D. 19...81 , there were present: ....algn.Q "Jim" arin1c1ious.0 ... f.Ax G}1 1? 1.an.a.] 1�.,....,?.x., when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 81-157 Commissioner Chairman Commissioner Commissioner County Attorney Clerk of the Board A RESOLUTION CONCERNED WITH GRANTING AN EXEMPTION FROM THE GARFIELD COUNTY SUBDIVISION REGULATIONS FOR C.E. BYERRUM. WHEREAS, C.E. Byerrum has petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption from the defintion of the terms "subdivision" and "subdivided land" under C.R.S. 1973, 30-28-101 (10) (a) -(d), as amended, and the Sub- division Regulations of Garfield County, Colorado, adopted January 2, 1979, Sections 2.02.21 (d) and 3.02.01 for the division of a 4.53 acre tract described as follows: That parcel of land as described in Document No. 1.83290 as of the Clerk and Recorder of Garfield County, Colorado into 2 imately 2.25 acres each, more or less, which proposed divided particularly described as follows: filed in the Office tracts of approx- tract(s) are more Tract A: Parcel 1, Beginning at the West one-quarter Corner of Section 31, Township 6 South, Range 94 West of the 6th Principal Meridian, Garfield County, Colorado; thence S 0°28'03" E, 21.81 feet along the west line of Section 31; thence N 89°52'00" E, 367.32 feet; thence N 0°28'03" W, 213.26 feet: thence N 66°30'00" W, 143.70 feet; thence S 87°07'00" W, 205.87 feet; thence S 89°31' 57" W, 30.32 feet; thence S 0°28'03" E, 239.01 feet along the west line of Section 31 to the point of beginning. Containing 2.167 acres, more or less. Tract B: Parcel 2, Beginning at a point whence the West one-quarter Corner of Sec- tion 31, Township 6 South, Range 94 West of the 6th Principal Meridian, Garfield County, Colorado bears S 89°52'00" W, 367.32 feet along the south right of way line of County Road (6309; thence N 0°28'03" W, 260.99 feet; thence S 84°48'00" W, 77.00 feet; thence S 77°36'00" W, 280.00 feet; thence N 66°30'00" W, 46.30 feet; thence S 0°28'03" E, 213.26 feet to the point of beginning. Containing 2.063 acres, more or less; and WHEREAS, the Petitioner(s) has demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that the proposed division does not fall within the purposes of Part 1, Article 28, Title 30, Colorado Revised Statutes 1973, as amended, for the reason that the impact created does not warrant further subdivision review, and WHEREAS, the Petitioner(s) has demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that there is a reasonable prob- ability of locating domestic water on each of said tracts, that there is adequate ingress and egress to said tracts, that the location of septic tanks will be permitted by the Colorado Department of Health, that the requested division is not part of an existing or larger development and does not fall within the general purposes and intent of the subdivision regulations of the State of Colorado and the County of Garfield, and should, therefore, be exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. 1973, 30-28-101 (10) (a) -(d), as amended; B ox 572 ncE790 NOW, THEREFORE BE IT RESOLVED that the division of the above described tracts "A", "B", from the above described 4.53 acre tract is hereby exempted from such 'definitions and said tract may be divided into tracts "A", "B", 'all as is more fully described above, and said divided tract may be conveyed in the form of such smaller tracts without further compliance with the aforesaid subdivision statutes and reg- ulations; provided, however, that this exemption is granted on the condition and with the express understanding and agreement of the Petitioner that no further exemptions be allowed on said tract(s) "A", "B", and that a copy of the instrument or instruments of conveyance when recorded shall be filed with this Resolution.
