Parte Kevin L. Patrick, Esq. DATE: December 21, 2009 RE: Application for Building Permit of George S. Whipple and Lydia B. Whipple ********9esk****x*x**$****xx***x**sH:h****k**:Fxx***A.* ******* This firm represents George and Lydia Whipple who have applied for a building permit to remodel and existing caretaker unit on their Cattle Creek property. This letter will describe the legal and physical water supply for the property, described in Exhibit "A". The property consists of approximately 21 acres with a main residence, caretaker residence and barn. The property is served by two sources of supply. The first source is the Whip Well (SEO Permit No. 048356 -FR, attached as Exhibit "B"). This well was decreed in Case No. 95CW337, Water Division No. 5; a copy of the final decree is attached as Exhibit "C". The Well is augmented by an approved plan for augmentation decreed in Case No. 95CW338, Water Division No. 5, a copy of which is attached as Exhibit "D". The Whip Well is used for the domestic uses of one single family residence, stock watering for up to four horses and the irrigation of 0.95 acres of home gardens and lawns. The well is a source of supply for the main residence, bam and grounds. The caretaker unit is served by the Whipple Spring Nos. 1 and 2 and Pipeline, decreed in Case No. W-542, Water Division No. 5; a copy of this decree is attached as Exhibit "E". This water right, which dates back to May 1, 1947, is protected by the historic users' pool of the Federal Green Mountain Reservoir. The water right is used for domestic and irrigation uses subject to a Water Ownership and Sharing Agreement with an adjoining parcel of land. A copy of the Water Ownership and Sharing Agreement is attached as Exhibit "F". The springs arise on BLM property and the applicant successfully secured a Special Use Permit for the location and use of the structures and water right, as evidenced by the Permit attached as Exhibit "G" hereto. The foregoing demonstrates that all structures located on the property, including the caretaker unit which is the subject of the current building permit request, has an adequate physical and legal water supply. The Referee does therefore conclude that the above -entitled Application should be granted as follows: 1. That the application for approval of the plan for augmentation described herein is hereby approved. 2. That the operation of this Plan for Augmentation will not cause injury to the appropriative system or owners of vested or decreed conditional water rights. 3. That the structures set forth may be operated in accordance with this Ruling without State Administrative curtailment for the benefit of senior appropriations, so long as the terms and conditions herein set forth are fully adhered to throughout the operation of this plan for augmentation. 4. Pursuant to C.R.S. §37-92-305(8), the State Engineer shall curtail all out -of -priority diversions, the depletions from which are not so replaced as to prevent injury to vested water rights. Upon request by the Division Engineer, the Applicant shall provide the Division Engineer with copies of all records and accounts and other such information requested by the Division Engineer as will allow for the administration of this plan. 6. The approval of this plan for augmentation shall be subject to reconsideration by the Water Judge on the question of injury to the vested rights of others during any hearing commencing in the two calendar years succeeding the year in which the plan for augmentation is implemented. In setting forth this period, after consideration of all relevant facts, the Court finds that such periods are necessary to assure that no injury shall occur to vested rights by the operation of this Decree.
