Box 8 Rifle, CO 81650 nbell @ bellconsultinqllc.com Reference: Shaffer Land Use Permit - The Lariat Garfield County File Number GAPA-8314 Dear Nathan; Garfield County had reviewed the above referenced application for technical completeness and provided a letter dated May 22, 2015, regarding deficiencies pursuant to the submittal requirements of the 2013 Land Use and Development Code, amended (LUDC). The letter also referenced Section 4-101 B.(2.)(a.) which requires that the applicant correct the application deficiencies within 60 calendar days or the application shall be considered to be withdrawn. The deadline for technical completeness was July 22,2015 Based your email dated July 22, 2015, you were going to re-evaluate and possible come back in the future. Based upon this and the fact that technical completeness has not been achieved within the required 60 days, the County deems your application withdrawn. Box 8 Rifle, CO 81650 nbell@ bellconsultinollc.com Reference: Shaffer Land Use Permit - The Lariat Garfield County File Number GAPA-8314 Dear Nathan; Garfield County is in receipt of land use application for a community meeting facility, submitted on May 18,2015. We have reviewed the documentation for compliance with the submittal requirements contained in the 2013 Land Use and Development Code, amended (LUDC). Our review has determined that the following required information has not been provided as required by the LUDC and as itemized in Section V. of the pre-application conference summary form : 1. There are severed mineral owners of the subject site which require notification. The application provided a mineral deed as well as documentation that the mineral owners contained in the deed are deceased. The applicant is required to research the heirs of the deceased individuals and provide names and mailing addresses for current severed mineral owners. Please see attached information regarding mineral owner research. Minimal research in the Clerk's records identified an order of intestacy that found heirs (Reception No. 267540). Several of those heirs are now deceased and several deeds of distribution were found to present mineral owners (Reception number 702167 and 674375). Additional research is necessary to provide current information on the mineral owners of the site. 2. The application does contain a list of the names and mailing addresses of adjacent properties however the attached map does not indicate the parcels that are within 200' of the subject site. 3. The list of names and mailing addresses contains a typographical error in the street address for Hoyos, which should be 1605. 4. A copy of the pre-application conference summary form is a submittal requirement. Please provide a copy of that documentation in the application. 5. Analysis and response to compliance with the minimum standards of the LUDC (Article 7) was not provided. Please respond to the standards in Divisions 1,2, and 3 and provide supporting documentation, prepared by qualified professionals. lf certain standards are not applicable please provide sufficient detail at to why the standard is not applicable to the proposal. 6, The responses to the lmpact Analysis require additional detail and supporting documentation. For example: a. The application states that the noise standards will be met - how will this be managed? Through hours of operation? Will music be played at these events and, if so, will there be restrictions or limitation on hours? b. A statement is made that no geologic hazards exist that will impact development. Please provide documentation to support this statement. County hazard maps indicate moderate slope hazard and a high water table on the site. What mitigation or avoidance has been utilized for these areas? 7. The Water Supply and Distribution Plan states that the site will be used for 57 days annually therefore it does not meet the 60 day annual threshold for CDPHE review and permitting. How will you assure that the site will not exceed the 60 days annually? Further, the water must meet the minimum standards of the Safe Water Drinking Act - it is not enough to say that renters will bring their own water as that does not prevent the water from being consumed. There was information related to the necessity of a Reverse Osmosis (RO) system, is this proposed to be included? 8. Legal access to the site has not been sufficiently demonstrated as the parcel does not abut the county road. Please provide easement information from Bryce Valley Holdings adequate to demonstrate legal access to the site from CR 296. 9. The application does not appear to discuss signage of the facility. Are any signs planned and, if so, where would they be located? 10.A weed management plan and inventory is required pursuant to Section 4-203 E The LUDC, Section 4-101 B.(2.)(a.) requires that the applicant must correct the application deficiencies within 60 calendar days or the application shall be considered to be withdrawn.
