HomeMy WebLinkAbout2.0 Colorado Dept. of Public Health & EnvironmentCOLORADO Department of Public Health b Environment Dedicated to protecting and improving the health and environment of the people of Colorado Electronic Document June 30, 2015 Mr. Doug Brown Greenback Produced Water Recovery LLC 1301 Academy Court Fort Collins, CO 80524 Re: Variance Request for Temporary Suspension of Operations - Approved Shaeffer Ranch Facility in Garfield County SW / GAR WES / 2.5 Dear Mr. Brown: The Solid Waste and Materials Management Program of the Hazardous Materials and Waste Management Division of the Colorado Department of Public Health and Environment (Division) received and reviewed the following reports/plans: • Variance Request for Temporary Suspension of Operations; Shaeffer Ranch Facility. The letter request was submitted by owner/operator GreenBack Produced Water Recovery, LLC (GreenBack) dated June 23, 2015 The Shaeffer Ranch facility temporarily suspended operations in early 2014 due to the poor economy in the exploration and production industry in the Piceance Basin. The Variance request dated January 23, 2014 was approved by the Division on February 27, 2014 allowing temporary shutdown status and therefore delay of initiation of closure activities until June 30, 2014. On July 2, 2014 the Division approved a 1 year extension to the temporary shutdown status. GreenBack is requesting one additional year for the Variance from initiating closure activities (through June 30, 2016). The Variance is from requirements in the approved Engineering Design and Operations Nan (2010) and Sections 2.5.9 and 17.5.1 (A) of the Regulations regarding commencement of closure activities (decommissioning type activities). The document was reviewed to determine compliance with the requirements set forth in the Solid Wastes Disposal Sites and Facilities Act, Title 30, Article 20, Part 1 of the Colorado Revised Statutes, as amended (Act), with the regulations promulgated there under 6 CCR 1007-2 (Regulations) and with the approved Dao Plan and subsequent revisions. The Division approves the extended Variance request with the following conditions. 1. The site maintenance, monitoring and financial assurance activities and submittals identified in the January 23, 2014 correspondence from GreenBack shall continue during the temporary suspension of operation. 2. Any quarterly or annual reporting activities identified in the approved Engineering Design and Operations Nan (2010) must continue even if there is no waste accepted or the wet/dry wells remain dry. This will circumvent the Division from issuing non-compliance notices for lack of reporting. In closing, the Division is authorized to bill for the review of technical submittals pursuant to C.R.S. 30-20- 109 (2) (b) at the rate of $125 per hour.
