We have however attached a Low Risk Environmental Assessment based off of the information provided in the Phase 1 ESA which was completed by Terracon. Traffic Study: We are requesting a waiver for a full traffic study as there will be little to no traffic pattern changes. This is due to the sites location on a cul-de-sac (Mesa Drive) and the uninhabitable nature of the structure. The tower is expected to receive maintenance 1-2 two times a month, during this time there will be a presence of one technician who will access the proposed utility easement. The phasing for this project will be: a. Phase 1 -initial testing and modulation studies i. This is a serious of tests that will determine what frequencies are in use and if they could cause potential interference to AT&T's proposed facility. ii. This normally takes 6-8 months b. Phase 2- Mobilization i. Equipment will be procured and shipped to the site along with proper arrangements for man power and tools to be in place as this equipment will have to be custom fit. iL This is expected to take an additional 6-8 months c. Phase 3- Installation 1. A construction crew of no less than 3 but no greater than 8 will install all proposed antennas, arrays, and appurtenances necessary for the operation of the facility. ii. This is anticipated to take a maximum of 2 months. d. Phase 4- Radio frequency optimization and closeout i. Testing of the facility once it has been brought on air with FCC standards and guidelines. ii. Closeout involves insuring the site is clean of all trash, materials, and debris. Also, in a well maintained condition as agreed to and approved by the landlord. Water Supply Plan/Wastewater Treatment Plan: This will not be needed since the structure is uninhabitable and there will be no need for water supply and there will be no wastewater. Narrative Proiect Description: This project consists of the installation and operation of antennas and associated equipment cabinets for AT&T's wireless telecommunications network. The new equipment shelter will be 11'-S" x 28' (322 square feet) with enclosure for emergency generator and will be completely uninhabitable. In addition, AT&T proposes a new 60' monopole with 12 antennas in a fenced in compound. The overall compound will be a total of 1375 square feet using .03 acres of the total 3.5 acres of the parcel. This new tower will provide enhanced cell coverage, open access of E-911, and network reliability in the area that has recently reached its maximum capacity. Additionally, this will provide the abilities to incorporate next generation technologies, including LTE. This facility will be constantly broadcasting once brought on air in compliance with the FCC regulations but, there will be no employees since this site is uninhabitable by nature. Since, there will be no employees there is no need for a parking lot. The site will be accessed one to two times a month by a technician to do site maintenance. The site will be accessed by the new AT&T 16' access and utility easement off of Mesa Drive. The new access will maintain the same gravel appearance as the existing gravel access road. On the West side the facility is 50' away from the adjacent property line. The power lines to the North of the facility are approximately over 35' away from the fence of the lease area, therefore not interfering. Standards Article 7- Telecommunications Facilities: 1. The proposed tower and facility will have sufficient structural strength and space available to accommodate the tower and related equipment. AT&T has done structural analysis and the drawings have been completed by licensed architects and engineers. 2. The proposed tower will not cause unreasonable interference with existing structures. Both the power lines and power towers are located beyond the proposed structure, refer to page A3 of the drawings. 3. No existing towers, structures, or facilities within a distance met the engineer's requirements for this facility. B. The project follows all engineering standards as all drawings have been completed by a licensed engineer/architect familiar with this scope of work. The facility meets all set back requirements and will not put adjacent properties in an unprotected scenario. C. Please waiver public utility structures as this 15 not applicable. This will not be mounted on a public structure. D. This facility has been designed to minimize visual impact, carry gravity, and wind loads by law. 4. This design is architecturally integrated as there are power lines and a power tower located in the vicinity. 5. This design is not located on existing vertical infrastructure due to towers in the area not meeting engineer's requirements. 6. This design does not contain any roof -mounted equipment and will have no antennas attached to any building. 7. Equipment shelters and antennas do not extend more than 10 feet from the top of a building as they are not located on a building. 8. This facility is located in an area where other power lines and power tower will provide screening and help blend into the fabric of the area. E. There will be no lighting or signage and absolutely no advertising. F. All wires, cables, fixtures, and other equipment shall be installed in compliance with the requirements of the National Electric Safety Code and all FCC, FAA, State and local regulations and will not interfere with radio communications, electronic transmissions, or all other electromagnetic communications. G. This site does not need an FAA determination as it is not within 8 kilometers (5 miles) of an airport. This information was determined through TOWAIR. H. This facility will comply with all applicable standards of the Federal Telecommunications Act of 1996 and all requirements of the FAA where applicable. Waivers from Submittal Requirements: We are requesting waivers from the following submittal requirements Grading and Drainage Map- this is not applicable to this facility and type of project. There are no water features and Wetlands within the proposed facility. Also, this does not fail into the 100 year flood pain boundaries. Landscape Plan- This type of plan is not applicable as the facility is located in a small lease area and most of the ground space will be used by the equipment shelter. Impact Analysis- The size of this project is small and there will be a minimal impact therefore an analysis is not necessary. Included in this packet is a Low Risk Environmental Assessment that this site is low risk and there is no need to conduct any more environmental investigations. Full Traffic Study- thls project is located in a rural area and on a cul-de-sac. There will be little to no impact on the traffic patterns. In addition, this is an uninhabitable equipment shelter and there will be no full time employees and a full traffic study will not be necessary. Waivers from Standards: Public Utility Structures- Please waive this standard as it does not to apply since the facility will not be located on an existing structure of public utility. Limited Impact Review Additional Items Mineral Estate Owners Through extensive research we have not been able to Identify any mineral estate owners for this site. We have contacted the Rifle Creek HOA on 12/10/14 and their representative Larry McCown was not aware of a current mineral estate owner. After contacting the HOA we researched the deed and the title policy. A recorded quitclaim deed does not include any information regarding a mineral estate owner and the title policy also does not state any type exceptions of mineral interests on the land. After searching these outlets we then researched with the assessor and once again could not find any record of mineral estate owners. After these did not turn up any information we contacted the Clerk and Recorder's office directly on 12/15 and spoke with Bonnie, we were unable to find any information regarding Mineral Estate Owners unfortunately. Limited Impact Analysis 1. The adjacent lands within a 1500' radius are all zoned rural with parcels to the west zoned as public land. The rural land is used for residential purpose but the overall density in the area is very low. The map below shows the 1500' radius. 2. The proposed tower site is located within an undeveloped woodland clearing sparsely covered with shrubs and grasses. Attached Is a topographic map showing the site's topography, it is observed as sloping towards the north. There are no wetlands, streams, springs, ponds, or other water sources in the proposed tower site. Also attached, a wetlands map showcasing that there are no wetlands 3. Please find attached a soil map and report regarding the site. 4. The proposed use of the land will had no adverse effects on the land according to a NEPA report conducted by Terracon. Previously sent was a Low -Risk Memo, deeming this site after all environmental review to be low risk and there is no need to further conduct research. 5. According to Garfield County G15, this site is not in a floodplain as seen in the Flood Plain Map attached. It is located to the West of the identified floodplain. Also, according to the topography this parcel is sloping slightly towards the North. Additionally included is section 2.3.7 of the NEPA report confirming that there will be no significant changes in surface features. 6. Since the proposed tower is in a clearing there will be no Tong -term or short-term effects on flora and fauna. According to the attached maps for the Wilderness areas and Wildlife Refuge Map, there are no designated wilderness areas in the vicinity. There are no federally listed threatened or endangered species or critical habitat at the site that would be adversely affected by the proposed project. This proposed pole will also abide by USFWS recommendations for Communication Tower Siting and will be under 200* tall with no lights to decrease potential effect on migratory birds. (The excerpt from the NEPA is included 2.3.1) Last, there is no potential radiation hazard that has been identified by the State or County Health Departments. 7. This site will not be a nuisance to adjacent land as no vapor, dust, smoke, glare, or vibration will be emitted. 8. Once this tower is on air it will be working 24/7 however, there are no employees and the equipment shelter is an uninhabitable structure. Statement of Authority A statement of authority has been completed by Larry McCown, the representative for Rifle Creek Home Owners Association and recorded with the county clerk. He has also sent an email giving Lyndsay Ward the authorization to complete zoning on this project. There is a second 50A completed by New Cingular, Mark Johns. Access and Roadways The proposed easements for access to the site meets each of the dimensional requirements and will use the same materials to maintain the same fabric in the area. This can be seen in the attached construction drawings. GENERAL PROJECT DESCRIPTION The Applicant proposes to construct a telecommunication tower on a site off of County Road 257 (aka as Mesa Dr.), located within the Rifle Creek Estates Subdivision. Waivers from submittal requirements can be requested pursuant to Section 4-202 and the review criteria contained therein. It is recommended that you contact the Planning Staff regarding any anticipated submittal waivers. Some submittals may not be applicable based on a facility being unmanned. M. Waivers from standards can be requested pursuant to Section 4-118 and the review criteria contained therein. Requests need to contained detailed information on compliance with the review criteria. Additional topics discussed as part of the pre -application meeting included: N. The need to provide documentation that the proposal is consistent with any covenants or plat notes for the subdivision and any conditions of the Subdivision approvals including any restrictions on use of the parcel. O. The need to provide good documentation on the access roadway including legal easements for access. If a roadway maintenance agreement is proposed or in place a copy should be provided. If a waiver is needed from roadway standards (i.e. grade) additional information on the roadway will be needed along with a statement from a Licensed Professional Engineer that the roadway is adequate for the proposed use. P. Based on proximity to existing homes the Application in the Impact Report Section should address compatibility including any screening or mitigation of visual impacts. Any potential nuisance impacts also need to be addressed. Q.
