In accordance with the Garfield County Unified Land Use Resolution of 2008, as amended, the Director of the Building and Planning Department hereby authorizes, by Administrative Review, the following activity: Special Use Permit Amendment to amend Resolution 2009-41 to replace fourteen (14) 500 bbl existing frac tanks with five (5) 1,000 bbl closed top upright tanks with vapor recovery and SCADA including a provision to install three (3) additional 1,000 bbl closed top upright tanks in the f rture on well pad SKR-598-35-BV and property owned by Chevron USA Inc. (Parcel Numbers 2137-321-00-008 and 2139-163-00-014). All proposed tanks shall be located within a surface mounted containment area and all 24 existing frac tanks and secondary containment berm shall be removed with the development of the proposed tanks and secondary containment. This Land Use Change Permit (Amendment to a Special Use Permit) is issued as a non - substantial modification to Resolution 2009-41 and shall be valid only during compliance with such conditions and other applicable provisions of the Garfield County Unified Land Use Resolution of 2008, as amended, Building Code, and other regulations of the Board of County Commissioners of Garfield County, Colorado. The Board of County Commissioners of Garfield County, Colorado. received an application for an amendment to a Special Use Permit, revising Condition 18 of Resolution 2009-41. B. The temporary producedwater management facility is located on well pad SKR 598 -35 -BV and approximately 18 miles northwest of the Town of DeBeque, CO. The facility is accessed from a private road off of County Road 211 and within property owned by Chevron USA Inc. E. The Board is authorized to approve, deny or approve with conditions an amendment to a Special Use Permit pursuant to Sections 1-301 and 4-107 of the Garfield County Unified Land Use Resolution of 2008, as amended. F. The Board of County Commissioners opened the public hearing on the 20th day of June, 2011 upon the question of whether the Special Use Permit. Amendment application, SUAA 6786, for the amendment of Condition 18 of Resolution 2009-41, should be granted or denied, during which hearing the public and interested persons were given the opportunity to express their opinions regarding the application. G. The Board of County Commissioners closed the public hearing on the 20th day of June, 2011 to make a final decision. H. The Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determinations of fact: 1. That proper posting and public notice was provided as required forthehearing before the Board of County Commissioners. 2. The public hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearing. 3. For the above stated and .other reasons, the Special Use Permit Amendment to revise Condition 18 of Resolution 2009-41 is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. The application has met the requirements for Amendment to Approved Land Use Change Permit (Sections 4-107 and 4-501) of the Garfield County Unified Land Use Resolution of 2008, as amended. The proposed Land Use Change Permit for a time extension is consistent with the applicable provisions of the Garfield County Comprehensive Plan of 2030.
