The subjecttract is approx. 37 acres in size and located north of highways 6 and 24 one mile west
of silt. The majority of the tract is an irrigated hay field and slope across the tract is relatively gentle.
The tract is situated on a bench above the highway and the Lower Cactus ditch flows along the
southern portion.
The land uses adjacent to and in the vicinity of the tract are largely agricultural and residential on
tracts of varying sizes.
The applicants are proposing to subdivide, by exemption, the 37 acre tract into four parcels of 3.7,
5.0, 6.0 and25.0 acres each. The applicants would retain the larger parcel and staffassumes the
smaller parcels would be developed as single family homesites.
A quit claim deed submitted with the petition indicates the tract has existed since March of 1970, at
the latest, and therefore, appears to comply with SectionS'.52 (A) of the subdivision regulations.
The tract is within the AIR/RD zone district and all proposed lots are in excess of the 2 acre minimum
lot size requirement. Slope of the tract would not preclude development.
It appears the applicant is proposing an exempt domestic well, that has recently been permitted, the
staffreport contains a copy of the well permit application and I have since received an approved
permit from the division of water resources for the exempt domestic well that would be the water
supply for three of the lots. A west divide water Conservancy district contract has also been
approved that would essentially allow an additional wellto be completed and used as the water supply
for the fourth lot. Staff discussed this scenario with the division of water resources who indicated
that the exempt domestic well permit and the permit that could be obtained from the west divide
contract would provide a legal water supply for all proposed lots.
At this time, one well has been completed and found to produce at least 12 gpm and, in the opinion
ofthe individual conducting the test, the well is physically capable of producing in excess of 15 gpm,
which should be a sufficient supply for the proposed uses. Additionally, the nitrate/nitrite and
coliform bacteria test of the well water indicated the sampled water meets state standards.
What is not abundantly clear is exactly which lots will be served by which wells. Staff suggests that
at this time, it would be appropriate to specif,r, for the record, which lots would be served in what
manner. Additionally, staffrecommends that the second wellbe completed before final approval.
The proposed method of waste water treatment is the use of individual sewage disposal systems and,
according to the SCS, the soils on-site have constraints varying from slight to severe for building site
development and moderate to severe constraints to the use of ISD systems. Staffrecommends that
site specific percolation tests be conducted at time of building permit application to determine specific
ISDS requirements.
Access to the site would be directly from highway 6 and 24 along an unimproved, single lane dirt
road. Staffdoes not contemplate any significant issues regarding this access, however, as a condition
of approval staffrecommends that an approved permit from the state be issued for the proposed uses.
It would also be required to survey and record this access easement.
The application included a letter from the burning mountains fire protection district, indicating the
district does provide fire protection to this area. Staffrecommends aplat note to address wildfire
mitigation.
All required easements must be shown on the exemption plat, the applicant would be required to pay
$200 per lot, in school impact fees prior to final approval and, upon adoption of road impact fees, the
lots created by this exemption would be required to pay the impact fee, paid at time of building permit
application.
Based on this analysis, staff recommends approval of the application, pursuant to the listed
conditions. In reviewing the staffreport, staffwould recommend that Condition #7 read:

a permit for a NEW well that will be used for household use in up to three single family residences, watering of up to
one acre of home gardens and lawns, and watering of the owner's domestic animals (sometimes referred to as
"DOMESTIC" use), and/or for the watering of livestock on a farm, ranch, range, or pasture. This form is to be used
only if the well will be the only well on your tract of land of 35 acres or more.
This form should not be used in the following cases:
