Cerise Eugene "Jim" Drinkhouse Earl Rhodes Mildred Alsdorf when the following proceedings, , Commissioner Chairman Commissioner , Commissioner , County Attorney , Clerk of the Board among others were had and RESOLUTION NO. 84-i13 done, to -wit: A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT APPLICATION BY JIM AND CAROL JONES WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has received an application from Jim and Carol Jones for a Special Use permit for a mobile home as principal use of a lot on the following described tract of land: A parcel of land located in the northeast one-quarter of the northwest one-quarter (NE 1/4 NW 1/4) of section 15, Township 5 South, Range 93 West of the 6th Principal Meridian according to the dependent resurvey and survey of said township and range as approved by the United States Department of the Interior, Bureau of Land Management in Washington, D. C., on January 20, 1978. Said parcel being more specifically described as follows: Beginning at a brass cap set for the north one-quarter corner of said section 15, thence South 00° 39' 05" East, 1318.46 feet to the center -north one -sixteenth corner of section 15 being a brass cap; thence South 89° 32' 18" West, 442.44 feet on the north one -sixteenth line of section 15 to the point of intersection with the Northeasterly boundary of Colorado State Highway No. 13; thence North 560 29' 52" West 100.00 feet on the Northeasterly boundary at Colorado State Highway No. 13; thence departing said Highway No. 13 North 10° 26' 15" East, 562.91 feet; thence North 29° 49' 32" East, 822.02 feet to the point of beginning. Said parcel contains 10.00 acres, more or less. (in the State of Colorado and the County of Garfield); and WHEREAS, pursuant to required public notice, the Board conducted a public hearing on the 21st day of November, 1983, upon the question of whether the above described Special Use permit should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said Special Use permit; and WHEREAS, the Board on the basis of the evidence produced at the aforementioned hearing, has made the following determination of fact: 1. The proposed land use is compatible with the existing land uses in the area. 2. All public notice requirements have been met concerning Section 9.03.04 of the Garfield County Zoning Regulations. NOW, THEREFORE, BE IT RESOLVED, by the Commissioners of Garfield County, Colorado, that a Special Use permit be and hereby is authorized permitting the use of the above described tract of land for a mobile home as a principal use of lot, upon the following specific conditions: 1. Prior to the final approval of the mobile home Special Use Permit, all conditions of the Senate Bil 35 Exemption request regarding this 10 acre parcel must be met. 2. That the use of the tract of land comply with all present and future regulations of Garfield County relating to the location and use of mobile homes in the zone district in which the property is now or may later be located. 3. That, prior to the issuance of the authorized Special Use permit, the above described tracts of land shall be severed from any other tract of land upon which there may exist a principal use unless such other such principal use has been terminated at the time of the issuance of the Special Use permit. 4. The applicants shall obtain and comply with all County building and septic permit regulations. 5. The individual sewage disposal system permit shall be obtained at the time the building permit is issued and shall be installed prior to occupancy. 6. The water supply system shall be available prior to the occupancy of the building. 7. Skirting around the mobile home shall be securely in place within 60 days after placement of the mobile home. No storage shall be allowed underneath or outside of the structure. The building official may require tie downs in areas subject to high winds. 8. That the mobile home make, year, list price/new purchase price and serial number be submitted to the Planning Section prior to issuance of the mobile home Special Use permit. 9. The mobile home must have a minimum of 720 square feet. 10. The mobile home shall be placed on a permanent concrete or masonry footer. 11. That the mobile home Special Use permit must be taken out within one year of the date of the signing of the Resolution of Approval. 12. That all proposals of the applicant shall be considered conditions of approval unless otherwise stated by the Board of County Commissioners. Dated this 18th day of �e ATTEST: .J4r-1.
