The requested amendment is to allow for construction of two additional buildings to be used as music practice facilities. These structures were not contemplated in the approved Conditional Use Permit which permitted thirty-three buildings including classrooms, dormitories, houses and various agricultural and accessory structures. The additional buildings would not exceed 3,000 square feet of floor area, thereby remaining below the maximum 5% increase to be determined a non -substantial change. No other changes to the CUP are requested. When considering an Amendment of a Conditional Use Permit the Director must first determine whether the request is a Non -substantial Change' based upon the original approval. The definition of Non -substantial Change is contained within Article 16: Definitions, of the Unified Land Use Resolution of 2008, as amended (ULUR). If the application meets the criteria for a determination of Non -substantial Change the Director has the authority to approve the application. After careful consideration of the proposal a determination of "Non -substantial Change" has been found, therefore your request to amend the existing CUP is hereby Approved. All conditions of approval contained within Resolution 99-016 remain in full effect. This Determination letter may function as the required notice to be provided to the Board of County Commissioners and alt property owners within 200' of the CRMS site. Notice must be sent certified mail, return receipt requested within five (5) working days of this letter. CRMS's CUP and master plan were approved in 1999. This application seeks approval to construct two musical practice structures on the campus. Each structure will be less than 1,500 square feet, CRMS plans to build one of these practice structures in the fall of 2010. CRMS was established in 1953 as a college preparatory school to provide the experience and skills necessary for growth of mind, body, and character. The values that CRMS teaches are rooted in its close family atmosphere nurtured by its small campus. Academics are the single most important component of the CRMS curriculum. Part of this curriculum is its music program. CRMS needs a musical practice facility. Currently, there is no dedicated practice facility for CRMS music students. CRMS music students practice in the barn, which is not exclusively dedicated for music practice. This occasionally conflicts with other classes held in the barn. CRMS needs space dedicated exclusively for the music students to enable those students to realize their full musical potential. This approval will allow CRMS to dedicate space solely to music students by constructing two music practice facilities for their existing students. This request will not expand the student population. The CUP permits up to 250 students on the campus. Currently, the student population is below 150 students. This BAI.COMB & GREEN, P.C. On Friday, May 14, Larry Green held a Pre -Application Conference with Fred Jarman. It is our understanding that no Pre -Application Conference summary was prepared. This application is submitted in accordance with GCULUR § 4-107, which was recently amended by Resolution No. 2010-30. This amendment permits administrative review of applications for an amendment to a conditional use permit that are non -substantive in nature. This application contains all of the materials required by Section 4-501(H) and meets all of the criteria for a non -substantial change. Attached are the standard application materials and a site plan. Below is a list of the criteria for a non -substantial change. Our response to the criteria is denoted in italics. Criteria for Non -Substantial Change: 1) Is consistent with action(s) taken during previous Land Use Change Permit approval; CRMS's CUP was approved in 1999. This permit was a comprehensive approval of the school's educational facilities and master plan. This approval permitted thirty-three buildings of various types on the property, including classrooms, dormitories, !causes, and various agricultural and accessory structures. Applicant's present request is consistent with the 1998 CUP in that it seeks approval for two additional educational buildings. These buildings would be no larger than 3,000 square feet and would provide a practice facility for existing music students. 2) Does not change the use category of the proposed development between residential, commercial and industrial uses; Approval of this application will not change the use category of CRMS. CRMS is still an educational facility. 3) Does not change the basic character of the approved use of the land on which the activity occurs, including basic visual appearance and method of operation; Approval of this application is consistent with CRMS's operation as an educational facility. CRMS will agree to a condition that the music practice structures be constructed similar in appearance to existing infrastructure on the campus. 4) Does not constitute a new land development activity; BALCOMB & GREEN, P.C. It is a minor extension of an approved land use. 5) Does not violate any Land Use Code standard; Approval of this application does not violate any Land Use Code standard. "6) Does not substantially increase off-site impacts (including but not limited to increased traffic, water use, wastewater generation, etc.) in the surrounding neighborhood; This application seeks approval to construct tzoo practice facilities for existing music students. It will not increase the population of students on the campus. Therefore, it will not substantially increase off-site impacts related to the student population on the campus, including traffic, wastewater generation, or other utilities. Each building consists of a hand washing station, a sound booth, and a practice room. The structures themselves will be heated, have electricity, and will provide hand washing stations for the musicians. Since this water use is non -consumptive, it will not substantially increase the off-site water use. Due to the size and nature of the structure, it will not substantially increase the off-site impacts related to any other utility. 7) Does not substantially increase the need for on-site parking or utilities; As stated in the response to Criterion 6, this application will not increase the number of students permitted on the CRMS campus and therefore will not substantially increase the need for on-site parking. Also, due to the nominal increase in utilities needed to operate the practice facility, it will not substantially increase the need for on-site utilities. 8) Does not increase the floor area of the use by more than five (5) percent or decrease the open space on the site by more than five (5) percent; and The total floor area of the buildings on the CRMS campus exceeds 139,000 square feet. This includes eight academic buildings, six student dormitories, two maintenance facilities, two administrative office buildings, twelve employee housing buildings, and numerous storage and agricultural outbuildings. The floor area of the requested music buildings upon completion will be less than 3,000 square feet, which means the total floor area will increase by 2% at most. BALCOMB & GREEN, P.C. As a result of the music building project, the open space would decrease a maximum of 3,000 square feet, a decrease of approximately 0.01%. 9) Does not endanger the public health, safety or welfare. Approval of this amendment will not endanger the public health, safety or welfare. We understand that your office will now review the application and issue a determination of completeness. Within thirty days of a determination of completeness, we understand you will make a determination as to whether this application constitutes a substantial modification of the conditional use permit. We have set forth the justification as to why this application does not substantially modify CMRS's conditional use permit. The Director shall review the application to determine whether the proposed change constitutes a substantial change to the Limited Impact Permit approval pursuant to Section 4-107 of Article IV. A. Green, Att atney for Applicant K/312. 0/0 Date GARFIELD COUNTY BUILDING AND PLANNING DEPARTMENT FEE SCHEDULE Garfield County, pursuant to Board of County Commissioners ("Board") Resolution No. 98-09, has established a fee structure ("Base Fee") for the processing of each type of subdivision and land use applications. The Base Fee is an estimate of the average number of hours of staff time devoted to an application, multiplied by an hourly rate for the personnel involved. The Board recognized that the subdivision and land use application processing time will vary and that an applicant should pay for the total cost of the review which may require additional billing. Hourly rates based on the hourly salary, and fringe benefits costs of the respective positions combined with an hourly overhead cost for the office will be used to establish the actual cost of County staff time devoted to the review of a particular project. Actual staff time spent will be charged against the Base Fee. After the Base Fee has been expended, the applicant will be billed based on actual staff hours accrued. Any billing shall be paid in full prior to final consideration of any land use permit, zoning amendment or subdivision plan. If an applicant has previously failed to pay application fees as required, no new or additional applications will be accepted for processing until the outstanding fees are paid. Checks, including the appropriate Base Fee set forth below, must be submitted with each land use application, and made payable to the Garfield County Treasurer. Applications will not be accepted without the required application fee. Base Fees are non-refundable in full, unless a written request for withdraw from the applicant is submitted prior the initial review of the application materials. Applications must include a Payment Agreement Form ("Agreement") set forth below. The Agreement establishes the applicant as being responsible for payment of all costs associated with processing the application. The Agreement must be signed by the party responsible for payment and submitted with the application in order for it to be accepted. The following Base Fees shall be received by the County at the time of submittal of any procedural application to which such fees relate. Such Base Fees shall be in addition to and exclusive of any cost for publication or cost of consulting service determined necessary by the Board for the consideration of any application or additional County staff time or expense not covered by the Base Fee, which have not otherwise been paid by the applicant to the County prior to final action upon the application tendered to the County. All applications shall be submitted with a signed Agreement for Payment form set forth below. 2. County staff shall keep accurate record of actual time required for the processing of each land use application, zoning amendment, or subdivision application. Any additional billing will occur commensurate with the additional costs incurred by the County as a result of having to take more time that that covered by the base fee. 3. Any billings shall be paid prior to final consideration of any land use permit, zoning amendment, or subdivision plan.
