in. upptir*i cai exchange these contracts for household use only well permits from the Division of Water Resources. D. Sewer: The applicant intends to use individual sewage disposal systems as the rnethocl for water treatment. According to the Soil Conservation Service, soils on-site (Heldt clay loam; Olney loam) are typically deep and well-drained; however, they carry moderate to severe ratings for the use of septic tanks. Additionally, the soils lHeidt clay loam) are identified as having severe shrink-swell potentials. Staff recommends a plat note to address these limitations. E. Coloradq River Floodplain; It appears the northern half of the property is co-ntlined within the designated floodplain of the Colorado River, see map, page l{ Staff recommends a plat note indicate this limitation and that any subs6quent development on the property willbe subject to County floodplain regulations, surveys and engineering if any development is proposed for the floodplain area. F. Access: All lots would have direct access to County Road 346 and staffrecommends approval of County Road and Bridge for the additional driveways, prior to submittal of an exemption plat. G. Fire Protection: The applicant has submitted a letter from the Burning Mountains Fire Protection District indicating tire protection would continue to the new lots, see letter, page _t5_. Although this property is not within an area that is dangerously susceptible to *iidn." hazard, staff still recommends that a plat note address wildfire prevention, especially due to the presence of both I-70 and CR 346 which could in.."use the likelihood of brush fires caused by sparks, cigarettes or other introduced sources of ignition. -L oo Easements: It willbe necessary to designate easements for the Last Chance irrigation ditch and the irrigation pump line. Additionally, all other easements, (drainage, access, utilities, etc.) will be required to be shown on an exemption plat. School Impact Fees: The applicant will be required to pay school impact fees of $200, for each lot created by this qxemption. Potential Road Impact Fees. If or when the County adopts a road impact fee, the lots created by this exemption will be subject to paying that fee; paid at time of building permit application, paid by the building permit applicant. This provision shall be included as a plat note. ry. SUGGESTED FINDINGS I That proper posting and public notice was provided as required for the meeting before the Board of County Commissioners. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. J That for the above stated and other reasons, the proposed exemption is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V. RECOMMENDATION Staffrecommends APPROVAL of the application, pursuant to the following conditions That all representations of the applicant, either within the application or stated at the meeting before the Board of County Commissioners, shall be considered conditions ofapproval. A Final Exemption Plat shall be submitted, indicating the legal description of the property, dimension and area of the proposed lots, access to a public right-of-way, and any proposed easements for setbacks, drainage, irrigation, access or utilities. That the applicant shall have 120 days to present a plat to the Commissioners for signature, frorn the date of approval of the exemption. The Board may grant extensions of up to one (l) year fiom the original date of approval. That the applicant shall submit $200.00, per lot, in School lmpact Fees for the creation of all exemption parcels. That the following plat notes be included: "Soil conditions on the site may require engineered septic systems and building foundations. Site specific percolation tests at the time of building permit submittal shall determine specific ISDS needs on the site." "The minimum def'ensible space distance shall be 30 feet on level terrain, plus appropriate modification to recognize the increased rate of fire spread at sloped sites. The methodology described in "Determining Safety Zone Dimensions, Wildfire Safety Guidelines for Rural Homeowners," (Colorado State Forest Service) shall be used to determine defensible space requirements for the required defensible space within building envelopes in areas exceeding five (5) percent grade." "Upon adoption of road impact fees by the Board of County Commissioners, the lots created by this exemption shall be subject to paying the fees, paid at time of building permit application, paid by the building permit applicant."
