The actual number and size ofindividual Iots is not absolutely clear oased on availableinformation. Garfield county has approveo L4 exemptions and denied 2exemptions within approximately a one mire radius of tne site. I Wi1low Lane which abuts the I am submitting this written comment hearing on Karen Groom's request fol am the owner of the Property at 0167 Groom proPertY on the north. My concern is in regard to preservation of irrigation rights and the reasonabl-e use of the same. I am requesting that as a condition of approvaL of the exemption that all iriigation easements be shown on a recorded plat to alert potential buyeis to th9 existence of such easements. There is a fO foot easement for the main branch of the Union Ditch and a fifteen foot easement for a lateral along the easterly and northerly portion of the property. The lateral ditch is the historical and -on1y gravity means of conveying water to the majorily of my 2,27 acrei [o the north. A11 too frequently as development occur! there is inadequate attention paid to the practical "o.,i"qu"nces of irrigation and inadequate provision made for protecting these rights. As a result smaller ditches are obliterated by new strucfures leavi-ng no practical carriage route ror structur"es are built too close [o the ditch creating high groundwater problems for the structure. If new buildings are constucted so close to the ditch as to have a groundwater problem' then the new development should bear the responsibility for any corrective action. I would like to offer the following comments to you regarding fire protection for this property. Access to the existing property and structures is adequete for fire trucks and ambulances. Response tj-me to the property is approximately Fire trucks and ambulance service will respond Fire Station. 12-15 minutes. from the Carbondale Water for fire protection for single family houses on the project will be provided by tanker trucks. The tanker trucks will ref.iIl in Carbondale or at an available 1oca1 ditch. If you have any questions feel free to contact me at 963-2491.
