WHEREAS, RAY BALDWIN, acting as agent for Richard Bumy, has petitioned
the Board of County Cornnissioners of Garfield County, Colorado, for an
exemption under C.R.S. (1973) Section 30-28-10l (I0) (a) - (a) as arended,
and the Subdivision Regulations of Garfield County, Colorado, adopted
Septenber I, 1972 and amended April .|4, .|975, Sections I.02.17 (d) and
3.02.01, for the division of a .|50 acre tract into two (2) tracts of
approximately twenty (20) acres and one hundred thirty (1S01 acres, more or
less, and more particularly described as follows:

The Easter'ly 20 acres, more or less, of the Richard
Burry property situated in the Nhl%NEk, Section I9,
and Lots 'l and 2, Section 20, Township 7 South,
Range 88 West of the 6th P.M.
WHEREAS, the Petitioner has shown to the satisfaction of the Soard of
County Commissioners of Garfield County, Colorado, that he desires said
exemption for the purpose of re-sale into single-family residential acreage'
and
WHEREAS, sites for building exist on said 20 acre parcel which lie
outside of the 100 year floodplain of the Roaring Fork River, and
WHEREAS, Petitioner has dernonstrated to the satisfaction of the Board
that there is a reasonable probability of locating domestic water on each
of said tracts, that there is adequate ingress and egress to said tracts,
that the location of septic tanks will be permitted by the Colorado Department
of Health, that the requested division is in accordance with the general
purposes and intent of the Subdivision Regulations of the State of Colorado
and the County of Garfield and that said division will actua'tly restrict
the density of housing within said area and should, therefore, be exempted
from the definition.of the terms "subdivision" and "subdivided land" as set
forth in C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended;

of land is hereby exempted from such definition and transfer of said tract
may be made by division into two (2) tracts of twenty (20) and one hundred
thirty (1101 acres, more or less, all as is more fully des-cribed in the
Petition pertaining hereto, and further, that a right-of-way easement be
granted to this parcel to provide access. A copy of the instrument or
instruments of conveyance when recorded sha'll be filed with this Resolutign.
