When reviewing a plan and it's discovered that required information has not been provided by the applicant, this will result in the delay of the permit issuance and in proceeding with building construction. The owner or contractor shall be required to provide this information before the plan review can proceed. Other plans that are in line for review may be given attention before the new information may be reviewed after it has been provided to the Building. Department. A driveway approach is understood to be that portion of the county road right -of way between the pavement edge and the property line that is designed and used for the interchange of traffic between the roadway and abutting property. 2. At any intersection, a driveway shall be restricted for a sufficient distance from the intersection to preserve the normal and safe movement of traffic. (It is recommended for rural residence entrances that a minimum intersection clearance of 50 feet be provided and for rural commercial entrances a minimum of 100 feet be provided.) 3. All entrances and exits shall be so located and constructed that vehicles approaching or using them will be able to obtain adequate sight distance in both directions along the county road in order to maneuver safely and without interfering with county road traffic. 4. The Applicant shall not be permitted to erect any sign or display material, either fixed or movable, on or extending over any portion of the county road right-of-way. 5. Generally, no more than one approach shall be allowed any parcel or property the frontage of which is less than one hundred (100) feet. Adjustment will be made according to the type of traffic to be served and other physical conditions. 9. The construction of parking or servicing areas on the county road right-of-way is specifically prohibited. Commercial establishments for customer vehicles should provide off -the -road parking facilities. 10. The grade of entrance and exit shall slope downward and away from the road surface at the same rate as the normal shoulder slope and for a distance equal to the width of the shoulder but in no case less than twenty (20) feet from the pavement edge. Approach grades are restricted to not more than ten percent (10%). 11. All driveways and approaches shall be so constructed that they shall not interfere with the drainage system of the street or county road. C O M 101 RESOLUTION #34 102 FACTORY BUILT HOUSING 103 104 105 BE IT RESOLVED BY THE STATE HOUSING BOARD OF THE STATE OF 106 COLORADO; 107 108 THAT PURSUANT TO §24-32-3301 et seq C.R.S. as amended, the State Housing Board 109 of the State of Colorado (the "Housing Board") repeals and readopts Resolution #34 Factory 110 Built Housing; and 111 112 THAT PURSUANT TO §24-32-3301 et seq C.R.S. as amended, the Housing Board 113 adopts the nationally recognized code as cited in SCHEDULE "B" as the "Colorado Construction 114 Safety Code for Factory Built Housing", and 115 116 THAT PURSUANT TO §24-32-3301 et seq C.R.S. as amended, the Housing Board 117 states the basis and purpose of these rule changes is to update the current minimum construction 118 and safety code for "Factory Built Housing" manufactured, sold, offered for sale, or occupied. in 119 Colorado; and 120 121 THAT PURSUANT TO §24-32-3301 et seq C.R.S. as amended, the Housing Board 122 establishes standards, to the extent allowed by the state constitution, Article 50 of the "State 123 Personnel System Act", and the rules promulgated by the Personnel Board, for private inspection 124 and certification entities to perform the Colorado Division of Housing's certification and 125 inspection of in-state and out-of-state Factory Built Housing; and 126 127 THAT PURSUANT TO §24-32-3301 et seq C.R.S. as amended, the Housing Board 128 states that "Factory Built Housing" manufacturers shall have the option to contract with the 129 Colorado Division of Housing or an authorized inspection agency to perform inspection and 130 certification functions; and 131 132 The Housing Board states that these rules do not include later amendments to or editions 133 of the nationally recognized code; and 134 135 The Housing Board repeals and readopts these rules and regulations to be administered 136 and enforced by the Colorado Division of Housing (the Division of Housing). 137 1 138 RULES AND REGULATIONS 139 140 Section I: SCOPE 141 142 Every Factory-Built Housing Unit manufactured after the effective date of these 143 regulations that is :manufactured, sold, offered for sale, or occupied in this state must display an 144 insigniaissued-by-the-Division of-Housingcertifying-thatthe unit is construeted in compliance ...: 145 with the standards adopted in schedule "B" which is incorporated herein and made a part of these 146 Rules and Regulations by reference, and all other requirements set forth by this resolution. 147 148 The Housing Board states that the Program Manager, Housing Technology and Standards 149 Section, Colorado Division of Housing, 1313 Sherman Street, Room 321, Denver, Colorado 150 80203, will provide information regarding how the codes adopted in Schedule "B" may be 151 obtained or examined. Homes constructed under Schedule "B" do not include units built to the 152 Federal Manufactured Home Construction and Safety Standards (HUD Standards). Incorporated 153 material may also be examined at any state publications depository library. 154 155 Section 2: DEFINITIONS 156 157 "ADMINISTRATIVE AGENCY" is the Colorado Division of Housing. The Division of 158 Housing is the state agency responsible for enforcing the Factory-Built Housing Construction 159 Statutes, Rules, and Regulations. 160 161 "ALTERNATIVE CONSTRUCTION (AC)" is specific additional construction and/or 162 modification of the factory-built structure that directly affects the life, health, safety, and/or 163 habitability of the structure and is not covered by the factory-built or installation certification 164 insignias and requires building permit(s) and inspection(s) to verify code compliance. 165 166 "AUTHORIZED INSPECTION AGENCY" means the Division of Housing or any state agency, 167 firm, corporation or entity approved by the Division of Housing to conduct production 168 inspections, to evaluate the manufacturer's quality control procedures, approve manufacturer's 169 engineering manuals, approve factory built model construction plans, and/or factory-built 170 installation instructions. Authorized Inspection Agencies will be "Registered" based on 171 qualifications and "Certified" based on qualifications and performance. 172 173 "CONSTRUCTION, CLOSED" means any building, building component, assembly, or system 174 manufactured in such a manner that all concealed parts or processes of manufacture cannot be 175 inspected before installation at the building site without disassembly, damage, or destruction. 176 177 "CONSTRUCTION, OPEN" means any building, building component, assembly, or system 178 manufactured in such a manner that all concealed parts or processes of manufacture can be 2 179 readily inspected at the building site without disassembly, damage, or destruction. Local 180 jurisdictions have the approval authority for Open Construction. 181 182 "FACTORY -BUILT HOUSING" is a unit or component built in compliance to the applicable of 183 codes listed in Schedule "B". These units are designed primarily for residential occupancy, 184 either permanent or temporary (as determined by the local building department), which is wholly 185 or in substantial part, made, fabricated, formed or assembled as Closed Construction in a 186 manufacturing facility for installation, or assembly and installation, on permanent or temporary 187 foundations at the building site. 188 189 "INSIGNIA" means a seal, label or tag issued by the Division of Housing to indicate compliance 190 in the manufacture of a unit with the regulations established by the Housing Board when affixed 191 to a Unit in conformance with this Resolution. 192 193 "INTERIM CHANGE" is a change made between the approval date and the expiration date. 194 195 "MANUFACTURER" means any person who constructs or assembles a manufactured 196 residential or nonresidential structure in a factory or other off-site location. Manufacturers will 197 be "Registered" based on the qualifications of quality control and "Certified" based on the 198 performance of quality control. 199 200 "MODEL" is a specific design of factory -built units designed by the manufacturer, which is 201 based on size, floor plan, method of construction, location arrangement and sizing of plumbing, 202 mechanical or electrical equipment and systems therein in accordance with plans submitted to 203 the Division of Housing. 204 205 "OCCUPIED" means a factory -built structure designed, built, modified, and/or used with the 206 intent for individuals to enter. 207 208 "PRODUCTION INSPECTION" means the evaluation of the ability of the manufacturing 209 facility to follow approved plans, standards, codes and quality control procedures during 210 continuing production. 211 212 "PROHIBITED SALE NOTICE" means a printed notification issued by the Division of Housing 213 for a structure providing that the unit may not be sold or offered for sale because of 214 nonconformance(s) with §24 -32 -Part 33 C.R.S., as amended and these regulations. 215 216 "QUALITY CONTROL PROCEDURES" means procedures prepared by a manufacturer for 217 each of its manufacturing facilities and approved by the Division of Housing or Authorized 218 Inspection Agency describing the method that the manufacturer uses to assure units produced by 3 219 that manufacturer are in conformance with the applicable standards, codes, quality control 220 procedures and approved plans. 221 222 "A RED TAG NOTICE" is a physical identification that a particular unit has a life threatening 223 violation as set forth in §24-32-3302 (14). Units with life threatening deviations shall not be sold 224 or offered for sale in Colorado. 225 226 "UNIT" means a factory -built house that shall comply with these rules and regulations 227. 228 Section 3: PROGRAM PARTICIPANTS 229 230 Other States 231 232 This program is open on a voluntary basis to all states with statutory authority to regulate 233 the design and construction of Factory Built Housing covered by this Division of 234 Housing Resolution. 235 236 Each state that wishes to participate in this program recognizes that they must enter into a 237 memorandum of understanding with Colorado to establish mutual recognition and 238 acceptance of codes and inspections. Areas of agreement include: 239 240 Acceptance of construction codes that are adopted by the State of Colorado 241 Housing Board for Factory Built Housing units sold into or offered for sale 242 in Colorado. (See Schedule "B" in this Resolution). 243 244 , Acceptance of the design evaluation and approval performed by the Division of 245 Housing or an authorized Inspection Agency for units sold into or offered 246 for sale in Colorado. 247 248 Performance of plant certifications and other inspection requirements. Routine 249 inspections include performing inspections of at least one (1) unit in each 250 phase of manufacturing and performing a minimum of a rough, final and 251 other inspections and/or tests (as required in Schedule "B") when a 252 production line process is not being utilized. Also to place the manufacturer 253 on a higher frequency of inspection when it is unable to conform, on a 254 continuing basis, to approved quality control procedures and or approved 255 plans and standards. 256 257 , Evaluation, at the manufacturing facility, of code compliance problems resulting 258 from consumer complaints on labeled Colorado units; work with the 259 manufacturer(s) in resolving such complaints by adequately following-up 4 260 and assisting them in correcting the complaint issue(s), and their production 261 and/or inspection process. 262 263 Provide sixty (60) days notice before withdrawing from participation in the 264 program, thereby allowing a :manufacturer sufficient time to obtain a new 265 Authorized Inspection Agency. 266 267 PARTICIPATING STATES OPERATING UNDER AN EXISTING STATE FACTORY 268 BUILT HOUSING LAW HAVE THE OPTION TO ACT AS THE AUTHORIZED 269 INSPECTION AGENCY WITHIN THEIR STATE. They are not required to change any of 270 their state fees, laws, or regulations other than those changes, which may be necessary to 271 allow them to agree to the above items. Manufacturers are required to be inspected by 272 their host state when this state agrees to perform inspections on Colorado units. 273 274 275 Independent Authorized Inspection Agencies 276 277 This program is open on a voluntary basis to all Division approved independent 278 Authorized Inspection Agencies with the capabilities to regulate the design and in -plant 279 construction of Factory Built Housing covered by this Division of Housing Resolution. 280 281 Each independent Authorized Inspection Agency that wishes to participate in this 282 program recognizes that they must be approved by the Division and establish mutual 283 recognition and acceptance of codes and inspections. Areas of agreement include: 284 285 Acceptance of construction codes that are adopted by the State of Colorado 286 Housing Board for Factory Built Housing units sold into or offered for sale 287 in Colorado. (See Schedule "13" in this Resolution). 288 289 Acceptance of the design evaluation and approval performed by the Division of 290 Housing or an authorized inspection agency for units sold into or offered for 291 sale in Colorado. 292 293 . Acceptance and use of the Division of Housing "Performance Criteria for 294 Monitoring the In -Plant Quality Control Systems of Factory Built Plants" 295 for in -plant inspection agencies. 296 297 . Acceptance and use of the Division of Housing "Performance Criteria for 298 Factory Built Plan Review and Approval" standards for plan review 299 agencies. 300 5 301 Performance of in-plant certifications and other in-plant inspection requirements. 302 Routine inspections include performing inspections of at least one (1) unit 303 in each phase of manufacturing and performing a minimum of a rough, final 304 and other inspections and/or tests (as required in Schedule "B") when a 305 production line process is not being utilized. Also to place the manufacturer 306 on a higher frequency of inspection when it is unable to conform, on a 307 continuing basis, to approved quality control procedures and or approved 308 plans and standards. 309 310 Evaluation, at the manufacturing facility, of code compliance problems resulting 311 from consumer complaints on labeled Colorado units; work with the 312 manufacturer(s) in resolving such complaints by adequately following-up 313 and assisting them in correcting the complaint issue(s) and their production 314 and/or inspection process. 315 316 Provide sixty (60) days notice before withdrawing from participation in the 317 program, thereby allowing a manufacturer sufficient time to obtain a new 318 Authorized Inspection Agency. 319 320 APPROVED PARTICIPATING INDEPENDENT INSPECTION AGENCIES 321 OPERATING UNDER AN EXISTING CONTRACT WITHA MANUFACTURER OR 322 LOCAL JURISDICTION WILL ACT AS THE SOLE AUTHORIZED INSPECTION 323 AGENCY FOR THAT PLANT AND/OR LOCAL JURISDICTION. They are not required 324 to change any of their company policies other than those changes, which may be 325 necessary to allow them to agree to the above items. Manufacturers are required to be 326 inspected by their contracted independent Plan Review and/or In-Plant Authorized 327 Inspection Agency when approved by the Division. 328 329 330 Manufacturers 331 332 Any manufacturer of Factory Built Housing products that are sold into, offered for sale, 333 and/or occupied in Colorado shall participate in this program and agree to comply with 334 the following: 335 336 All manufacturing facilities may have only one Authorized Inspection Agency for 337 plan review and one Authorized Inspection Agency for inspections that is not the 338 Division of Housing 339 340 All in-state manufacturers shall have the option to contract with an Authorized 341 Inspection Agency or continue to use the Division of Housing as the 6 342 Authorized Inspection Agency to perform certifications, in-plant production 343 inspections, to evaluate their plant's quality control procedures, approve 344 manufacturer engineering manuals, approve plant construction plans, and/or 345 installation instructions. 346 347 Out of state manufacturers are required to obtain the services of an Authorized 348 Inspection Agency to perforin certifications, in-plant production 349 inspections, to evaluate the plant's quality control procedures, and may use 350 the Authorized Inspection Agency to approve manufacturer engineering 351 manuals, approve plant construction plans, and/or installation instructions. 352 353 , Out of state manufacturers located in states that have reciprocity or other 354 agreements with the Division of Housing shall be notified if the state in 355 which they are located will continue to inspect Colorado units or if they 356 have to obtain the services of a firm or corporation to perform certification 357 and in plant production inspections of Colorado units. 358 359 , After notification that the state in which they are located will no longer inspect 360 Colorado units, manufacturers have (60) days to obtain another Authorized 361 Inspection Agency. 362 363 , Out of state manufacturers without existing plant certifications and located in 364 states that enter into an agreement with Colorado to inspect Colorado units, 365 shall use that state as the Authorized Inspection Agency to perform 366 certifications, in-plant production inspections and evaluations of their 367 quality control procedures. 368 369 , All manufacturers shall obtain prior approval from the Division of Housing or 370 Authorized Inspection Agency for all quality control manuals, plans, and 371 installation instructions before manufacturing and affixing the Colorado 372 and Authorized Inspection Agency label(s) to units constructed under those 373 approvals. 374 375 , All manufacturers shall allow and pay for the reasonable costs incurred by the 376 Division of Housing for work related to retaining and evaluating their 377 performance and registration/certification status. 378 379 All manufacturers shall allow and pay for oversight inspections as required by the 380 Division of Housing or Authorized Inspection Agency to assure compliance 381 to the approved designs. 382 7 383 All manufacturers shall permit Division of Housing or Authorized Inspection 384 Agency monitoring personnel to review plans and to perform in-plant 385 inspections. 386 387 All manufacturers shall correct any code violations in plans discovered by the 388 Division of Housing or by the Authorized Inspection Agency monitoring 389 personnel, or forfeit the right to have Division of Housing and Authorized 390 Inspection Agency labels affixed. 391 392 All manufacturers shall correct any construction code violations within 20-days, 393 or forfeit the right to have Division of Housing labels affixed. 394 395 All manufacturers must provide the Division of Housing with a monthly 396 inspection report showing the Authorized Inspection Agency and the 397 . Division of Housing label number(s), unit serial number(s), and the first 398 destination of shipped Units. 399 400 All manufacturers shall submit a fully completed and legible oversight 401 inspection data sheet to the Division prior to shipment of the home from the 402 factory. 403 404 Manufacturer Registration, Certification, and Performance Requirements 405 406 Manufacturers of Factory Built Housing which are manufactured, sold into, offered for 407 sale, and/or occupied in the State of Colorado must register with the Division of Housing. 408 Registrations are for a specific plant location, and are not transferable to any other 409 locations including those of the same manufacturer. 410 411 Where there is a change in ownership, address, or location of manufacture, the 412 manufacturer having Division of Housing certification shall notify the Division of 413 Housing within ten (10) working days of such a change. At such time the Division of 414 Housing shall review the performance of the manufacturer and transfer or revoke the 415 certification. 416 417 Plant certification is granted to a manufacturer's registered plant, based on adequate plant 418 production performance, for a specific location, and is not transferable to other locations. 419 Plant certification is a certification of the plant Quality Control QC) program and the 420 quality control personnel that ensures construction code compliance. The Division shall 421 be immediately notified of any changes to the QC program and/or personnel. 422 8 423 The manufacturer's quality control department shall do "no cover" inspections for all 424 phases of construction on all units and witness all required tests, regardless of plant 425 status. 426 427 At the time of plan submittal all manufacturers are required to have Division of Housing 428 approval, in writing, of the state, firm, corporation or entity that will conduct the 429 certification and in -plant inspections of Colorado units. Additionally, manufacturers are 430 also required to request approval of the Division of Housing thirty (30) days prior to any 431 subsequent change of their Authorized Inspection Agency. 432 433 Upon Division of Housing approval of the Authorized Inspection Agency for production 434 inspections, approved copies of the plans and quality assurance manual shall be sent to 435 the manufacturer. Upon the manufacturer's receipt of the approved plans and manual, the 436 Authorized Inspection Agency shall schedule plant production oversight inspections. 437 438 Registered plants shall be inspected for certification approval on an ongoing basis. Upon 439 completion of certification inspections, a letter recommending plant certification and a 440 copy of the certification inspection report shall be faxed by the Authorized Inspection 441 Agency to the Division of Housing with a copy to the manufacturer. Upon receipt of this 442 report, the Division of Housing will review it for completeness and accuracy. The 443 manufacturer can then ship the certification unit(s) to Colorado for field inspection by the 444 Division of Housing. After field inspection, the Division of Housing will notify the 445 manufacturer if the unit has passed inspection and if the plant is certified or not certified. 446 447 Manufacturers are required to construct, on a continuing basis, factory built housing in 448 conformance with plans, quality control manual, codes, standards, and procedures 449 prepared by them and approved by the Division of Housing or Authorized Inspection 450 Agency. The certification of a plant is considered to be ongoing unless conditions 451 warrant immediate removal of the certification. Conditions for removal of certification 452 are: 453 454 . The change of an Authorized Inspection Agency or change in Authorized 455 Inspection Agency status. 456 457 . The change of a plant location. 458 459 . Where a plant has had Division of Housing and/or Authorized Inspection Agency 460 labels removed by the Authorized Inspection Agency pursuant to the 461 Division of Housing procedures. 462 463 .
