After speaking with planning manager Tamra Allen, it was determined that amending open space to a buildable lot would be most unlikely and very difficult. Based on this information, we will waive the fire resistive construction requirement for lot #287. As documentation of this determination, please include a copy of this correspondence with the building permit application submittal. If you have difficulty reading these I can take more time and send a scaled drawing. As we discussed on the phone there is a lot with a residence on one side, open space at the rear and other side and street at the front. You are stating (generally) that there needs to be a 5 foot distance from the property line and the structure or the portions ti that are within this area will need to be 1 hour fire rated. (If the overhangs are within the 5 foot area the soffits will be required to have an 1 hour fire rating. 1. Can we interpret this to mean the structures and element of them need to be 10 feet apart or does it mean the structure and it's elements have to be 5 feet from the property lines to keep from being rated? 2. You and I, with Andy's input, discussed a number of weeks ago, because there is open space on 2 side and street at the front that these areas would not need to be considered for the 1 hour rating rules since there is over 30 foot separations on each of theses sides to any additional lots.
