The tanks being structures cannot be in any setbacks or on property lines. The storage area itself is also a concrete containment structure which also cannot be built on property lines. Please note any fences along Scarrow Avenue cannot be over 3 foot in height unless the fence is outside the 25ft. either front or through lot setback along Scarrow Avenue. This problem has become evident in reviewing the fence building permit submitted last week. They have also submitted for a fence permit on Nov 2511'. Still pending is an amended plat to combine the separate 4 lots into a single lot to accommodate the proposed use of the building and outside storage. They should submit any information directly to the fire district as it relates to the fire code. Prior to moving into the building, the fire district will need to do an inspection and the county will need to do a final inspection after the fire district's inspection. The site is within the Travelers Highlands development and consists of a number of platted lots. The proposal is to allow a fence along a front property line to exceed the maximum three feet in height when within the front yard setback. The existing fence does not meet the standards for °Accessory Structures in Required Yards" in Section 3-301 J of the Unified Land Use Resolution (ULUR) which limits fences to three feet in height. The applicant is considering applying for a variance to allow the fence to remain. Other options include reducing the height of the fence to meet the requirements of the ULUR or moving the fence out of the front yard area to the building setback line of 25 feet. Article 4, Division 3, Review Procedures for Variances. Section 4- 301 (B) Standards for Approval of Variance Requests of the ULUR lists the standards that must be met to approve a variance by the Board of Adjustment. The applicant's narrative should address how the requested variance meets the standards. Submittal requirements include the necessary public notice documents for public notice discussed in Section 4-103 (assessors map and list of property owners within 200 feet), application form(s), written statement, Site Plan, and specific details of the proposed sign.
