The Board of County Commissioners of Garfield County, Colorado, (Board) received a request for a Land Use Change Permit to allow for Multi-Unit Dwellings on the above referenced property. The request was submitted by Partners Ill, LLC. B. The application's proposed development, also known as the Buffalo Valley Apartments, is located on approximately 2.2 acres of land owned by Partners III LLC. The ownership and legal description of this prope1ty is described in a deed found at Reception Number 835572 in the records of the Garfield County Clerk and Recorder (the "Property"). The Property is located within unincorporated Garfield County in the Commercial Limited Zone District, approximately one mile south of Glenwood Springs, Colorado, located off of County Road 154, with an address of 3637 Highway 82. D. In accordance with the County's adopted Land Use and Development Code, Multi-Unit Dwellings may be permitted in the Commercial Limited zone district with a Limited Impact Review. E. The Board of County Commissioners is authorized to approve, deny, or approve with conditions a Land Use Change Permit pursuant to the Garfield County Land Use and Development Code, as amended. F. The Board of County Commissioners opened a public hearing on March 16, 2015, for consideration of whether the proposed Land Use Change Permit should be granted or denied, during which hearing the public and interested persons were given the opportunity to express their opinions regarding the request. G. The Board of County Commissioners closed the public hearing on the !61h day of March, 2015 to make a decision. H. The Board of County Commissioners, on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determinations of fact: I. That proper public notice was provided as required for the hearing before the Board of County Commissioners. 2. The hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. That for the above stated and other reasons the proposed Land Use Change Permit for multi-unit dwellings is in the best interest of the health, safety, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That with the adoption of conditions, the application is in general conformance with the 2030 Comprehensive Plan, as amended. RESOLUTION NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that based on the determination of facts set forth above, the Land Use Change Permit, LIPA-8179, to allow Multi-Unit Dwellings on the Property is hereby approved with a 2-1 vote, the following conditions: 2 II II W.1 ~Jit~~ll.~~ .I~·J.~W. r.\~·~~~r/,~/~1/ni•.:.t:ai•,·~ IIIII Reception~: 861203 04/07/2015 09:02:29 AM Jean Alberico 3 of 7 Reo Fee:$0.00 Doc Fee:O.OO Gi=IRFIELD COUNTY CO 1. That all representations made by the Applicant in the application shall be conditions of approval, unless specifically altered by the Board of County Commissioners. 2. That the operation of the multi-family dwelling development shall comply with all applicable Federal, State, and local regulations governing this type of facility including storm water management permitting and provision of handicapped accessible dwelling units. The following Conditions shall be satisfied prior to the issuance of the Land Use Change Permit 3. The Applicant shall revise the site plan, grading and drainage plan, lighting and trash location plan, and landscaping plan to accommodate all required off-street parking of 135 parking stalls. 4. The Applicant shall revise the site plan to show the following: a. Any necessary drainage easements, b. Any necessary utility easements, c. A slope 3% or less for the first 30 feet of the entry driveway, d. Placement of additional hydrants as required by the Fire District, and e. A 6 foot wide sidewalk along County Road 154. 5. The Applicant shall either a. Modify the grading and drainage plan to remove the proposed retaining wall from encroaching on the adjacent property, or b. Provide an easement to allow for this structure to encroach onto the adjacent property. 6. The Applicant shall submit a revised landscaping plan compliant with section 7-303 Landscaping standards. The landscaping plan shall replace the crab apple trees, which are an attractant for bears, with a different native or drought-tolerant tree species. 7. The Applicant shall submit a revised Lighting Plan and Trash Location Plan compliant with section 7-304 Lighting Standards. The plan shall include adequate areas for trash collection. All existing non-conforming lighting shall be removed from the site. 8. The Applicant shall update its pre-annexation agreement with the City of Glenwood Springs. 9. The Applicant shall verify water service will meet fire flow and domestic water needs. 10. The Applicant shall model and provide verification from the City of Glenwood Springs Fire Department, that the site can be negotiated by the Fire Department's ladder truck. Should the site require modifications, a revised site plan shall be submitted to the County for review. 12. The Applicant shall prepare and subsequently execute with the County an Improvements Agreement to construct and maintain a 6 foot wide sidewalk along County Road 154, as shown on the revised site plan dated November 11, 2014. 13. The Applicant shall enter into a License Agreement with County Road and Bridge for the encroachment of the 6 foot wide sidewalk within the County Road 154 right of way. The following general Conditions shall be satisfied prior to Issuance of a Building Permit as noted or as part of the general site development. 14. The Applicant shall comply with the City of Glenwood Springs water and sewer utility and public works requirements (as referenced in Exhibit J) including but not limited to proper metering, back flow prevention, provision of easements for fire hydrant access and allowance for city maintenance of the hydrants, private maintenance of the sewer lift station, and provision of water and waste water projections demonstrating adequate line capacity for the development. 15. The Applicant shall comply with the Glenwood Springs Fire Department referral comments (Exhibit I) and regulations including installation of additional fire hydrants, installation of fire suppression systems, fire alarm systems and knox key boxes for building access. 16. The Applicant shall provide site specific subsurface, soils and geotechnical studies for the site as recommended by their preliminary geotechnical studies. The studies shall address foundation, pavement, roadway, and retaining wall designs and shall address slope stability. Engineered foundations shall be required. 17. The Applicant shall obtain a driveway access permit from the County Road and Bridge Department and construction of the driveway shall meet the County's standards. 18. The Applicant shall coordinate with County Road and Bridge to provide updated signage on County Road 154 to implement speed limit reductions to 25 mph (2 signs) and no- parking signs (4 signs) for the County Road proximate to the site. 4 • • 19. The Applicant shall install a Stop Sign at the driveway approach to County Road 154. 20. The Applicant shall remove the existing free-standing billboard. To ensure compliance with the County's Land Use and Development code and specific representation of the Application, the following shall occur: 21. At the time of building permit submittal, compliance with all dimensional requirements of the Land Use and Development Code including building height, setbacks, lot coverage and floor area ratio shall be verified. 22. The Applicant's installation and maintenance of landscaping for the development shall maintain compliance with Section 7-303 of the Land Use and Development Code. 23. The Applicant shall provide raw water irrigation for the site and shall include in property management guidelines provisions to avoid potential subsurface and foundation impacts from improper maintenance including irrigation line breaks . 24. The Applicant shall provide and maintain fully enclosed bear proof trash structures for trash collection. 25. The Applicant shall properly permit any proposed project identification signage. 26. The project shall be constructed generally consistent with the architectural illustrations provided with the submittal. 27. The applicant shall maintain the privacy fencing adjacent to the mobile home park along the southeasterly property line. 28. The Fire Department recommended using Fire Wise Plant Materials as listed by the Colorado State Forest Service. The Applicant should consider implementing these plant materials, as appropriate. 29. The Applicant should continue to work, in good faith, with the adjacent property owner to the north to secure a shared driveway and preferred access driveway for the project.
