PROJECT INFORMATION AND STAFF COMMENTS
REQUEST: An amendment to the Plat of Cooperton
Townsite, Block 11.
APPLICANT: Charles Moore & Compass (Carbondale
Community School)
LOCATION: Lots 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, and 16
of Block 9; Lots 17,18,19, 20, 21, 22, 23, 24,
and 25 of Block 10; Lots 17, 18, 19, 20, 21,
22, 23, 24, 25, 26, 27, 28, 29 and 30 of Block
11; All within the Townsite of Copperton.
Located in a portion of Section 28, T7S,
R88W.
SITE DATA:
Currently fourteen (14) lots: 25' x 162.50';
one (1) lot 10' x 162.50'; one (1) lot 50' x
162.50' more/or less in size.
WATER: Sutank Water Association
SEWER: ISDS
ACCESS: Sopris Avenue or Cedar Street
EXISTING/ADJACENT ZONING: R/L/UD
I. RELATIONSHIP TO THE COMPREHENSIVE PLAN
The site for the amended lots is designated by the Garfield County Comprehensive Plan of
2001, Proposed Land Use Districts Map as high density residential (less than 2 acres per
dwelling unit). The amendment request appears to be consistent with the proposed
designations.
II. DESCRIPTION OF THE PROPOSAL
A. Site Description: The site is located within the Townsite of Cooperton, Block number
11, and is accessed off of Sopris Avenue or Cedar Street.

B. Project Description: Block 11 is currently platted as sixteen (16) individual lots. The
request is to amend the plat for lot numbers 16-20 to be redrawn as one (1) parcel. Lot
numbers 21-25 are to be redrawn as one (1) parcel and lot numbers 26-30 & lot A, are
also to be redrawn as one (1) parcel. The new lots will be approximately 28,437.5 square
feet, 20,312.5 square feet, and 17,875 square feet in size more or less.
III. MAJOR ISSUES AND CONCERNS
A. Subdivision Regulations. Section 6:10 of the Garfield County Subdivision
Regulations establishs the criteria for an amended plat. An amendment can be made
to a recorded plat, if such amendment does not increase the number of subdivision
lots or dwelling units, result in a major relocation of a road or add new roads. The
BOCC shall consider the amended plat request at this meeting. The applicant will be
responsible for mailing the notices and shall present proof of mailing at the meeting.
B. Zoning: The proposal meets the criteria of a minimum lot area of seven thousand
five thousand (7,500) square feet lot size as required by the R/L/UD zone district.
All of the proposed lots meet the minimum lot size criteria.
C. Legal Access: Access will be provided off of Sopris Avenue.
D. Water: The Sutank Water Association states that their records show there are three
(3) water tap shares purchased for this area. They also stated that these taps are for
single-family units only. No multi -family units are allowed. (see attached page
number `7 )
E. Sewer: All lots will utilize Individual Sewage Disposal Systems (ISDS) for their
sewage disposal needs and will have to meet the County ISDS regulations for
separation from wells and other ISDS in the area.
F. State and Local Health Standards: No State or Local health standards are applicable
to the application, with the exception of Colorado Department of Health ISDS
setback standards.
G. Easements: Any required easements (drainage, access, utilities, etc.) will be required
to be shown on the exemption plat.
H. Fire Protection: The property located on Block 11 of the Cooperton Townsite, is located
in the Carbondale Rural Fire Protection District. The Carbondale Fire District currently
provides fire protection service to the property and will continue to do so. (see attached
pagegd-'o )

IV. SUGGESTED FINDINGS
1. That proper posting and public notice was provided as required for the meeting
before the Board of County Commissioners.
2. That the meeting before the Board of County Commissioners was extensive and
complete, that all pertinent facts, matters and issues were submitted and that all
interested parties were heard at that meeting.
3. That for the above stated and other reasons, the proposed exemption is in the best
interest of the health, safety, morals, convenience, order, prosperity and welfare of the
citizens of Garfield County.
V. RECOMMENDATION
Staff recommends APPROVAL, with the following conditions of approval:
1. That all representations of the applicant, either within the application or stated at the
meeting before the Board of County Commissioners, shall be considered conditions
of approval.
2. An Amended Plat, Cooperton Townsite, Block Number 11 shall be submitted,
indicating the legal description of the parcels, dimension and area of the proposed
lots, access to a public right-of-way, and any proposed easements for setbacks,
drainage, irrigation, access or utilities.

*CONDITIONS:
1. All installation must comply with all requirements of the Colorado State Board of Health Individual Sewage Disposal Systems Chapter
25, Article 10 C.R.S. 1973, Revised 1984.
2. This permit is valid only for connection to structures which have fully complied with County zoning and building requirements. Con-
nection to or use with any dwelling or structures not approved by the Building and Zoning office shall automatically be a violation or a
requirement of the permit and cause for both legal action and revocation of the permit.
3. Any person who constructs, alters, or installs an individual sewage disposal system in a manner which involves a knowing and material
variation from the terms or specifications contained in the application of permit commits a Class I, Petty Offense ($500.00 fine — 6
months in jail or both).
