The Director decision to conditionally approve the Accessory Dwelling Unit at 259 Mel Ray Road was issued on
December 19, 2011. The Land Use Change Permit will be issued upon compliance with certain conditions of approval,
particularly Condition 4 and Condition 5.
It has been brought to my attention that Condition 5 causes some difficulty due to timing issues. I have spoken with the
Director and a revised Director Determination has been issued to amend the language to resolve these timing issues.
The new condition states that the building permit will be issued concurrent with issuance of the Land Use Change
Permit.
We are confident that this change will simplify and streamline the issuance of permits so that you may move forward on

DIRECTOR DETERMIINATION DECEMBER 19, 2011(revisedJanuary5,2012)
1. REQUEST
Christina Gore, the owner of parcel number 2185-061-01-008, otherwise described as Lot 7,
Block 1 and the northerly 25' of Lot 6, Block 1, Mel Ray Subdivision, has requested a Land Use
Change Permit to allow for an Accessory Dwelling Unit (ADU). Addressed as 259 Mel Ray Road
in West Glenwood Springs the site is located in unincorporated Garfield County. Zoning is
Commercial Limited (CL) with water is provided by the City of Glenwood Springs and sanitation is
provided by the West Glenwood Springs Sanitation Department.
2. DESCRIPTION OF THE PROPOSAL
Pursuant to an Assessor Record Search the site has historically been assessed as a single family
home. A recent neighbor complaint led to the Code Enforcement Officer to investigate the site as
a possible zoning violation with two units existing in what was permitted as a single family
structure. Single family is a use -by -right in the CL zone however a second unit (ADU or two -unit
dwelling) require County review, approval and issuance of a land Use Change Permit. The
proposed second unit is proposed to exist in the basement of the structure with ingress/egress
directly to the exterior of the home. The structure was built as a single family home and therefore
certain building improvements are required to comply with fire code and other applicable building
codes.

3. APPLICABLE REGULATIONS
The Land Use Table contained in Article III designates an ADU as a Use Permitted Subject to
Administrative Review and compliance with standards contained in Article VII. Submittal
requirements have been met including provision of a site plan indicating access to the unit,
separation of the unit so it is independent of the primary unit, and compliant with zone district
dimensional standards. Information regarding public water and sanitation provided by the City of
GWS may require purchase of an additional tap for service to the second unit on the site.
Section 4-104 stipulates the Administrative Review Process and Section 7-801 provides
additional standards applicable to an ADU. All requirements have been met, including the
requirement for notice to the adjacent properties which the applicant has completed, submitting
certified return receipts for that notice.
4. ADJACENT OWNER COMMENTS
Two adjacent owners have contacted Budiling and Planning to voice their opposition to the
approval fo the ADU application. It appears that the ADU has been in operation since at least
1995 (as the assessor records first note a second unit at this location) and the neighbors have
identified noise, parking and potential illegal activities at the site that they are concerned will
increase if this application is approved.
5. RECOMMENDATION
Despite the issues identified by the neighbor Staff finds that the proposed ADU is in compliance
with §3-501, and §4-104, §4-501 and §7-801 of the Garfield County Unified Land Use Resolution
of 2008, amended and recommends that the Director approve the General Administrative Permit
to allow an ADU on a property legally described as Lot 7, block 1 and the northerly 25' of Lot 6,
Block 1, Mel Ray Subdivision compliant with the following conditions:
1. All representations of the applicant within the application shall be considered conditions of
approval unless otherwise modified by the Determination of the Director.
2. The ADU shall not exceed 1,500 square feet of finished floor area.
3. All lighting associated with the ADU shall be the minimum amount necessary. All exterior
lighting shall be shielded to prevent light trespass on any adjoining property and be
downward facing towards the structure.
4. Prior to issuance of a Land Use Change Permit the Applicant shall provide sufficient
documentation from the City of Glenwood Springs regarding the payment of any fees due
to the City or the West Glenwood Sanitation District.
5. Upon issuance of the Land Use Change Permit the building permit for renovations to the
structure shall be issued to assure compliance with all building codes requirements.
6. The Applicant shall meet all requirements of the Garfield County Unified Land Use
Resolution of 2008, as amended.
7. The accessory dwelling unit shall not be conveyed as a separate interest but may be
leased.
