at the top of Red Mountain. Please be advised that the Building Permit cannot be issued until all of the
conditions of approval contained in Garfield County zoning resolution 2004-43 have been met and a Special
Use Permit has been issued. Specifically, the following items of information are required, as numbered on

MINIMUM APPLICATION REQUIREMENTS
FOR
CONSTRUCTION OF
COMMERCIAL OR MULTI -FAMILY RESIDENTIAL BUILDINGS
including
NEW CONSTRUCTION
ADDITIONS
ALTERATIONS
and
MOVED BUILDINGS
In order to understand the scope of the work intended under a permit application and expedite
the issuance of a permit it is important that complete information be provided. Adequate and
complete information will prevent delays in the plan review process. Reviewing a plan and the
discovery that required information has not been provided by the applicant may result in the
delay of the permit issuance and in proceeding with building construction. The owner or
contractor may be required to provide this information before the plan review may proceed. This
causes delays because other plans that are in line for review may be given attention before the
new information may be reviewed after it has been provided to the Building Department.
Please review this document to determine if you have enough information to design your
project and provide adequate information to facilitate a plan review. If you do not, it may
be helpful to obtain a book titled "Dwelling Construction Under the Uniform Building
Code". This book is available to you through this department at our cost. Also, please
consider using a design professional for assistance in your design and a construction
professional for construction of your project.
To provide for a more understandable plan in order to determine compliance with the building,
plumbing and mechanical codes, applicants are requested to review the following checklist prior
to and during design.

Plans to be included for a Building Permit must be on draft paper at least 18"x 24"" and
drawn to scale.
Plans must include a floor plan, a concrete footing and foundation plan, elevations all sides with
decks, balcony steps, hand rails and guard rails, windows and doors, including the finish grade
line. A section showing in detail, from the bottom of the footing to the top of the roof, including
re -bar, anchor bolts, pressure treated plates, floor joists, wall studs and spacing, insulation,
sheeting, house -rap, (which is required), siding or any approved building material.
A window schedule. A door schedule.
A floor framing plan, a roofing framing plan, roof must be designed to withstand a 40 pound per
square foot. up to 7,000 feet in elevation, an 80 M.P.H. windshear, wind exposure B, windload
of 15 pounds per square foot and a 36 inch frost depth.
All sheets to be identified by number and indexed. All of the above requirements must be met or
your plans will be returned.
All plans submitted must be incompliance with the 1997 UBC, UMC and 1997 UPC.
Applicants are required to indicate appropriately and to submit completed checklist at
time of application for a permit:
Is a site plan included that identifies the location of the proposed structure, additions or
other buildings, setback easements, and utility easements showing distances to the
property lines from each corner of the proposed structure prepared by a licensed surveyor
and has the surveyors signature and professional stamp on the drawing? Slopes of 30%
or more on properties must be show on site plan. NOTE: 106.3.1 (7.) Any site plan for
the placement of any portion of a structure within 50 ft, of a property line and not within
a previously surveyed building envelope on a subdivision final plat shall be prepared by a
licensed surveyor and have the surveyors signature and professional stamp on the
drawing. Any structure to be built within a building envelope of a lot shown on a
recorded subdivision plat, shall include a copy of the building envelope as it is shown on
the final plat with the proposed structure located within the envelope.

A RESOLUTION CONCERNED WITH THE APPROVAL OF A. SPECIAL USE
PERMIT FORA COMMUNICATIONS FACILITY ON A PROPERTY OWNED BY
MOUNTAIN STATES COMMUNICATION, INC

WHEREAS, the Board of County Commissioners of Garfield County, Colorado,
received a Special Use Permit (SUP) request for a "Communications Facility" submitted
by Mountain States Communication, Inc. to erect a communications tower for KMTS in
order to comply with the Federal Communications Commission (FCC) regulations on
Red Mountain; and
WHEREAS, the subject property contains approximately 40 acres, is located on
Red Mountain above the City of Glenwood Springs in the A/R/RD zone district and in
Study Area I of the Comprehensive Plan of 2000, and is legally described as NE 'k of the
SE ' of sec'aon 17, Township 6 South, Range 89 West of the 6th P.M.; and
WHEREAS, the Board of County Commissioners opened a public hearing on the
3te day . of May, 2004 and continued the public hearing to May 10th, 2004 upon the
question of whether the above-described SUP for a Communications Facility should be
granted or denied, during which bearing the public and interested persons were given the
opportunity to express their opinions regarding the issuance of said SUP; and

WHEREAS, the Board of County Commissioners closed the public hearing on the
10± day of May, 2004 tc make a final decision; and
WHEREAS, the Board of County Commissioners on the basis of substantial
competent evidence produced at the aforementioned hearing, has made the following
determination of facts:
1. That proper publication, public notice, and posting was provided as required by law
for the hearings before the Board of County Commissioners.
2. That the public hearing before Board of County Commissioners was extensive and
complete; all pertinent farts, matters and issues were submitted; and that all interested
parties were heard at those hearings.
3. The proposed subdivision of land conforms to Sections 2.02.155, 3.02.03, 5.03, arid
5.03.13 of the Garfield County Zoning Resolution of 1978, as amended.
4. The proposed use is in the best interest of the health, safety, morals, convenience,
order, prosperity and welfare of the citizens of Garfield County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Garfield County, Colorado, that based on determination of facts set
forth above, the SUP request for a "Communications Facility" is approved to erect an 80'
tall tower with the following conditions:
1. That all representations made by the Applicant in the application and as testimony
in the public hearing before the Board of County Commissioners shall be
conditions of approval, unless specifically altered by the Board of County
Commissioners.
2. That the Applicant shall construct a tower no taller than 80 feet as measured from
natural grade that will allow for an antenna to transmit from KMTS. The base
location of the tower shall be at least 70 linear feet directly to the west of the
existing 41' tower. The area around the base of the tower on the ground shall be
fenced in order to preclude the general public from coming within 70 feet of the
tower in all directions.
3. As represented by Mountain States Communications, Inc during the public
hearing, the Applicant shall be required to honor their commitment to remove the
pole portion of the existing 41' KMTS tower so that the overall height is reduced
to comply with the 25' height restriction in the AIR/RD zone district.
4. The Applicant shall continuously remain in compliance with the requirements of
the Federal Aviation Administration (FAA), as stated in the "Determination of No
Hazard to Air Navigation" including:

of land located in the NE 1/4 of the SE 1 of Section 17, Township 6 South, Range
89 West of the 6th Principle Meridian, the deed to which is recorded in book 478,
page 340, hereafter referred to as the "Property".
Mountain States Communications, Incorporated hereby gives Its full and
complete permission to Colorado West Broadcasting, Incorporated to apply for a
Special Use Permit to upgrade the current communication tower on the Property,
and to build that tower.
