Cerise Earl 'Rhodes Mildred-Alsdorf , Commissioner Chairman , Commissioner , 'Commissioner , County Attorney , Clerk of the Board when the following proceedings, among others were had and done, to•wit: RESOLUTION NO 83-156 A RESOLUTION CONCERNED WITH THE APPROVAL OF A ZONE DISTRICT AMENDMENT TO THE GARFIELD COUNTY ZONING RESOLUTION REQUESTED BY L.W. AND SANDRA E. WRIGHT AND THE LAZIER -SILLS PARTNERSHIP - WHEREAS, _L.W. ARTNERSHIP. WHEREAS,•L.W. and Sandra Wright and the Lazier -Sills Partnership have filed a petition with the Board of County Commissioners of Garfield County, Colorado to rezone. the herein described property in Garfield County from Planned Unit Development zone district to Agricultural/Residential/Rural Density zone district; and WHEREAS, a Public Hearing was held by this Board on June 6, 1983;.; and WHEREAS, based on the evidence, testimony, exhibits, study Plan for th_ unincorporated area of the County, comments of the of Development, comments of public officials, and agencies, and interested parties, this Board finds as follows 1. That.proper posting, publication_ and public notice was by law for the hearing before the Board; 2. That the hearing before the Board was extensive facts; matters,and issues were submitted and that all that hearing; 3. That the Garfield County Planning Commission has recommended to this Board that the requested rezoning be granted; 4. That the proposed zoning is in compliance with the recommendations set forth in the Comprehensive Plan for the unincorporated area of the Count -y; 5. That the proposed land use will be compatible with existing and permitted land uses in all directions; 6. That for the above stated and other reasons, the proposed zoning is in the . best:interest of the health, safety, morals, convenience, order, prosperity, and welfare of the citizens of Garfield County. of the Comprehensive Garfield County Department comments from all provided as required and complete, that all pertinent parties were heard at • NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners: SECTION 1: That the petition. of L.W. and Sandra E. Wright and the Lazier -Sills Partner- ship fora zone change from Planned Unit Development zone district to Agricultural/ Residential/Rural Density zone district for the following described unincorporated area of Garfield County be approved. SECTION 2: That upon this Board's determination that the foregoing conditions have been satisfied or agreed to by the applicant, the Chairman be and hereby is authorized to execul..e:an amended Zone District map to the Garfield County Zoning Resolution, reflecting the amendment herein granted for the following described unincorporated area ,of Garfield County: A parcel of land situated in the SW% SWC and the SE4 SW1 of Section 25 and in the Nz NWS of Section 36, Township 5 South, Range 90 West of the 6th Principal Meridian, according to the original survey on file in the Surveyor General's Office in Denver, Colorado, dated February 13, Said parcel of land being more particularly described as follows: BOOK 630 PAGE 865 Beginning at the Northwest Corner of said Section 36, a 1" x 8" x 6" Red Sandstone found in place, 'THENCE South 85°33'48" East, 1373:32 feet to a rebar and cap in place, being the TRUE POINT OF BEGINNING; THENCE North • 00°36'16" West, 92.85 feet; THENCE North 10°45'32"East, 104.12 feet; THENCE 12°54'49" East, 195.09 feet; THENCE North 01°30'05" West, 174.98 feet; THENCE North 10°59'32" West, 351.50 feet; THENCE North 00°36'16" West, 40.56 feet; THENCE South 78°10'50" West, 187.57 feet to the centerline of Canyon Creek; THENCE ALONG SAID CENTERLINE THE FOLLOWING BEARINGS AND DISTANCES: South 09°18'05" East, 22.85 feet; South 04°08'06" West, 424.03 feet; South 23°38'42" West, 180.64 feet; South 18°27'32"West, 82.82 feet; South 00°58'43" West, 50.08 feet; South 25°58'48."
