TO QUALIFY FOR A MINOR EXEMPTION Division of land by which no more than two (2) parcels, i.e. one (1) new parcel and the remainder parcel, will be split from any parcel that was described in the records of the Garfield County Clerk and Recorder's Office as of January 1, 1973, regardless of size, as long as the resulting parcels meet the minimum lot size for the underlying zone district. The proposed Minor Exemption shall satisfy the criteria in Section 5-407, General County Exemption Criteria, and shall require recording of a Minor Exemption Plat, describing each Exemption Lot by a metes and bounds legal description and as a numbered or lettered "Exemption Lot" . II. TO QUALIFY FOR A MAJOR EXEMPTION Division of land by which no more than four (4) parcels, i.e. the remainder parcel and not more than three (3) new parcels will be split from a parcel of land that was described in the records of the Garfield County Clerk and Recorder's Office as of January 1, 1973 as a parcel of land 35 acres or more in size and not part of a recorded subdivision. In addition to the general exemption criteria, contained in Section 5-407, the proposed Major Exemption shall require recording of a Major Exemption Plat, describing each Exemption Lot by a metes and bounds legal description and as a numbered or lettered "Exemption Lot". For purposes of the definition of Minor and Major Exemptions: 1) All tracts of land thirty five (35) acres or greater in size created after January 1, 1973 pursuant to C.R.S. 30-28-101(10)(b), i.e. divisions of land creating parcels each of which comprises thirty-five (35) acres or more and none of which is intended for use by multiple own.ers, shall be considered parcels of land created by exemption for purposes of further division in accordance with the exemption review processes outlined in Division 4 and, thus, shall be counted as one of the not more than four (4) Exemption Lots allowed to be split by the Major or Minor Exemption process; unless; 2) If the parcel of land under consideration, or part thereof, is split by a public right- of-way or a County road right-of-way included in the County highway system, and the location of the public or County right-of-way prevents joint use of one or more of the proposed Exemption Lots, then the division of land may include a split into no more than five (5) parcels, i.e. no more than four (4) new parcels and the remainder parcel in a Major Exemption and no more than three (3) parcels, i.e. no more than two (2) new parcels and the remainder parcel, in a Minor Exemption. Ill. APPLICATION SUBMITTAL REQUIREMENTS As a minimum, an application for a· Major Exemption shall specifically provide the following items below pursuant to Article V, Sections 5-406 and 5-501. . j ' ' ' I ' i ' I I I I 1. Submit a completed and signed Application Form, an application fee, and a signed Agreement for Payment form. 2. A narrative addressing criteria in this application and explaining the purpose of the application. 3. Copy of the deed showing ownership. Additionally, submit a letter from the property owner(s) if the owner is being represented by another party other than the owner. If the property is owned by a corporate entity (such as an LLC, LLLP, etc.) Please submit a copy of recorded "Statement of Authority" demonstrating that the person signing the application has the authority to act in that capacity for the entity. 4. Submit a copy of the appropriate portion of a Garfield County Assessor's Map showing the subject property and all public and private landowners adjacent to your property (which should be delineated). In addition, submit a list of all property owners, private and public, and their addresses adjacent to or within 200 ft. of the site. This information can be obtained from the County Assessor's Office. You will also need the names (if applicable) of all mineral interest owners of the subject property, identified in the County Clerk and Recorder's records in accordance with §24-65.5-1 01, et seq. (That ..... information may be found in your title policy under Exceptions to Title). 5. Vicinity map: An 8 % x 11 vicinity map locating the parcel in the County. The vicinity map shall clearly show the boundaries of the subject property and all property within a 3-mile radius of the subject property. The map shall be at a minimum scale of 1"=2000' showing the general topographic and geographic relation of the proposed exemption to the surrounding area for which a copy of U.S.G.S. quadrangle map may be used. 6. A copy of the Pre-Application Conference form from the original Pre- Application Conference. 7. Provide a Minor I Major Exemgtion Plat that is scaled at 1 inch to 200 feet for properties exceeding 160 acres in size, or 1 inch to 100 feet for properties less than 160 acres in size. The Director may require a more detailed version of all or part of the exemption map or plat. The required details for an Exemption Map or Plat can be found in Section 5-502(C)(7) of the ULUR. 8. All requests for Minor and Major Exemptions shall be required to demonstrate that they can meet the following criteria: a) Adequate Water Supply. The resulting Exemption Lots have a sufficient legal and physical source of water, in compliance with the requirements of this Land Use Code set forth in Section 7-104 of Article VII, Standards. .i b) Adequate Water Distribution and Wastewater Disposal System. The resulting Exemption Lots have an adequate water distribution system and wastewater disposal system in compliance the requirements of this Land Use Code set forth in Section 7-105 of Article VII, Standards. c) Adequate Access. The resulting Exemption Lots have legal and adequate access in compliance with the requirements of this Land Use Code set forth in Section 7-107 of Article VII, Standards. d) Hazards. The resulting Exemption Lots do not create hazards identified in Section 7-209 and Section 7-210 of Article VII, or exacerbate existing hazards. e) Compliance with Comprehensive Plan and Intergovernmental Agreements. The proposed exemption is consistent with applicable provisions of the Garfield County Comprehensive Plan and any intergovernmental agreements between the County and a municipality that apply to the area where the division of land will occur. f) Exemption Map Requirements. See the specific requirements for Exemption Plats at Section 5-502 86 and 87. The following general criteria also apply: 1. Suitability of Plat for Recordation. The exemption map or plat is drawn in accordance with the requirements of these Regulations and is suitable for recordation. 2. Adequacy of Supporting Materials. The exemption plat meets all planning, engineering, and surveying requirements of these Regulations for maps, data, surveys, analyses, studies, reports, plans, designs, documents, and other supporting materials. 3. Liens and Encumbrances. The exemption plat does not include a lien, conveyance, or encumbrance to the property dividing a lot or encumbering the public use of public dedications for roadways public utility easements or other purposes. g) Taxes. All taxes applicable to the land have been paid. 9. Submit 3 copies of this comp!eted application and all the required submittal materials to the Building ana Planning Department. Staff will . request additional copies once the application has been deemed technically complete. . j ' . I I I ' I I . I IV. PROCEDURAL REQUIREMENTS Minor and Major Exemptions are reviewed in an Administrative Process. The following steps outline how the Major Exemption review process works in Garfield County as further defined in Article IV, Section 4-104 of .the Unified Land Use Resolution of 2008 . 1. Pre-Application Conference. A pre-application conference shall be held in accordance with the provisions of Section 4-103 A, Pre-Application Conference. 2. Application. The application materials required for a land use change subject to Administrative Review are set forth in Section 4-601 A. 3. Determination of Completeness. The Director shall review the application for determination of completeness in accordance with the provisions of Section 4- 103 C, Determination of Completeness. 4. Evaluation by Director/Staff Review. Upon determination of completeness, the Director shall review the application for compliance with the applicable requirements. A staff report shall be prepared pursuant to Section 4-103 E. a) Review by Referral Agencies. The Pirector's evaluation of the application may include comment by referral agencies received under Section 4-103 D, Review by Referral Agency. b) Notice to Adjacent Property Owners. The applicant shall mail a written notice by certified mail, return receipt requested, to the owners of record of all property adjacent to the property within a 200' radius and the mineral owners of record in the office of the County Clerk and Recorder .. The notice shall include a vicinity map, the property's legal description, a short narrative describing the current zoning and proposed land use change, and the contact information and the date that the Director has to make a ,, decision and notice of the 10 day period after the Director's decision to appeal the decision and the deadline for comments to be submitted. The comment period for adjacent property owners shall be within twenty-one (21) calendar days from the date of receipt of the notice established by return receipt. 5. Director Decision. Within thirty (30) working days of the date of determination of completeness, or close of the comment period if the application is referred for comment, the Director may approve, approve with conditions or deny the land use change application subject to Administrative Review. The Director's decision shall be based upon compliance of the proposed use with the approval standards set forth in Divisions 1 and 2 of Article VII, Standards. a) Approval of Application. If the application satisfies all of the applicable standards, the application shall be approved. The application may be I i i : i J approved with conditions determined necessary for compliance with applicable standards. Once it has been approved, the applicant shall prepare the necessary legal documents to be placed on the consent agenda for the signature of the Chairman of the Board of County Commissioners and shall be duly recorded by the Clerk and Recorder after signature. b) Denial of Application. If the application fails to satisfy all of the applicable standards, the application shall be denied. 6. Written Notice of Decision. The Director shall inform the applicant and noticed property owners of the approval, conditions of approval or basis for denial in writing within five (5) working days of the date of decision. Notice of the Director's decision shall also be provided to the Board of County Commissioners. V. AMENDMENTS TO APPROVED EXEMPTIONS An amendment may be made to a recorded Final Exemption Plat if such amendment does not increase the number of subdivision lots or result in a major relocation of a road or add one or more new roads (pursuant to Section 5,306). A correction can be made to a recorded Exemption Plat in order to correct an engineering error, mislabeling issue, etc. that does not affect the substance of the plat. .... A. Outline of Prqcesses. The review processes for amending an Exemption Plat shall consist of the following: 1. Four (4) Lots or Less: The Administrative Review Process, detailed in Section 4, 104 of Article IV, shall be used for review of a request to amend an Exemption Plat for modifying lot lines, building envelopes, easement locations or other interests affecting up to four (4) lots. An Amended Exemption Plat which modifies lot lines or easements affecting not more than two (2) adjacent Exemption Lots or a single building envelope shall be subject to the Administrative Review Process set forth in Section 4,104 of Article IV, with the addition of presentation of the Amended Exemption Plat to the Board of County Commissioners for signature, prior to recording with the Office of the Clerk and Recorder. ' 2. More Than Four (4) Lots: The Major Exemption Review Process, detailed in Section 5A03, shall be used to amend an Exemption Plat modifying lot lines, building envelopes, easement locations or other interests affecting more than four (4) Exemption Lots. An Amended Final Exemption Plat which modifies lot lines or easements affecting more than four (4) lots or more than one (1) building envelope shall be subject to the Major Exemption Review Process set forth in Section 5A03. 6 ' . OWNER understands and agrees that Garfield County Resolution No. 98-09, as amended, establishes a fee schedule for each type of subdivision or land use review applications, and the guidelines for the administration of the fee structure. 3. OWNER and COUNTY agree that because of the size, nature or scope of the proposed project, it is not possible at this time to ascertain the full extent of the costs involved in processing the application. OWNER agrees to make payment of the Base Fee, established for the PROJECT, and to thereafter permit additional costs to be billed to OWNER. OWNER agrees to make add~tional payments upon notification by the COUNTY when they are necessary as costs are incurred. 4. The Base Fee shall be in addition to and exclusive of any cost for publication or cost of consulting service determined necessary by the Board of County Commissioners for . . the consideration of an application or additional COUNTY staff time or expense not covered by the Base Fee. If actual recorded costs exceed the initial Base Fee, OWNER shall pay additional billings to COUNTY to reimburse the COUNTY for the processing of the PROJECT mentioned above. OWNER acknowledges that all billing shall be paid prior to the final consideration by the COUNTY of any land use permit, zoning amendment, or subdivision plan. Hoaglund and Ida L. Hoaglund ("Applicants") request that the Board of County Commissioners exempt by resolution the division of a 283.61 acre, more or less, tract of land into one tract of 17.189. acres, more or less, (Parcell), and one tract of266.421 acres, more or less, (Parcel2) from the definitions of "Subdivision" and "Subdivided Land" as the terms are used and defined in C.R.S. § 30-28- lOl(lO)(a)-(d) and the Subdivision Regulations. Submitted herewith are a completed application form and payment agieement form signed by the Hoaglunds. This request is based upon the reasons stated below. I. The 283.61 acres, more or less, tract which is the subject of this request is owned by Applicants and is described summarily as a tract of land in the SEI/4 SEI/4 and in Lots 6 and 7 and In ilie Southwest 5.04 acres ofLot 5 in Section 35, Township 6 South, Range 95 West and Lots I, 2, 3, and 4 in Section 2, Township 7 South, Range 95 West of the 6th P.M. in Garfield County, Colorado. A copy of the deed transferring the property to Applicants on December 22, 1975 is attached as Exhibit 1. 2. The purpose of this exemption request is to allow transfer of the smaller ofthe lots to Applicants' son for residential use. 3. The residential improvements on the Parcels are supplied with domestic water through Hoaglund Well No. I permitted as Division of Water Resources Permit No. 279383. ( Copies of the Pennit, a report from Colorado River Engineering, and a proposed Declaration of Water Well Use and Maintenance are attached as Exhibit 2.) 4. The residential improvements constructed on Parcels I and 2 are served by individual septic systems. 5. Each of the parcels are accessed via County Road 309 and have exercised that access via existing driveways in place for more than twenty years. 6. No parcels have been separated from the property as it existed on January I, 1973. Attached as Exhibit 3 are-copies of the deed transferring the property to Applicants' predecessor In title on March 5, 1941 and graphic representations of the property on January I, 1972 and on today's date. 7. In further support of this Request, the following documents are submitted: a. Proposed exemption plat including vicinity map; b. Letter authored by Colorado River Engineering, dated December 10, 20 I 0 with Geohazard Report (Exhibit 4); c. Schedule of names and addresses of owners of record oflands within 200 feet of the proposed exemption, Assessor's map and mineral owners of record for the exempted parcels (Exhibit 5); d Copy of Request for the Comments from Grand Valley Fire Protection District and copy of response (Exhibit 6); e. Copy of Pre-Application Conference Form (Exhibit 7); and f. Copy of Assessor's data base showing payment of taxes (Exhibit 8); and g. Application Fee of $300.00. 8. School impact fees as provided by regulation will be paid upon approval of final exemption plat. ENGINEERING lliCORrORATED Mr. & Mrs. Edward Hoaglund 4064 County Road 309 Parachute, CO 81635 December 9, 2010 RE: Job #701-Hoaglund Exemption-Water Supply Dear Ed & Ida: As requested, Colorado River Engineering, Inc has completed a water supply review for the existing well which currently serves your residence located at 4064 CR 309 and the residence located to the east at 4136 CR 309, the latter of which is proposed for subdivision from the balance of your ranch through the subdivision exemption process. The purpDse of our review was to conform to the requirements of the Garfield County Land Use Code for Individual Wells (7-104.B) as part of the exemption process. It is our opinion that the water supply has adequate quality, quantity, and dependability _ .. for the proposed uses. In support of our work we are attaching the following documents; • Well Permit 279383 • Well Construction Report • Pump Installation Report • Water Quality Laboratory Results Legal Supply The well is permitted as a "35-acre Exempt Well" with the Colorado Division of Water Resources under Permit No. 279383. The permit limits include a maximum pumping rate of 15-gpm (gallons per minute), use in up to 3 single family dwellings, the watering of poultry, livestock, and domestic animals, fire protection, and the irrigation of up to !-acre of lawn and gardens. Well Construction The well was constructed to a total depth of 140' and completed at a depth of 130' by Shelton Drilling Corporation on April I, 2009. The well was constructed into the Wasatch Formation with water encountered between 110' to 125' below the surface. The static water level was recently measured at 104'-W' below the top of the casing. A 1-1/2 hp well pump capable of producing up to 15-gpm was installed by Samuelson Pump Company on April 8, 2009 at a depth of 130'. Well Yield Test A well yield test was conducted by Colorado River Engineering from July 19 to July 20, 2010. The well was pumped for 24-hours and 10-minutes with monitoring ofdrawdown, recovery, and the collection of water quality samples. The water yield rate over the study period was set to approximately 1.1-gpm, which totaled I ,590-gallons of water pumped P.O. The water level in the well dropped approximately 2'-3!1,'' during a typical pump cycle and recovered to the initial static water level of 104'-W' before a new pump cycle began. The well produced substantially more water than would be required for two typical residences, assuming that each residence would require 350 gallons per day or 700-gallons.per day total for two residences combined. Recovery data showed the well is recharged and will provide a dependable supply. The test shows that the well has significantly more available yield and has characteristics of an alluvial well. No impacts to surrounding ground water resources are expected to occur based on the location and aquifer characteristics. Water Quality Use of the well for two single family residences does not prompt any water quality testing and monitoring by the Colorado Department of Public Health & Environment under the Colorado Primary Drinking Water Regulations. However, tests were conducted to meet items identified in the Garfield County Land Use Code Section 7-104.B.2.d which includes inorganic contaminants (heavy metals), asbestos, nitrate/nitrite, sulfate, bacteria, and radiological parameters. Secondary standards for items such as taste and odor were not tested. The water quality results for the parameters analyzed were all below established Maximum Contaminant Levels, MCL. The overall water quality for . this well is excellent. Existing System The existing system consists of a pipeline from the well to a point located between the two residences, on the south side ofCR 309. A "Tee" in the pipeline delivers water from the well to the two residences. A pressure tank is connected to the pipeline at the residence located at 4136 CR 309. The pressure tank and associated pressure switch controls the operation of the well pump. When water is used at either residence, the pressure in the pressure tank drops to the lower set point and the well pump is started. The well pump then delivers water into the pipeline and the pressure tank until the pressure rises to the upper set point and the well pump is stopped. A well sharing agreement should be developed to define the well usage, operation, and maintenance terms. It is our opinion that the water supply has adequate quality, quantity, and dependability for the proposed use. WHEREAS, Declarant is the owner in fee of those real properties described as Parcels 1 and 2 on the plat of the Hoaglund Subdivision Exemption, Garfield County, Colorado. Said Parcels 1 and 2 are referred to hereinafter collectively as "the Parcels." WHEREAS, Declarant is the owner of a water well ("Well") located on Parcel2, Hoaglund Subdivision Exemption, and permitted under Colorado Division of Water Resources Well Permit No. 279383 for, inter alia, the domestic and irrigation use of not more than three single family dwellings; and WHEREAS, by this Declaration, it is the intent of Declarant to establish a regime governing the joint use of the Well by the future owners of the Parcels (the "Owners"). The Owner of Parcell shall be deemed to own an undivided one-third share of the subj~t Well permit, Well, pump, fittings at the Well head, meters (whether existing now or to be installed at a later time), pump house, foot valves, and any pipes or pipelines and any other structures which are jointly used. 2. The Owner ofParcel2 shall be deemed to own an undivided two thirds share of the subject Well permit, Well, pump, fittings at the Well head, meters (whether existing now or to be installed at a later time), pump house, foot valves, and any pipes or pipelines and any other structures which are jointly used. 3. No Owner is deemed to have any ownership right in and to any pipe, pipeline or other structure used or required solely by the Owner of another of the Parcels which may utilize any portion of the water flowing, from this Well and its structures. This Declaration does not intend to relate to such individually owned or used rights or structures. Nothing in this Declaration shall be construed to give any Owner any rights to such non-shared property of the other Owner nor to obligate any Owner to pay any costs associated with non-shared structures. 4. The Owners shall cooperate with each other at all times in all matters necessary to promote the proper construction, completion and functioning and use of the water system in such manner as to provide to their respective uses an optimum water supply on demand at all times possible based upon the natural availability of water. The Owners shall agree to not waste water and to endeavor to use no more than their respective shares of the available water. At this time it is agreed that no individual water meters must be installed. If at any time after the date hereof, any 1 I . I I I , Owner requires that meters be installed, then each of the Owners shall install meters at their individual expense. Waste or over-use shall be deemed to be a violation of this Declaration for which the non-defaulting owner may seek remedy at law or equity for damages or for injunctive relief, or both. Irrigation uses shall be limited to not more than 1 /3 acre oflawn and garden irrigation for Parcel 1 and 2/3 acre oflawn and garden irrigation for Parcel2. Unless otherwise agreed by each Owner, the Owner of Parcell shall not use more than one-third (113) of the water legally allocated to the Well (i.e., 5 g. p.m.) and the Owner ofParcel2 shall not use more than two thirds (2/3) of the water legally allocated to the Well (i.e., 10 g. p.m.). In the event the water physically available from the Well is less than the legally available amount, then each Owner shall proportionately reduce the consumption of same to the amount actually available. In no event shall the Well be pumped at a rate exceeding fifteen (15) gallons per minute. Any household use of the Well water must provide for return flow through an individual disposal system of the non-evaporative type, returning the water to the watershed in which the Well is located. 5. Declarant has installed and constructed the Well system, pump house, and any jointly used pipe lines. Following the initial construction, the actual and continuing costs of operation, maintenance, construction, extension, upgrading, cleaning, repairing and all other work required on. shared components of this water system to cause the water at the well to become and remain available to deliver water to the Owners shall be shared by the Owners in proportion to their share in the Well. This Declaration shall relate only to costs incurred after the date hereof. Electrical charges for the operation of the Well shall be shared in proportion to the water allocated to each Owner. No operational costs will be charged to any Owner until such owner actually makes a physical connection to the well and begins using water from same. 6. Subject to the provisions in paragraph 5 above, any Owner who has been using water from this system and at any time elects not to share in costs, necessary repairs, maintenance, replacement and the like necessary to maintain the Well and deliver the subject water, shall not receive water from the system. At such time as said electing Owner chooses to resume use of water from the system said Owner may do so upon reimbursement to the other user the full cost of said Owner's share of such expenditures with legal interest retroactive to the expenditure date. . 7. The Owners agree to cooperate in the future maintenance, operation, repair, replacement or improvement of all common facilities. In the event the Owners are unable to agree on any required maintenance, repair, replacement or improvement, any Owner shall be entitled to undertake the minimal maintenance, repair, replacement or improvement necessary and essential for proper functioning of the common facilities. In the event an Owner determines to undertake such work unilaterally, such Owner shall notifY the other owners in writing. The Owner undertaking the work shall, upon completion, provide the other Owner with a written statement of work performed and the other Owner's proportionate share of the cost of same. In the event an Owner fails to pay the proportionate share of any amount due within thirty (30) days after presentment, the Owner which has paid such cost and expense shall be entitled to pursue any remedy available at law or in equity. Colorado River Engineering is recommending that the existing structures evaluate their defensible space in accordance with the Colorado .. State Forest Service Regulations as a wildfire safety preventative measure. The access for the created parcels is provided by County Road 309 and did not require additional review. New construction will require the applicant to obtain a driveway permit through Garfield County Road and Bridge at the time of building permit review. The existing structures are currently on Individual Sewage Disposal Systems (ISDS) and appear operational. Stones are angular to subangular and primarily unweathered basalt derived largely from landslide deposits (Qsl) . Terrace and Fan Gravels of Grand Mesa (map unit Qga/Qgay) Pebble, cobble, and boulder gravel in sandy matrix; glacial and nonglacical; moderately to well sorted; subrounded to well rounded; stones are mostly basals but also include variable amounts of sedimentary rocks; near Colorado river are abundant cobbles of igneous and metamorphic rocks derived from east of the mapped area. Qgay are younger gravels; merges with recent floodplain deposits (Qal). Referencing the USDA NRCS Web Soil Survey, the main soil physical properties encountered on the project are: a. Potts loam-This soil type makes up over 39% of the parcel of land. It has gentle slopes ranging from 3 to 12 percent. b. Potts-lldefonso Complex-This soil type makes up over 17% of the parcel of land). It has moderate to steep slo.pes ranging from 12 to 45 percent. c. Torrifluvents -This soil type makes up over 21% of the parcel. It has nearly levelland characteristics. d. Wann Sandy loam-This soil type makes up over 7% of the parcel of land. It has gentle slopes ranging from 1 to 3 percent. e. lldefonso stony loam-This soil type makes up over 5% of the parcel of land. It has steep slopes ranging from 25 to 45 percent. The hydrologic soil group for the majority of the soil types is Group B. These soils have a moderate infiltration rate when thoroughly wet. They consist chiefly of moderately deep or deep, moderately well drained or well drained soils that have moderately fine texture to moderately course texture. These soils have a moderate rate of water transmission. The subject parcel does not fall within the extent of geologic study on the Garfield- County Slope Hazard or Soil Hazard Maps. 21Page I ' Seismicity This area, like most of Colorado, is subject to a degree of seismic activity. Geologic evidence indicates that movement along some Colorado faults has occurred during the last two million years (Quaternary). The site is located in the Colorado Plateau Physiographic province as designated by Kirkham & Rogers, 1981. Relatively few faults with evidence of recent activity are known to be present in this province. The closest known fault is an unnamed fault east of Whitewater (Class A) No. 2257, located 62 miles to the west-south west. Evidence of Quaternary movement on this fault has not been demonstrated. The Colorado geologic Survey considers this part of Colorado to be in Seismic Zone 2. Mitigation for seismicity should include design of new structures to resist seismic shaking forces. Appropriate seismic design parameters should be developed for individual structures after design-level geotechnical studies are performed. Ground Water The project site contains multiple irrigation laterals, springs and encompasses portions of Cottonwood Creek and the Colorado River. CRE reviewed well drilling permit documents and no apparent evidence of groundwater exists. New construction that may be proposed in low lying agricultural fields, or along the Colorado River, should be reviewed by a Geotechnical Engineer during their analysis and recommendations for building construction. Erosion Near surface materials, particularly in the steep sloping southern portion of the site and along the Colorado River are considered susceptible to erosion. Erosion potential would be expected to increase as vegetation is disturbed due to construction activity. The application does not create the need for immediate erosion control or construction activities. Proper management of naturally occurring storm water runoff with techniques of Best Management Practices may be required to limit the effects of erosion on the surrounding areas. Generally, surface drainage should be designed to eliminate ponding of water, minimize sediment transport, and provide for the rapid removal of runoff. Wildfire Hazard The property was mapped by Garfield County Geographic Information Services based on Colorado State Forest Service wildfire hazard mapping practices and delineated as having a low to moderate hazard (see attached map). A site visit of the property reveals that the steep southern slope of the property, particularly around the Subdivision Exe-mption Lot 1 contains quid< liuYning fuels sucn as pirMn, juniper an·d sage \vhii:n could be a tributary hazard if wildfire were present. It is recommended that the existing structures on the property be evaluated and improved to provide a defensible space in accordance with the Colorado State Forest Service memorandum No. 6.302 on "Creating 3fPage , I .I : . In general a 75-foot defensible space consisting of two zones should be created around the homes. Zone One removes all flammable vegetation and ladder fue!s within the first 15-ft from the home. Zone Two is the removal of stressed, diseased or dead trees and shrubs and thinning and pruning remaining vegetation with emphasis placed around the driveway. Slope Hazard The property in general has a steep hillside gradient from the south, down to flat agricultural pasture land and then steepens as terrain drops into the Colorado River Basin. Areas in the steeper southern western portion of the site are inclined steeper than about 3:1 (horizontal to vertical) and have periodic rock outcroppings. The site is outside of the "Geologic Hazards Identification Study" prepared by Lincoln-Devore Testing Laboratory for the 1-70 corridor, however moderate slope hazards largely due to the rock outcroppings and steep slopes in the southwest of the property do exist. A slope analysis for Exemption Parcel 1 has been prepared with this application and no structures are located in slopes greater than 30%. The existing home on Subdivision Exemption Parcel One is substantially protected from slope hazards by a road uphill and south of the structure and will act as an additional barrier to mitigate any potential hazard. Development Recommendations Colorado River Engineering did not identify geologic conditions or hazards we believe will preclude the subdivision exemption. The primary development considerations for the site are avoidance of construction on steep slopes and wildfire mitigation. The current site plan for the property does not propose any structures or development onto the steep slopes greater than 20%. Wildfire impacts can occur on this property and proper management practices for structures, such as creating and maintaining defensible space, will be necessary. These estimates are given for the layers of each soil in the survey area. The estimates are based on field observations and on test data for these and similar soils. Depth to the upper and lower boundaries of each layer is indicated. Particle size is the effective diameter of a soil particle as measured by sedimentation, sieving, or micrometric methods. Particle sizes are expressed as classes with specific effective diameter class limits. The broad classes are sand, silt, and clay, ranging from the larger to the smaller. Sand as a soil separate consists of mineral soil particles that are 0.05 millimeter to 2 millimeters in diameter. In this table, the estimated sand content of each soil layer is given as a percentage, by weight, of the soil material that is less than 2 millimeters in diameter. Silt as a soil separate consists of mineral soil particles that are 0.002 to 0.05 millimeter in diameter. The content of sand, silt, and clay affects the physical behavior of a soil. Particle size is important for engineering and agronomic interpretations, for determination of soil hydrologic qualities, and for soil classification. The amount and kind of clay affect the fertility and physical condition of the soil and the ability of the soil to adsorb cations and to retain moisture. They influence shrink- swell potential, saturated hydraulic conductivity (Ksat), plasticity, the ease of soil dispersion, and other soil properties. The amount and kind of clay in a soil also affect tillage and earthmoving operations. Moist bulk density is the weight of soil (ovendry) per unit volume. Volume is measured when the soil is at field moisture capacity, that is, the moisture content at 113-or 1110-bar (33kPa or 10kPa) moisture tension. Weight is determined after the soil is dried at 105 degrees C. In the table, the estimated moist bulk density of each soil horizon is expressed in grams per cubic centimeter of soil material that is less than 2 millimeters in diameter. Bulk density data are used to compute linear extensibility, shrink-swell potential, available water capacity, total pore space, and other soil properties. The moist bulk density of a soil indicates the pore space available for water and roots. Depending on soil texture, a bulk density of more than 1.4 can restrict water storage and root penetration. Moist bulk density is influenced by texture, kind of clay, content of organic matter, and soil structure. Saturated hydraulic conductivity (Ksat) refers to the ease with which pores in a saturated soil transmit water. The estimates in the table are expressed in terms of micrometers per second. They are based on soil characteristics observed in the field, particularly structure, porosity, and texture. Saturated hydraulic conductivity (Ksat) is considered in the design of soil drainage systems and septic tank absorption fields. The capacity for water storage is given in inches of water per inch of soil for each soil layer. The capacity varies, depending on soil properties that affect retention of water. The most important properties are the content of organic matter, soil texture, bulk density, and soil structure. Available water capacity is an important factor in the choice of plants lor crops to be groWn and in the design and management of irrigation systems. Available water capacity is not an estimate ' of the quantity of water actually available to: plants at any given time. Linear extensibility refers to the change in length of an unconfined clod as moisture content is decreased from a moist to a dry state. It is an expression of the volume change between the water content of the clod at 1/3-or 1/10-bar tension (33kPa or 1 OkPa tension) and oven dryness. The volume change is reported in the table as percent change for the whole soil. The amount and type of clay minerals in the soil influence volume change. Linear extensibility is used to determine the shrink-swell potential of soils. The shrink-swell potential is low if the soil has a linear extensibility of less than 3 percent; moderate if3 to 6 percent; high if6 to 9 percent; and very high if more than 9 percent. If the linear extensibility is more than 3, shrinking and swelling can cause damage to buildings, roads, and other structures and to plant roots. Special design commonly is needed. Organic matter is the plant and animal residue in the soil at various stages of decomposition. In this table, the estimated content of organic matter is expressed as a percentage, by weight, of the soil material that is less than 2 millimeters in diameter. The content of organic matter in a soil can be maintained by returning crop residue to the soil. Organic matter has a positive effect on available water capacity, water infiltration, soil organism activity, and tilth. It is a source of nitrogen and other nutrients for crops and soil organisms. Erosion factors are shown in the table as the K factor (Kw and Kf) and the T factor. Erosion factor K indicates the susceptibility of a soil to sheet and rill erosion by water. Factor K is one of six factors used in the Universal Soil Loss Equation (USLE) and the Revised Universal Soil Loss Equation (RUSLE) to predict the average annual rate of soil loss by sheet and rill erosion in tons per acre per year. The estimates are based primarily on percentage of silt, sand, and organic matter and · on soil structure and Ksat. Values of K range from 0.02 to 0.69. Other factors being ' equal, the higher the value, the more susceptible the soil is to sheet and rill erosion by water. Erosion factor Kw indicates the erodibility of the whole soil. The estimates are modified by the presence of rock fragments. Erosion factor Kf indicates the erodibility of the fine-earth fraction, or the material less than 2 millimeters in size. Erosion factor Tis an estimate of the maximum average annual rate of soil erosion by wind and/or water that can occur without affecting crop productivity over a sustained period. The rate is in tons per acre per year. Wind erodibility groups are made up of soils that have similar properties affecting their susceptibility to wind erosion in cultivated areas. The soils assigned to group 1 are the most susceptible to wind erosion, and those assigned to group 8 are the least susceptible. The groups are described in the "National Soil Survey Handbook." Depth to the upper and lower boundaries of each layer is indicated. Texture is given in the standard terrr\s used by the U.S. Department of Agriculture. These terms are defined according to percentages of sand, silt, and clay in the fraction of the soil that is less than 2 millimeters in diameter. "Loam," for example, is soil that is 7 to 27 percent clay, 28 to 50 percent silt, and less than 52 percent sand. If the content of particles coarser than sand is 15 percent or more, an appropriate modifier is added, for example, "gravelly." Classification of the soils is determined according to the Unified soil classification system (ASTM, 2005) and the system adopted by the American Association of State Highway and Transportation Officials (AASHTO, 2004). The Unified system classifies soils according to properties that affect their use as construction material. Soils exhibiting engineering properties of two groups· can have a dual classification, for example, CL-ML. The AASHTO system classifies soils according to those properties that affect roadway construction and maintenance. In this system, the fraction of a mineral soil that is less than 3 inches in diameter is classified in one of seven groups from A-1 through A-7 on the basis of particle-size distribution, liquid limit, and plasticity index. Soils in group A-1 are coarse grained and low in content of fines (silt and clay). At the other extreme, soils in group A-7 are fine grained. Highly organic soils are classified in group A-8 on the basis of visual inspection. If laboratory data are available, the A-1, A-2, and A-7 groups are further classified as A-1-a, A-1-b, A-2-4, A-2-5, A-2-6, A-2-7, A-7-5, or A-7-6. As an additional refinement, the suitability of a soil as subgrade material can be indicated by a group index number. Group index numbers rahge from 0 for the best subgrade material to 20 or higher for the poorest. · Rock fragments larger than 10 inches in diameter and 3 to 10 inches in diameter are indicated as a percentage of the total soil on a dry-weight basis. The percentages are estimates determined mainly by converting volume percentage in the field to weight percentage. Percentage (of soil particles) passing designated sieves is the percentage of the soil fraction less than 3 inches in diameter based on an oven dry weight. The sieves, numbers 4, 10, 40, and 200 (USA Standard Series), have openings of4.76, 2.00, 0.420, and 0.074 millimeters, respectively. Estimates are based on laboratory tests of soils sampled in the survey area and in nearby areas and on estimates made in the field. Liquid limit and plasticity index (Atterberg limits) indicate the plasticity characteristics of a soil. Soils are assigned to one of four groups according to the rate of water infiltration when the soils are not protected by vegetation, are thoroughly wet, and receive precipitation from long-duration storms. I The soils in the United States are assigned to four groups (A, B, C, and D) and three dual classes (ND, B/D, and C/D). The groups are defined as follows: Group A. Soils having a high infiltration rate (low runoff potential) when thoroughly wet. These consist mainly of deep, well drained to excessively drained sands or gravelly sands. These soils have a high rate of water transmission. Group B. Soils having a moderate infiltration rate when thoroughly wet. It can find the weak link in your home's fire protection scheme and gain the upper hand because of a small, overlooked or seemingly inconsequential factor. While you may not be able to accomplish all measures below (and there are no guarantees), each will increase your home's, and possibly your family's, safety and survival during a wildfire. Start with the easiest and least expensive actions. Begin your work closest to your house and move outward. Keep working on the more difficult items until you have completed your entire project. Defensible Space 1\vo factors have emerged as the primary determinants of a home's ability to survive wildfire. These are the home's roofing material and the quality of the "defensible space" surrounding it. Use fire-resistive materials (Class C or better rating), not wood or shake shingles, to roof homes in or near forests and grasslands. When your roof needs significant repairs or replacement, do so with a fire-resistant roofing material. Check with your county building department. Some counties now restrict wood roofs or require specific classifications of roofing material. Defensible space is an area around a structure where fuels and vegetation are treated, cleared or reduced to slow the spread of wildfire towards the structure. It also reduces the chance of a structure fire moving from the building to the surrounding forest. Defensible space provides room for firefighters to do their jobs. Your house is more likely to withstand a wildfire if grasses, brush, trees and other common forest fuels are managed to reduce a fire's intensity. The measure of fuel hazard refers to its continuity, both ',horizontal (across the ground) and vertical (from the ground up into the vegetation crown). Fuels with a high degree of both vertical and horizontal continuity are the most hazardous, particularly when they occur on slopes. Heavier fuels (brush and trees) are more hazardous (i.e. produce a more intense fire) than light fuels such as grass. Mitigation of wildfire hazards focuses on breaking up the continuity of horizontal and vertical fuels. Additional distance between fuels is required on slopes. Creating an effective defensible space involves developing a series of management zones in which different treatment techniques are used. See Figure I for a general view of the relationships among these management zones; Develop defensible space around each building on your property. Include detached garages, storage buildings, barns and other structures in your plan. The actual design and development of your defensible space depends on several factors: size and shape of buildings, materials used in their construction, the slope of the ground on which the structures are built, surrounding topography, I' b::e.! and sizes and types of vegetation on your property. These factors all affect your design. You may want to request additional guidance from your local Colorado State Forest Service (CSFS) forester or fire department. For example, if your home is situated on a 20 percent slope, the minimum defensible space dimensions would be 90 feet uphill and to the sides of the home and 104 feet downhill from the home. Zone '1 is the area of maximum modification and treatment. It consists of an area of 15 feet around the structure in which all flammable vegetation is removed. This 15 feet is measured from the outside edge of the home's eaves and any attached structures, such as decks. Zone 2 is an area of fuel reduction. It is a transitional area between Zones 1 and 3. The size of Zone 2 depends on the slope of the ground where the structure is built. Typically, the defensible space should extend at least 75 to 125 feet from the structure. See Figure 2 for the appropriate distance for your horne's defensible space. Within this zone, the continuity and arrangement of vegetation is modified. Remove stressed, diseased, dead or dying trees and shrubs. Thin and prune the remaining larger trees and shrubs. Be sure to extend thinning along either side of your driveway all the way to your main access road. These actions help eliminate the continuous fuel surrounding a structure while enhancing hornesite.safety and the aesthetics of the property. Zone 3 is an area of traditional forest management and is of no particular size. It extends from the edge of your defensible space to your property boundaries. Prescriptions Zone 1 The size of Zone 1 is 15 feet, measured from the edges of the structure. Within this zone, several specific treatments are recommended. Plant nothing within 3 to 5 feet of the structure, particularly if the building is sided with wood, logs or other flammable materials. Decorative rock, for example, creates an attractive, easily maintained, nonflammable ground cover. If the house has noncombustible siding, widely spaced foundation plantings of low' growing shrubs or other "fire wise" plants are acceptable. Do not plant directly beneath windows or next to foundation vents. Be sure there are no areas of continuous grass adjacent to plantings in this area. Frequently prune and maintain plants in this zone to ensure vigorous growth and a low growth habit. Remove dead branches, stems and leaves. Do not store firewood or other combustible materials in this area. Enclose or screen decks with metal screening. Extend the gravel coverage under the decks. Do not use areas under decks for storage. Ideally, remove all trees from Zone 1 to reduce fire hazards. If you do keep a tree, consider it part of the structure and extend the distance of the entire defensible space accordingly. Isolate the tree from any other surrounding trees. Prune it to at least 10 feet above the ground. Remove any branches that interfere with the roof or are within 10 feet of the chimney. Remove all "ladder fuels" from beneath the tree. Ladder fuels are vegetation with vertical continuity that allows fire to bum from ground level up into the branches and crowns of trees. Ladder fuels are potentially very hazardous but are easy to mitigate. No ladder fuels can be allowed under tree canopies. In all other areas, prune all branches of shrubs or trees up to a height of I 0 feet above ground (or 1/2 the height, whichever is the least). Zone 2 Zone 2 is an area of fuel reduction designed to reduce the intensity of any fire approaching your home. Follow these recommended management steps. Thin trees and large shrubs so there is at least 10 feet between crowns. Crown separation is measured from the furthest branch of one tree to the nearest branch on the next tree (Figure 3). On steep slopes, allow more space between tree crowns. (See Figure 4 for minimum recommended spacing for trees on steep slopes.) Remove all ladder fuels from under these remaining trees. Carefully prune trees to a height of at least 10 feet. Small clumps of 2 to 3 trees may be occasionally left in Zone 2. Leave more space between the crowns of these clumps and surrounding trees. Because Zone 2 forms an aesthetic buffer and provides a transition between zones, it is necessary to blend the requirements for Zones I and 3. Thin the portions of Zone 3 adjacent to Zone 2 more heavily than the outer portions. Isolated shrubs may remain, provided they are not under tree crowns. Prune and maintain these plants periodically to maintain vigorous growth. Remove dead stems from trees and shrubs annually. Where shrubs are the primary fuel in Zone 2, refer to the Special Recommendations section of this fact sheet. Limit the number of dead trees (snags) retained in this area. Wildlife needs only one or two snags per acre. Be sure any snags left for wildlife cannot fall onto the house or block access roads or driveways. Mow grasses (or remove them with a weed trimmer) as needed through the growing season to keep them low, a maximum of 6 to 8 inches. This is extremely critical in the fall when grasses dry out and cure or in the spring after the snow is gone but before the plants green up. Stack firewood and woodpiles uphill or on the same elevation as the structure but at least 30 feet away. Clear and keep away flammable vegetation w_ithin 10 feet of these woodpiles. Do not stack wood against your house or on or under your deck, even in winter. Many homes have burned from a woodpile that ignited as the fire passed. Wildfires can burn at almost any time in Colorado. Locate propane tanks at least 30 feet from any s((uctures, preferably on the same elevation as the house. You don't want the LP container below your house-· if it ignites, the fire would tend to bum uphill. On the other hand, if the tank is above your house and it develops a leak, LP gas will flow downhill into your home. Clear and keep away flammable vegetation within 10 feet of these tanks. Do not screen propane tanks with shrubs or vegetation. Dispose of slash (limbs, branches and other woody debris) from your trees and shrubs through chipping or by piling and burning. Contact your local CSFS office or county sheriff's office for information about burning slash piles. If neither of these alternatives is possible, lop and scatter slash by cutting it into very small pieces and distributing it over the ground. Lay it close to the ground to speed decomposition. If desired, no more than two or three small, widely spaced brush piles may be left for wildlife purposes. Locate these towards the outer portions of your defensible space. Zone 3 This zone is of no specified size. It extends from the edge of your defensible space to your property lines. A gradual transition into this zone from defensible space standards to other management objectives you may have is suggested. Typical management objectives for areas surrounding homesites or subdivisions are: provide optimum recreational opportunities; enhance aesthetics; maintpn tree health and vigor; provide barriers for wind, noise, dust and visual intrusions; support limited production of firewood, fence posts and other forest commodities; or grow Christmas trees or trees for transplanting. Specific requirements will be dictated by your objectives for your land and the kinds of trees present. See Figure 5 for the minimum suggested spacing between "leave" trees. Forest management in Zone 3 is an opportunity for you to increase the health and growth rate of the forest in this zone. Keep in mind that root competition for available moisture limits tree grow1h and ultimately the health of the forest. A high canopy forest reduces the chance of a surface fire climbing into the tops of the trees and might be a priority for you if this zone slopes steeply. The healthiest forest is one that has multiple ages, sizes, and species of trees where adequate growing room is maintained over time. Remember to consider the hazards of ladder fuels. Multiple sizes and ages of trees might increase the fire hazard from Zone 3 into Zone 2, particularly on steep slopes. A greater number of wildlife trees can remain in Zone 3. Make sure that dead trees pose no threat to power lines or fire access roads. While pruning generally is not necessary in Zone 3, it may be a good idea from the standpoint of personal safety to prune trees along trails and fire access roads. Or, if you prefer the aesthetics of a well-manicured forest, you might prune the entire area. In any case, pruning helps reduce ladder fuels within the tree stand, thus enhancing wildfire safety. Mowing is not necessary in Zone 3. Any approved method of slash treatment is acceptable for this zone, including piling and burning, chipping or lop-and-scatter. Special Recommendations Tree spacing guidelines do not apply to mature stands of aspen trees where the recommendations for ladder fuels have been complied with. In areas of aspen regeneration and young trees, the spacing guidelines should be followed. Brush and shrubs Brush and shrubs are woody plants, smaller than trees, often formed by a number of vertical or semi-upright branches arising close to the ground. Brush is smaller than shrubs and can be either woody or herbaceous vegetation. On nearly level ground, minimum spacing recommendations between clumps of brush and/or shrubs is 2 1/2 times the height of the vegetation. Maximum diameter of clumps should be 2 times the height of the vegetation. As with tree crown spacing, all measurements are made from the edges of vegetation crowns (Figure 3). · For example: For shrubs 6 feet high, spacing between shrub clumps should be 15 feet or more apart (measured from the edges of the crowns of vegetation clumps). The diameter of shrub clumps should not exceed 12 feet (measured from the edges of the crowns). Grasses Keep dead, dry or curing grasses mowed to less than 6 inches. Defensible space size where grass is the predominant fuel can be reduced (Figure 5) when applying this practice. Windthrow In Colorado, certain locations and tree species, including lodgepole pine and Engelmann spruce, are especially susceptible to damage and uprooting by high winds (windthrow). If you see evidence of this problem in or near your forest, or have these tree species, consider the following adjustments to the defensible space guidelines. It is highly reconnnended that you contact a professional forester to help design your defensible space. Adjustments: If your trees or homesite are susceptible to windthrow and the trees have never been thinned, use a stem spacing of diameter plus five instead of the guides listed in the Zone 3 section. Over time (every 3 to 5 years) gradually remove additional trees. The time between cutting cycles allows trees to "firm up" by expanding their root systems. Continue this periodic thinning until the desired spacing is reached. Also consider leaving small clumps of trees and creating small openings on their lee side (opposite of the predominant wind direction). Again, a professional forester can help you design the best situation for your specific homesite and tree species. Remember, with species such as lodgepole pine and Engelmann spruce, the likelihood of a wildfire running through the tree tops or crowns (crowning) is closely related to the overabundance of fuels on the forest ftoor. Be sure to remove downed logs, branches and excess brush and needle buildup. Maintaining Your Defensible Space Your home is located in a forest that is dynamic, always changing. Trees and shrubs continue to grow, plants die or are damaged, new 'plants begin to grow, and plants drop their leaves and needles. Like other parts of your home, defensible space requires maintenance. Use the following checklist each year to determine if additional work or maintenance is necessary. Defensible Space and Fire Wise Annual Checklist o Trees and shrubs are properly thinned and pruned within the defensible space. Slash from the thinning is disposed of. o Roof and gutters are clear of debris. o Branches overhanging the roof and chimney are removed. o Chimney screens are in place and in good condition. o Grass and weeds are mowed to a low height. o An outdoor water supply is available, complete with a hose and nozzle that can reach all parts of the house. o Fire extinguishers are checked and in working condition. o The driveway is wide enough. The clearance of trees and branches is adequate for fire and emergency equipment. (Check with your local fire department.) o Road signs and your name and house number are posted and easily visible. o There is an easily accessible tool storage area with rakes, hoes, axes ;uid~ stiovels for use in case of fire. o You have practiced family fire drills and your fire evacuation plan. o Your escape routes, meeting points and other details are known and understood by all family members. o Attic, roof, eaves and foundation vents are screened and in good condition.
