The following items were found that conflict with the agreement that we had with the new owner back in October 2011for the use of the building: • Rooms that were designated not to be used are being used for storage, nursery and have furniture in them for other uses. • Two rooms on the second floor are being used as sleeping quarters- no use of second floor was to be allowed • Fire alarm system is disconnected, not being maintained and is in alarm and trouble. • Doors to upstairs and other areas not to be used are not labeled or secured from use • Removal of combustibles has not happened in unoccupied areas. There is also construction debris piled under the second story stairs and against the south side of the building In addition, there are numerous open wiring, holes in drywall, fire extinguisher not serviced since 2009, and exit and emergency lights not working. Although not a fire code, the concrete cap for access to the septic tank was off and open.(we put it back on). After a long conversation with Pastor Machado and the use of a fire district interpreter we agreed on the following: • Pastor Machado committed to have all items corrected by 10/10/12. • A fire prevention safety talk for all users will take place this Sunday at 16:00. It appears that we will be able to have a fire district interpreter present. • Since this building is infrequently used (unoccupied) a fire watch has not been instituted at this time. Since the county issues C of 0 and my understanding is that they have a building permit that is up for renewal, it is important that you weigh in on this property. Now we know what we have, and we can come up with a plan that will work for all parties. It appears, the scope of work involved with a building permit to also change the occupancy to a A-3 church is to improve the egress for the building and to provide accessible access and bathrooms as outlined with your submittal. From speaking with Mr. Machado, I believe he only wants to address the use of the building as a church with some incidental other uses. As your plan shows, the balance of the building would be in a non used or non occupied manner. I believe the building department could issue a building permit and C.O. once the scope of work was completed based on limiting the buildings use as described above. It does not appear a fire sprinkler system would be required as per section 903.2.1.3. A manual fire alarm system as per 907.2.1 and 907.5 would be required. Please check with the local fire district to verify these conditions. The fire district will also need a set of plans to review other provisions of the fire code. 1 would anticipate a set of conditions to the building permit as follows: • Maintain egress throughout the entire building. • Limit use of the building to church sitting area, library, bathrooms, lobby, vending, 2 offices and conference room shown on plans. • Secure all rooms and areas not occupied from use. Rope off stairs to upper floors. • Permit is only for A-3 occupancies and incidental offices and storage. A new permit would be required to increase the use or change the use of the building. • Verify existing exit signs locations and operation as per Sec. 1011. • Possible other conditions once we have a permit to review. We did some research on the septic system and it appears the system is adequate for the above uses. A formal building permit submittal would be the next step for your client to follow. As proposed, only 7,734 sq ft of the building will be used out of the total square footage of 18,136 sq ft. The following are my comments: 1. A fire sprinkler system is required for this building per IFC 903.2.1.3 and the IFC Garfield County amendment to 903.2- Table A. This requirement is waived in agreement with the current owner, Guillermo Machado, Garfield County Building Official , Andy Schwaller and your office until such time as the building reaches an occupant load of 300 or any of the unused/unoccupied spaces proposed are put into use. 2. The existing fire alarm system needs to be serviced ,maintained and monitored per NFPA 72. 3. The rooms and spaces(entire upper floor) that are designated not to be used/occupied needs to be: a. Properly separated from the used and occupied portion of the building per the building official b. Safeguarded and maintained in accordance to section 311 of the IFC -Vacant Premises. This includes: i. Securing all interior and exterior doors ii. Maintaining the fire alarm system in an operable condition iii. Maintaining all fire separations iv. Removal of all combustibles v. Removal of any hazardous materials 4. Verify that the kitchen facilities is one of the rooms designated as "Room Not Used" . 5. This occupancy was last inspected by the fire district on 9/13/10 and had some outstanding items that needed to be corrected. We request to tie this annual inspection with an inspection verifying the above items. 6. Since this is an unique situation, I would request the following: a. A CD of the floor plan showing what will be occupied and unoccupied so that these can be verified on the fire district's annual inspections of this building b. A signed written agreement from the owner acknowledging his responsibilities to not occupy or use the areas designated not to be used c. Put signs on each door to the areas that are not to be used "NO Use or Storage" in addition to the security in 3bi above. Kevin C.
