Proposed Land Use: Small Contractors Yard
Application Type: Administrative Review
Site area: 4.93 acres (of total 12.98 acre property)
The Applicant proposes to delineate a 4.93 acre parcel for use as a Small Contractors Yard on a 12.98
site. Land uses within the Yard shall include storing machinery,
equipment and supplies, including office and repair facilities, as
commonly required by the building trades. The balance of the site shall
continue to be used as a tree farm and two residences.

OWNERSHIP
The Owner/Applicant is Timberline Energy Inc.; William H. Spires is the president and sole share holder.
(See Appendix A: Warranty Deed) The Applicant’s Authorized representative for this application is
Allen Gerstenberger. (See Appendix B: Authorization letter.)
VICINITY MAP
The site is locate one mile east of New Castle, at the junction of County Road 240 (Bruce Road) and US
Hwy 6.

SITE DESCRIPTION
The Tree Farm property is a triangular-shaped site with 1,376’ frontage on County road 240 (Bruce Road;
876’ frontage on US Hwy 6; and 1,345’ adjacent to agricultural uses. Within the 12.98 acre site, a 4.93
acre parcel will be delineate as the Small Contractors Yard (SCY).
There are no natural streams or waterbodies on the property. An irrigation ditch traverses the site
north-to-south, delivering water to an impound area for irrigating the Tree Farm property.
The Tree Farm property has a total elevation change of about 80’ from north to south. The Small
Contractors Yard has about a 30’ elevation change.
There are no unique site features, such as rock outcroppings or water features on the site. The grove of
mature cottonwood trees near the two residential homes will be protected. The Small Contractors Yard
has been configured so that the mature trees are retained by excluding them from the 5 arce SCY. The
irrigated portion of the Tree Farm property has also been excluded from the SCY.

Site is located at the intersection of County Road 240 (Bruce Road) and US Highway 6. The Site is served
by two existing ingress/egress points; no change in the location or configuration of these access points
is proposed. The primary access for the SCY is about 750’ from the US 6 intersection. (See TRAFFIC
STUDY on page 9).

SITE HISTORY & CURRENT LAND USES
The site has historically been used for agricultural-related uses, with two residences built in about 1919,
with a variety of outbuildings and sheds added over the years. For over a decade, beginning in the mid-
1990’s, the West Canyon Tree Farm operated a retail nursery, tree farm, and landscape construction
company on the site, employing up to 50 people, a fleet of 8 trucks and
support vehicles. They stored equipment and landscape materials on-
site.
Existing uses on the site include tree farm and two residences. There
are no retail, industrial, or mercantile uses currently on site.
In 2013, the Garfield County Code Enforcement officer notified the
Owner that several businesses operating on the property were not in compliance with county
regulations. The tenants were notified by the Owner and all tenants have vacated the property.
The wholesale tree farm operation continues to grow and inventory trees. The two residences are both
leased and occupied.
PROPOSED LAND USES
The Applicant proposes designating a 4.93 acre portion of the total 12.98 property for use as a “Small
Contractors Yard” for the storage of equipment and materials used in the building trades. No new
buildings are proposed. Shared roadways will be gravel. Storage yards will be a combination of gravel
and compacted soil, depending upon the intensity of use. Minimal impervious surfaces will be install,
primarily limited to special use areas such as fuel or hazardous materials storage.
CURRENT ZONING & COMPREHENSIVE PLANS
The property is currently zoned “Rural” (R). Lot size and setbacks comply with zone district
requirements from Table 3-201. Historical uses on the site, including nursery, tree farm, two single
family homes, and ancillary structures, are consistent with the zone district standards. Based on county
records, the residential homes were built in 1919. (See Error! Reference source not found. for
supporting information.)
The proposed land use permit for a 5 acre Small Contractors Yard is compatible with the zone district
objectives for uses and densities that protect the area from uncontrolled and unmitigated residential,
commercial, and industrial uses. The SCY will provide a screened, organized, and managed area for the
storage of materials and equipment used in the landscaping and building trades. The location of the
property near the intersection of US Hwy 6 and CR240 minimizes traffic impacts on county roads and
neighboring properties.

The property is located approximately 1 mile east of the incorporated Town of New Castle and is in their
Urban Growth Boundary. The 2009 New Castle Comprehensive Plan Future Land Use Map identifies
the property as the “East Gateway,” with the recommended land use “Mixed Use – Commercial Focus.”
The following describes the types of uses and
densities New Castle proposes for the site:
Types of Uses: The primary uses in this area are
commercial (at least 70%) with other residential or
noncommercial not exceeding 30% of the square foot
occupancy. Uses include small and medium sized
retail (not exceeding 20,000 square feet in a single
structure), a variety of services, lodging, entertainment,
groundlevel retail, offices, restaurants, entertainment,
civic functions, lower and upper level offices, dining,
andapartment/condo residential units. Upper-story
residential uses include apartments, lofts and
live/wounits. Compatible light industrial activities are
permitted in this district.
Density: Multi-storied mixed-use structures up to 20
units per acre with excellent design.
The subject property is seen as an important mixed
use development site and entry for the Town of New Castle. The interim uses proposed in this land use
application are consistent with the long-term objectives of New Castle.
SITE PLAN
The Small Contractors Yard has been designed to accomplish a variety of objectives, including:
Permit a variety of areas that can serve small contractors’ requirements for separation and
security.
Minimize the need for site grading for the Contractors’ Yard.
Protect existing, mature trees and natural landscaping.
Provide a primary ingress/egress point to CR240 that is a
safe distance from the intersection with US Hwy 6.
Protect the two existing residences and maintain their
yards and open space.
Provide secondary access for emergency vehicles, as
required.
Minimize disruption to the existing Tree Farm functions
and irrigation systems.

GRADING & DRAINAGE
High Country Engineers has prepared storm water calculations and reviewed existing drainage facilities
for the 12.98 site and the 5 acre Small Contractors Yard. A copy of their report and worksheet
calculations are included in Appendix D: Storm Drainage – Engineer’s Report. The following
summarizes their findings and recommendations:
One 6.66 acre off-site basin drains to the site and is conveyed through the site to an existing
pond via an earthen swale. The offsite basin discharges 0.06 cfs during a 25 year storm event
and 0.26 cfs during the 100-year event. A 4 inch deep swale with 2:1 side slopes is sufficient to
route the runoff to the existing pond.
An existing 10’x10’ box culvert under US Hwy 6 carries runoff when the pond overtops.
The existing 12.98 acre site discharges 2.48 cfs during a 25 year event and 4.81 cfs during the
100-year event.
The proposed Small Contractors Yard will increase the 25-year storm runoff to 3.50 cfs and 6.06
cfs for the 100-year event, assuming that gravel will replace the trees stored on the
southeastern portion of trees.
A small detention facility will be required to restrict runoff from the site to the pre-developed
conditions. The 25-year detention volume will be 3,690 cubic feet and the 100-year volume is
5,036 cf. A 2’foot deep pond with 2:1 side slopes along 335 feet paralleling US Hwy 6, with
earthen weirs, will be sufficient.
The Small Contractors Yard has been designed to minimize the need for site grading or modification of
historic drainage patterns, traffic flow, foliage, or structures. This approach eliminates the need for
additional temporary roads or soil stockpiles.
The Small Contractors Yard will permit the storage of equipment, fuel, lubricants, and other materials.
Spill containment facilities shall comply with relevant local, state and federal regulations.
The Owner/Applicant’s signature on the “Grading Drainage and Site Plan” indicates acceptance of
responsibility for the erosion/sediment control and stormwater drainage conditions, as well as the
responsibility for maintenance of the facilities.
The proposed Small Contractors Yard is not within 100’ of a Waterbody nor does it create more than
10,000 sf of impervious surface area; therefore Section 7-207, Stormwater Run-off standards are not
applicable.
The Applicant shall work with the CDPHE to determine if the National Pollutant Discharge Elimination
System Permit is required.

LANDSCAPE PLAN
The Small Contractors Yard has been designed to retain and protect existing foliage and natural
landscape features on the property. The aerial photo and Landscape Plan identify locations of the
mature cottonwood trees and foliage that will be retained. In addition, the Tree Farm inventory
provides landscape screening.
The Small Contractors Yard is less than 40% of the total property. It has been configured to (1) have
minimal impact on existing mature trees and foliage and (2) to provide an efficient, fully utilized
contractors’ yard. The SCY will be leased to small contractors. The landscaping on the overall site will
provide the necessary screening and natural setting consistent with the neighborhood.
The SCY is adjacent to agriculture lands to the west, with the closest residential building approximately
1,100’ away. For screening purposes, the SCY will require opaque or semi-opaque fencing (wood,
slatted wire, or wind screens) to hide uses that are unsightly from view from adjacent residential homes
or public ROWs. If the tenant selects to use landscape materials for screening, the plants will be
sufficient dense year-round to provide consistent screening. Privacy fencing will be installed after the
initial tenants have determined their individual site plans.
No permanent, existing trees larger than 6” caliper will be removed to accommodate the Small
Contractors Yard. Note that the southern part of the SCY is currently used by the Tree Farm for storage
of non-permanent tree inventory, which will be relocated. This tree storage area is not served by a
permanent irrigation system.
Because of the quantity, location, and size of existing vegetation, as well as the quantity of plant
materials inventoried by the Tree Farm operation, no additional plants or landscaping will be installed.
Any areas disturbed by grading or other construction activities will be reseeded with mix of native,
adaptive, and drought-tolerant grasses. Seed mixtures are noted on the Landscape Plan.
The landscape maintenance program will include the use of irrigation ditch water for the mature
cottonwoods and the the Tree Farm operations. General landscape maintenance (mowing, cleanup,
pruning, etc.) will be managed by the Property Manager.
The driveway intersection with CR240 will comply with county “clear vision area” requirements to avoid
visibility obstructions.
Designated parking areas in the SCY have fewer than 15 spaces and therefore do not require landscape
buffers.

TRAFFIC STUDY
The site is adjacent to CR 240 (Bruce Road) and US Hwy 6. There are 2 existing access points on CR 240.
There is no access existing or proposed for
US Hwy 6. The following exhibit shows
roads within 1 mile of the site:
Access will be from CR240 (Bruce Road),
approximately 775 feet north of US Hwy 6.
CR240 is two-lane, paved roadway; US Hwy
6 is a two-lane arterial roadway under the
jurisdiction of CDOT.
The principal access to CR240 for the Small
Contractors Yard will be the existing
driveway at about the middle of the site.
This curbcut also provides access for the two
existing residential units. The access
driveway closest to US 6 will serve the
existing Tree Farm operation and be
available for emergency vehicle access. This
circulation pattern will provide for the most efficient and safest separation of vehicles, while utilizing
existing vehicular access routes.
Trip generation estimates for the Small Contractors Yard have been prepared by David Ruble, a
registered engineer with 30 years of traffic and transportation planning experience.
The copy of the traffic analysis letter is in Appendix E: Traffic Report – Engineer’s Report. The following
summarizes key points:
Trip Generation:
o The ITE Trip Generation report, 8th Edition was used to estimate the number of vehicle
trips.
o Land Use category 151, mini-warehouse, provides the most realistic traffic model for the
proposed development. The traffic engineer determined that the ITE model
understated the potential trips at full buildout and he estimates that the SCY will
generate a total of 50 vehicle trips per day at full build out.
o The estimated daily traffic count for CR240 in 2013 is 195 daily vehicle trips; including
the SCY generated traffic, the total will be 245 daily vehicle trips.
o The engineer reports states: Site-generated traffic accounts for 20 percent of total
traffic. The resulting daily traffic estimate of 245 daily vehicle trips will not result in the
need for additional improvements to CR240 or the intersection of US 6 and CR240.”

o Engineer Conclusion: The proposed Timberline Small Contractors Yard will have a
minimal impact to CR 240 (Bruce Road) and US 6.
The Small Contractors Yard will require only minimal on-site construction, involving installation of
fencing and gravel/roadbase in select areas. Therefore, there is no need for temporary access points,
traffic interruption, or additional permitting.
No off-site road improvements are planned as a result of this application. No new driveway or access
permits or easements are planned as a result of this application.
IMPACT ANALYSIS
The county requirements for the “impact analysis” generally address (1) environmental issues (site
features, geology, groundwater, and other impacts) and (2) nuisance impacts on neighbors.
The proposed Small Contractors Yard will result in minimal changes in the historical use or
environmental condition of the site: there
will be no changes in the topography, no
foliage is removed, no changes to existing
drainage patterns, no additional impervious
surfaces, and no new structures will be built.
The SCY will provide exterior storage for
materials and equipment; the traditional
agricultural uses on the site also involved
the storage of materials and equipment – all
the buildings and sheds that have been
incorporated into the Small Contractors Yard
were originally built and used for
agricultural purposes for the storage of
materials and equipment. (Based on
discussions with county building officials,
the structural integrity of the buildings will
be professionally evaluated prior to being
leased to tenants, and will brought up to
code, as necessary.)
The potential for “nuisance” impacts on adjacent lands is the second issue. The setting for the proposed
SCY is relevant: it is bordered by crop lands on one side, an overgrown slope and county road on the
second, and the third side is adjacent to a US highway, a railroad,and an interstate highway – hard to
imagine that the SCY can out-nuisance that combination of land uses.

Of the two closest residential homes off-site, one is about 1100’ from the Small Contractors Yard,
however it is closer to both to US 6 (500’) and the I-70 (700’) than to the SCY. The second residence is
about 1200’ away, but it operates a contractor yard between the home and this proposal.
Management of the “nuisance” issues will be controlled through the lease agreements with tenants.
The lease agreement will respect county guidelines, standards and regulations to ensure that the
operations are compatible with neighbors.
Adjacent Land Uses within 1500-foot radius
The exhibit on the previous page identifies land uses within a 1500 foot radius of the property.
Adjacent properties and mineral owners
An address list of real property adjacent to the site and mailing addresses for each owner is in Appendix
J: Adjacent property owners &
Site Features: Soils, hazards, wildlife
Based on county GIS maps, the soil characteristics of the site are,
described as “deep, well drained to somewhat poorly-drained, nearly
level to gently sloping soils on benches, terraces, alluvial fans and flood
plains.” (Arvada-Torrifluvents-Heldt). This is suitable for the proposed
uses for exterior storage and limited buildings.
Based on county GIS geology and hazard maps, there are no issues that
prevent the propose use on-site for exterior storage of materials.
The existing site vegetation on the site will be retained. In addition to
the Small Contractors Yard, the site uses include a tree farm, providing an inventory of young trees that
provides additional screening.
Based on county maps, there are no critical wildlife habitats on the site. This historic uses on the site
will not be changed based on this application and therefore there will be no blockage of migration
routes, use patterns or other disruptions to wildlife or domestic animals due to this application.

Spill prevention control.
The Small Contractors Yard area will require that chemicals, flammable liquids and fuels, and chemicals
be stored in compliance with relevant local, state and federal regulations.

There will be minimal nuisance impacts on adjacent properties. The Small Contractors Yard will be used
for storage of materials and equipment. Therefore, there will be no abnormal vapor, dust, smoke, noise,
glare, or vibrations from the use of the property.
Hours of operation:
Efforts will be made to limit activities that generate noise, odors, or glare beyond the property
boundaries to the hours of 7 a.m. to 7 p.m. However, this requirement shall not be construed to limit
the normal loading/unloading of materials, if done in a conscientious and quiet manner, before or after
these hours. Because of seasonal work demands, weather issues, and daylight hours, it is normal for
small contractors to be a job sites before 7 am during summer months or work later in the evening than
7 pm. There are no residential developments in close proximity to the Small Contractors Yard.
LAND USE IN FLOODPLAIN OVERLAY DISTRICT)
Based on Garfield County documents, the site does not appear to be located in a designated floodplain.
WATER
The site is not served by a water supply entity. The site is served by an existing well that was
adjudicated in 1980 and amended in 1983 (permit #129238). The well is 95 feet deep and is approved
for 0.033 cu.ft./second. It provides sufficient water for the existing uses. It has been a consistent and
reliable water source meeting domestic and irrigation demands. The existing well is owned by the
Applicant and is not shared with other property owners. (Appendix F: Water related documents)
The Applicant owns irrigation ditch rights which provides adequate and consistent water supply for the
irrigation of the nursery stock and landscaping.
No water services are planned for the SCY.
The water quality was tested by John C. Kephart & Co., Grand Junction Laboratories (6/17/13). They
concluded that sodium, dissolved solids, and hardness were above suggested limits for public drinking
supplies. Based on their finding, a water treatment and filtration system was installed by Western
Water Treatment Inc. (Rifle) and Samuelson Pump Co. (Glenwood Springs) in July 2013. The water
treatment system includes:
To control iron, iron bacteria & hardness: Hellenbrand Iron Curtain system with a 14”x65” aeration tank and
a 12”x52” Promate 6 iron filtration tank with automated backwash and outlet meter and will control a
Chem-Tech 4 gpd chemical pump with 15 gal. chemical tank. This provides proportional continuous
chlorination.
An E3 32-10 meter controlled water conditioner to remove 27 grains of hardness to protect fixtures & water
heaters.
The entire system is meter controlled and demand based to allow the system to adjust itself to changes in
water use.
New pressure tank and sand separator.

WASTEWATER
There are two existing ISDS on the property, providing wastewater service to the two residences and the
single office restroom. Based on research of county records, permits could not be located. Both
systems were pumped, tested, and locations identified in field tests in September 2013.
Based on the field testing, the ISDS that provides service for the east residence and for the SCY office
failed. Therefore, High Country Engineering Inc. has designed a new ISDS. The plan is presented on the
next page.
Based on the engineer’s analysis (see Plan General Notes), the ISDS will include a minimum 1000 gal.
tank with baffles (daily demand calculated to be 909 GPD), with 33 “Quick 4” infiltration units installed
in 3 rows of 11 units each.
An application for a septic permit has been prepared and submitted to Garfield County. (Appendix K:
ISDS documents)
The existing ISDS servicing the west residence is not impacted by the proposed Small Contractors Yard.

PUBLIC UTILITIES
The Site is served by adequate public utilities to meet the demands of the existing uses; no change of
use is proposed and no additional utility services will be required.
NATURAL HAZARDS
The site is not subject to significant risk from Natural Hazards and will not exacerbate existing natural
hazards.
GRICULTURAL LANDS
The Small Contractors Yard will be adjacent to agricultural land to the west. The Small Contractors Yard
shall primarily be used for storage of materials and equipment and shall not negatively impact adjacent
agricultural land uses.
Lease and management agreements will include restrictions for dogs and other domestic animals to
ensure there is no interference with livestock.
An irrigation ditch on the property provides irrigation water for the Tree Farm operation. Maintenance
and ditch rights-of-way shall continue uninterrupted because they are critical to the land uses on the
Site.
WATER QUALITY FROM POLLUTANTS
All hazardous materials shall be stored and used in compliance with applicable State and Federal
hazardous materials regulations. Hazardous materials, sand, and salt shall not be stored within 100’ of
any waterbody1. Management and operational systems shall be included in the lease agreement,
requiring tenants to implement programs to prevent spilled fuels, lubricants, or other hazardous
materials. Vehicle maintenance shall not occur within 100’ of any waterbody. Containment areas for all
fuel storage areas shall be required. Waste storage areas, if any, shall be designed to prevent discharge
of these materials in runoff from the site. The storage areas shall be located away from the storm
drainage system. The Property Manager will monitor and enforce lease terms that address these issues.
AIR QUALITY
The Small Contractors Yard shall not cause air quality to be reduced below acceptable levels established
by state requirements.

not be constructed as a Waterbody.” (pg 16-42). The irrigation ditch and water impound area on the Tree Farm
site are not considered to be a water body, as defined by the Garfield county codes.

WILDFIRE HAZARDS
The site is not considered to be subject to wildfire hazards, based on county maps.
SITE PLANNING & DEVELOPMENT STANDARDS
COMPATIBLE DESIGN
Site Organization: The historic use of the site is generally consistent with the proposed Small
Contractors Yard. The general site organization will not be changed: the eastern half continue to be a
tree farm; two existing residential homes are located in the center of the property; and the 5-acre
portion of the property delineated as the Small Contractors Yard will provide for the storage of
equipment and materials. Those uses will be managed and screened to provide for efficient use by
tenants, with minimal impact on neighbors and public rights-of-way.
Operational Characteristics: The designation of the Small Contractors Yard will improve operational
issues through management, shared facilities, improved vehicular circulation, and screening.
Improvements will include: gravel driveways to minimize dust; requirements for fuel storage areas and
hours of operations managed through lease agreements; and existing curb cuts onto CR240 will provide
for safe ingress/egress. Management and operational issues include:
The Owner will contract with a property management firm to provide management
coordination, contract administration, leasing, and tenant relations.
General maintenance of facilities, including roadways, storage areas, buildings, and utilities in
the Small Contractors Yard area have two components: (1) shared facilities and (2) leased
facilities.
o Shared facilities include entrance driveway and roadways serving multiple tenant areas,
office and restroom, including water service and ISDS. Maintenance and operations of
the Shared Facilities will be by the responsibility of Owner and managed by the Property
Manager. Driveways will be gravel to provide a safe and serviceable driving surface.
Snow plowing will be on an as-needed basis. Water quality system, well and pumps,
and the ISDS will be maintained by the Owner with contracts as-needed by third-parties.
o Leased facilities are the areas of the SCY that are leased to individual contractors for
their exclusive use, subject to the terms of lease agreements. The leasee will be
responsible for the construction and regular maintenance of any improvements within
their leased area. The lease agreement will include standards for appearance,
maintenance, storage of hazardous materials, hours of operation, noise levels, lighting
standards, landscaping and screening. The lease documents will reference County
standards as appropriate. The Property Manager will be responsible for monitoring
tenant compliance with lease terms and standards.

Lighting: Exterior lighting will be designed in compliance with Section 7-306.
Buffering: The Site is adjacent to agricultural croplands to the west. Trash containers and unsightly
work areas will be screened, as appropriate, from the single home (1/4 miles west) and public ROWs.
There is a steep slope to the east that provides a natural buffer.
Materials: There are several existing residential and storage buildings on site that will remain. Building
materials include brick, adobe, and wood siding. Modification of existing buildings is not proposed in
this application. (Also see “NONCONFORMING STRUCTURE” on page 20.)
Building scale: The scale of buildings on site is similar to adjacent properties.
OFF-STREET PARKING & LOADING STANDARDS
The Small Contractors Yard shall comply with county parking and loading standards. Parking and access
drives will have gravel surfaces. Loading/unloading will be on private property.
Parking standards, as per Table 7-304A will be complied with for the existing office building, which will
be in the designated Small Contractors Yard.
County parking standards for commercial and industrial uses are based on the floor area of buildings;
no new or remodeled buildings are proposed as a part of this application. The Small Contractors Yard
will provide for the organized storage of materials and equipment; this function will not use typical
loading/unloading standards. Traffic circulation areas will be gravel and sufficient parking for the uses
will be available on-site. No off-site parking or loading will be require. The property is not located
adjacent to residential uses or residential zone districts.
LANDSCAPING STANDARDS
The Small Contractors Yard shall have minimal landscaping within the fenced 5 acre site. The larger Tree
Farm site, of which the Contractor Yard is a component, is used for growing and storage of trees. These
landscape materials provide a visual buffer for the storage areas of the Yard.
In addition, there are numerous mature cottonwoods and other trees on the property, all of which will
be retained. The irrigation ditch on the property provides ample water for the irrigation of all nursery
functions and existing vegetation and landscaping.
The Site is not located adjacent to residential uses or residential zone districts. Adjacent properties are
agricultural.

Landscaping and/or fencing shall be used to screen trash enclosures, storage areas, and similar unsightly
areas in the Small Contractor’s Yard where visible from public roads. In areas where existing trees and
shrubs are inadequate to conceal equipment, trash containers, or unsightly storage areas, slatted wire,
wood fences, or landscaping will be used.
Wire mesh fencing will be used in select areas to separate tenant areas with the SCY. It preferable to
minimize the use of opaque fencing and to promote the use of landscape materials, either permanent
trees/shrubs or Tree Farm inventory, to provide screening. Minimizing the use of slatted fencing except
where absolutely necessary is consistent with the openness characteristic of the agricultural
neighborhood.
Standards for screening of unsightly areas, such as trash containers, equipment and materials storage,
will be included in the lease agreements. Installation and maintenance of screening and fencing within
the leased premises will be the responsibility of the tenant and monitored by the Property Manager.
The two access points to CR240 shall have a minimum clear vision area formed by the intersection of the
driveway centerline, the street right-of-way line, and a straight line joining said lines thourgh points 20
feet from their intersection. Plant materials shall be limited to 30 inches in height within the clear vision
area.
LIGHTING STANDARDS
There will be limited security lighting in the Small Contractors Yard, if required and provided by leasees.
All lighting will comply with county lighting standards. Lighting standards will be included in the Lease
Agreement.
SNOW STORAGE STANDARDS
The Small Contractors Yard may require occasional plowing and snow storage, but the plowing pattern
and storage locations will be dependent upon the uses in the SCY and cannot be determined at this
time. The Site is not adjacent to residential uses or zone districts.
UTILITY STANDARDS
There will be no change in the existing utility configuration on site; if additional electrical distribution
on-site is required for the Small Contractors Yard, it will comply with county requirements.
NURSERY/GREENHOUSE
The Site will continue to have nursery uses, including the storage and sale of landscaping materials. The
Land Use codes permit an accessory dwelling unit and the storage of materials and equipment directly
related to the on-site nursery operations.

INDUSTRIAL USE
The purpose and uses of the Small Contractors Yard is for “…storing machinery, equipment and
supplies…that provide services to clients through the use of machinery, equipment, or supplies…” The
Yard may “…include office and repair facilities…”
The proposed Small Contractors Yard will comply with applicable sections of the Industrial Use
Standards in Section 7-1001.
Residential subdivisions. Not applicable; the property is not in a residential subdivision.
Setbacks: Not applicable; the property is not adjacent to a residential property line.
Concealing & screening: The Small Contractors Yard will be fenced and screened from adjacent
properties, as necessary to minimize visual impacts; screening may include the use of landscape
materials, including nursery trees. See “LANDSCAPING STANDARDS” on page 17 for additional
information.
Storing: Materials, products, petroleum and hazardous products will
be stored in compliance with county, state, and national codes.
The storing standard in the Land Use code requires a “…minimum of
100 feet from an adjacent property line.” This is impractical for the 5
acre Small Contractors Yard to comply with this standard. The
application is for an irregular-shaped site that is adjacent to
agricultural properties. The exhibit demonstrates the result of
applying the setback requirement.
The intent of the requirement is to minimize visual impacts, as well as provide a safety buffer. For the
Small Contractors Yard, the normal setbacks as specified in Table 3-201 are more than adequate.
Request waiver from Section 7-1101.E. Industrial Use: E. Storing
Rationale: The requirement that “All products shall be stored … a
minimum of 100 feet from an adjacent property line…” is impractical. This
application will comply with the setback requirements as specified in Table 3-201.
Criteria:
1. Intent: The intent of the code is to minimize impact of storage areas on
neighboring properties. In this situation, there are no neighbors that will be
impacted by the waiver.
2. No greater impact on adjacent properties: same as #1.

Industrial waste: All industrial wastes shall be disposed of in a manner consistent with Federal and
State statutes and requirements of the DCPHE.
Noise, ground vibration nuisance or hazards. Uses on the site shall comply with appropriate
regulations and shall make every effort to be good neighbors. The adjacent property to the west is crop
land with the closest residential home is approximately 1,100 feet from the property. Adjacent
properties to the south include a 2-lane US highway, an interstate highway and a railroad.
Dust control: Common roadways (entry driveway and vehicular circulation between tenant leased
areas) will be graded with about 6” of gravel and roadbase. Yards leased to contractors will have some
areas that are gravel, but will also have areas that are not bare. Dust in these areas will be watered on
an as-needed basis. The Lease Agreement will include dust control standards.
STORAGE AREAS & FACILITIES
Hazardous materials (flammable, explosive, or other) shall be safely stored and comply with applicable
codes and recommendations.
NONCONFORMING STRUCTURE & SHEDS
One existing wood frame storage structure is located within the rear setback along the western property
boundary. The single story structure is a shed, with 3 walls and a roof. The adjacent property is
agricultural crop lands with no nearby structures.
This shed will not be altered, repaired or enlarged in a manner that would increase the degree of
nonconformity with respect to the setback. Normal or routine maintenance will be performed, as
permissible under Sect. 10-102.B.
Based on discussion with Dave Barthomew, Garfield County Building Dept., the existing wood sheds will
be evaluated by an architect or engineer for their structural integrity for snow and wind loads prior to
entering into lease agreements with tenants.

Dear William and Allen:
We have reviewed your application materials submitted for the Timberline Energy Inc.
small contractor's yard Administrative Review, located at 1650 County Road 240,
Glenwood Springs, CO 81601. Our completeness review included input from the
County Attorney's Office and has noted several items that need to be addressed prior to
a determination of technical completeness.
In accordance with the Garfield County Land Use and Development Code, please
respond to the following items:
1. The Application needs to include evidence of your ownership of the property as
in a copy of a deed.
2. Information on mineral rights owners (names' and mailing addresses) are needed
or at a minimum clarification needs to be provided as to the research completed by the
Applicant in an attempt to ascertain mineral rights ownership. Mineral rights ownership
information is only needed for your property on which the application is filed.
3. An authorization to represent letter from William Spires allowing Allen
Gerstenberger to be his representative is needed.
4. The statement of authority executed by William Spires needs to be recorded.
5. The Application needs to provide a water supply plan. Said plan needs to fully
·address potable water issues including well permits indicating that you have a legal
source of water for the proposed uses. Information should include what buildings or
facilities are served with water (i.e. office) and the location of significant water
infrastructure in addition to the well. Representations regarding water quality testing
and treatment/filtration systems need to be supported with additional information or
copies of reports. Additional pump tests and water quality tests will be required but may
be addressed as conditions.
6. The Site Plan needs to clearly indicate all structures and facilities to be used in
the contractor yard operation including the office and bathroom location. Improvement
to the legibility and/or scale of the Site Plan may help to address this issue. Additional
information on parking, circulation areas, and storage is needed on the site plan in order
to understand the scale of the operation. A summary table or expanded narrative may
be appropriate.
7. Additional details on proposed screening and fencing needs to be provided. The
Application representations that the "perimeter will be screened with nursery plant
materials" and that "Landscaping and fencing shall be used to screen trash enclosures,
storage areas, and similar items ... " need to clarified and supported by site plan details.
8. The Application should include information as to whether existing storage
buildings can meet building code requirements for conversion from agricultural type
sheds to commercial contractor yard storage. This topic may also be addressed by
conditions.
9. The Landscaping Plan information needs to be supplemented to more clearly
reflect the existing conditions and any proposed additional planting. Legibility of the
submittals may address this topic. A waiver from landscaping plan requirements may
also be needed.
10. The Waste Water Plan waiver is not supported as submitted. Additional
information including existing permits and/or installation plans or records to support the
adequacy of the existing septic systems needs to be provided. What buildings within
the contractor's yard and the balance of the site are served by the system needs to be
included.
11. The drainage, storm water and erosion and sediment control components of the
application need to supplemented with more technical information. In particular portions
of the site that have previously been part of the nursery operation will now be operating
as part of the proposed contractor's yard. While a waiver request has been submitted it
is not supported without the provision of additional documentation.
12. The narrative description of the use should include additional operational details.
Information on how general maintenance, road upkeep, snow removal, and similar
topics will be handled by the owner are needed and would serve to support a variety of
waiver requests that have been submitted.
13. The Traffic Report information needs to include additional information or findings
by a qualified traffic professional regarding the significant traffic estimated to result from
the proposed use. Information on access and any related permits from Garfield County
and/or CDOT needs to be provided. If no permits exist the application should make that
clarification.
14. Requests for waivers including from various sections of the Impact Report should
reference the submittal requirements waiver criteria.
15. Sections on Industrial Use Standards and nuisance issues need to be expanded
to include a plan for dust control on roadways and storage areas.
16. Documentation supporting the existing dwelling units and storage shed (setback)
as pre-existing non-conforming uses needs to be provided.
17. One copy of the updated application saved on a CD needs to be provided
Once the above information/topics are addressed we can finalize our completeness
review, schedule a date for your Director's Decision and proceed with the public notice
requirements. Also, once determined to be complete, you will need to provide
additional copies of the submittal materials to send to referral agencies.
Please note that the Garfield County Land Use and Development Code requires that the
technical completeness issues be resolved within 60-days of the date of this letter,
otherwise the application will be deemed withdrawn unless a request for extension is
submitted and approved.

I. GENERAL DESCRIPTION & DISCUSSION
The Application proposes to consolidate several existing contractor businesses located on their
property into the northerly 5 acres of the site. The application for a small contractor's yard is
designed to bring the uses on the site into code compliance. Some of the contractors businesses
will include small office uses. The existing contractors include 3 - 4 small companies including
concrete, stucco, masonry, and stone businesses (see attached site plan).
A tree maintenance/removal contractor is also located on the southern portion of the property
along with a tree nursery business. A cabin and a single family residence are located in the central
portion of the property. It is anticipated that the residential uses will be located outside of the
delineated 5 acre small contractors yard area.
The overall 12.98 acre property was the former site of a tree nursery and greenhouse business. If
the tree maintenance/removal business is not permitted pursuant to the pre-existing nursery
greenhouse use, then it would also need to be relocated to t~e small contractors yard area.

II. COMPREHENSIVE PLAN
The Future Land Use Mapping for the Garfield County Comprehensive Plan shows the property
located within the Urban Growth Area for the Town of New Castle (see map excerpt below). The
New Castle Comprehensive Plan, Future Land Use Map shows the site with a "Mixed Use -
Commer ... Focus".

IV. WAIVER REQUESTS
Should the Applicant chose to request waivers from submittal requirements or standards, the
Application submittals will need to clearly address the review criteria contained in Sections 4-117
and 4-202 in justifying the requests. Where waiver's from completion of fully developed plans (i.e.
landscape plan) are requested, the Application should still contain general information appropriate
to demonstrate compliance with the review criteria. Where technical issues are concerned (i.e.
roadway standards, traffic, drainage, erosion control) the Application needs to demonstrate that the
issues are also adequately addressed. Technical expertise may still be required to support the
waiver request. Further pre-application meetings are recommended to discuss potential waiver
requests with Staff prior to finalizing the Application submittals.

VI. ADDITIONAL SUBMITTAL REQUIREMENTS
An Application for an Administrative Review will also need to provide the standard application
forms and related documents, a listing of all property owners (with addresses) within 200 ft., an
excerpt from the Assessor's Office mapping showing the ownerships, a listing of any mineral rights
owners on the property {with addresses), authorization to represent statements/letters if needed,
and evidence of ownership.
Site Plan mapping will be an important element of the review process and will need to include
improvement location information for structures, existing site features, and clear delineation of the
contractors yard area no larger than 5 acres in size. The plan should demonstrate the feasibility of
relocating the existing contractors businesses to the sniall yard area or provide alternative
solutions.
The Application needs to provide information on the uses on the balance of the site adequate to
demonstrate that they will be in compliance with the County's Unified Land Use Resolution of
2008, as amended (ULUR). In accordance with Section 12-103(0)(2) of the ULUR, verification of
compliance will be required prior to the issuance of any new Land Use Change Permit for the small
contractors yard. Additional pre-application meetings with staff are suggested in regard to this
topic.
Information on the existing residential uses needs to be provided adequate to confirm that they
are legal non-conforming uses and are in compliance with all applicable regulations including water
supply (well permits) and sanitation (County ISDS permitting).

Bill and Allen,
In accordance with the letter from the Garfield County Community Development office on
August 30, 2013, High Country Engineering, Inc. (HCE) performed storm water calculations on
the existing approximate 12.98-acre tree farm site to assess the impacts from the conversion of
approximately 5-acres of the tree farm site to a proposed small contractors’ yard. Contributing
offsite basins as well as onsite basins were analyzed to determine the amount of runoff draining
to the site as well as through the site to US Highway 6. Calculations for all of the basins
mentioned below have been attached to this letter.
One 6.66-acre offsite basin drains to the site, and is conveyed through the site to an existing pond
via an earthen swale. If the pond overtops it’s banks, the runoff is routed east, to an existing 10-
foot x 10-foot box culvert that drains to US Highway 6. It was determined that the offsite
drainage basin located north of the site discharges 0.06 cfs during the 25-year storm event and
0.26 cfs during the 100-year storm event. A 4-inch deep swale with 2:1 side slopes will need to
be maintained to route the offsite runoff to the existing pond located mid way along the northern
property line, near Bruce Road.
The existing site discharges 2.48 cfs of storm water during the 25-year storm event and 4.81 cfs
during the 100-year storm. The proposed contractor’s yard increases the 25-year storm runoff to
3.50 cfs and the 100-year storm water runoff to 6.06 cfs. The increase in runoff was determined
by assuming that gravel will replace the southeastern area of trees. If gravel does not replace the
trees, and the ground will be left as-is, with just the trees removed, then no detention will be
required. The increase in runoff from the site, assuming the addition of gravel as stated above,
will require a small detention facility to be constructed, restricting the runoff from the site to the
pre-developed conditions as required per Garfield County. The 25-year detention volume will be
3,690 cubic feet and the 100-year detention volume is 5,036 cubic feet. A small detention pond
should be constructed near the southeast corner of the site, where the tree farm’s trees will be
removed to create more storage area for the proposed contractor’s yard. The required detention
volumes will be achieved by creating a 2-foot deep pond with 2:1 side slopes along

approximately 335 feet of the existing road that runs along the eastern property line, in the
southeast corner of the lot. Storm-water will infiltrate into the native soils if the percolation is
acceptable or a 10” pipe will release the flows at the pre-developed rate.

Re: Timberline Small Contractor Yard
Per your request, I have prepared a traffic analysis for the proposed Timberline Small
Contractor Yard commercial development which is located in Garfield County, Colorado. The
proposed commercial development consists of 5.0 acres. The attached Figure 1 depicts the
location of the site with respect to the surrounding area. The site is bounded by CR 240 on the
east and north, agricultural land on the west, and US 6 on the south.
Existing Roadway System
The proposed commercial development will obtain its access from CR 240 (Bruce Road). This
access is approximately 775 feet north of US 6. CR 240 is a two-lane , paved roadway. CR 240
begins at US 6 and ends at US 6 on the west, approximately 1.6 miles to the west. US 6 is a
two-lane arterial roadway that is under the jurisdiction of the Colorado Department of
Transportation. The intersection of CR 240 and US 6 is an unsignalized intersection with stop-
control on CR 240. The attached Figure 2 depicts the existing roadway network.
Trip Generation
The Institute of Transportation Engineers (ITE) Trip Generation report, 8 th Edition , was used to
estimate the number of vehicle trips the proposed commercial development will generate. The
proposed site is expected to be used by small contractors as their storage yard for equipment
and material. At most, the site is expected to have a maximum of 10 small contractors using the
yard.
ITE has a number of land use categories that could be used for this analysis. Land use
category 151 , mini-warehouse is the best fit for the proposed development. This land use
category is designed to be used for a typical storage facility which has storage units that are
about the size of a single car garage. Clearly, the proposed commercial development is not of
this nature. Each small contractor is going to use a larger piece of land than a single car
garage. For the purposes of this analysis, I am proposing to use the term "parcel" be used to
describe the space each small contractor is expected to use. The attached Table 1 depicts the
estimated vehicle trips for the proposed development based on ITE trip generation rates.
However, based on my experience, the ITE estimate in Table 1 underestimates the daily vehicle
trips that will be generated by the proposed development at full build out. Contractors use the
yard to pick up equipment and material in the morning and drop off the equipment and material
at the end of the day. Some of the contractors may visit the proposed commercial development
during the day, but it is not expected to be a regular occurrence for all ten contractors . If you
assume that each contractor visits the site in the morning and evening and 50 percent will visit
the site during the day. the proposed commercial development is expected to generate a total of
50 vehicle trips at full build out. This estimate seems more realistic based on how the site will
be used.
Total Traffic Volumes
The 2002 Transportation Study for Garfield County reported a daily traffic count for CR 240
(Bruce Road) of 175 daily vehicle trips . It is not know where this count was taken. If you
assume an annual growth rate of one percent, the estimated Year 2013 traffic volume is 195
daily vehicle trips. Adding the estimated site-generated traffic to this estimate, the total Year
2013 daily vehicle trips would be 245 daily vehicle trips. Site-generated traffic accounts for 20
percent of total traffic.
The resulting daily traffic estimate of 245 daily vehicle trips will not result in the need for
additional improvements to CR 240 or the intersection of US 6 and CR 240.
Conclusions
Based on the information contained in this report, the proposed Timberline Small Contractor
Yard will have a minimal impact to CR 240 (Bruce Road) and US 6 .

issuance of the permit does not assure the applicant
that no injury will occur to another vested water
right or preclude another owner of a vested water

APPLICATION CHECKLIST
Permit applications can be obtained and submitted to the Garfield County Community
Development Department at 108 sth Street, Suite401, Glenwood Springs, Colorado. See
below for additional information. All applications are required to be submitted in person.
PERMIT APPLICATION & SUBMITTAL REQUIREMENTS:
• Complete application.
• 1 Copy of a Site Plan that includes well, all streams, irrigation ditches, and any
water courses. Draw in your house, septic tank & system, detached garages,
and driveway. If a change of location is necessary, you must submit a corrected
drawing.
• Engineered System will need copy of perk rate and design for our records prior to
final inspection.

FINAL INSPECTION
• When all components are in place, connected and ready to cover, request a final
inspection by the County Inspector.
• DO NOT backfill any part of the system prior to the inspection.
• The initial fee covers the percolation test and one (1) inspection before cover up.
Any additional percolation test will be charged at $100.00 each and additional
inspections will be charged at $50.00 each.
• Upon final approval, carefully cover the entire system.
• Engineered Systems are inspected by the Engineer prior to backfill. A final sealed
letter by the Engineer is required to be submitted to Garfield County.

PERCOLATION TEST INSTRUCTIONS
• The successful operation of your septic system depends on the rate the soil in which your leach
field will be installed will accept water.
• THIS IS CRITICAL If instructions are not followed completely, technician may not do the
perk test and you wlll be charge a $50.00 fee for 2"" visit.
• The rate of absorption is called the percolation rate and it determines the size of the leach field
needed for a particular flow of sewage and in some cases even determines the feasibility of the
installation of a septic tank and leach field system.
• PERGOLA TION TEST MUST BE DONE AT THE GROUND DEPTH WHERE ABSORPTION
WILL TAKE PLACE. STANDARD LEACH FIELDS ARE INSTALLED THREE FEET DEEP,
SO THE 3 PERCOLATION HOLES ARE DUG FOUR FEET DEEP, AT LEAST 20 FEET
APART, IN A TRIANGLE SHAPE. THE PERCOLATION TEST IS DONE IN THE BOTTOM
ONE (1) FOOT OF THE HOLE.

A posthole digger, auger or backhoe can be used to dig the percolation test holes. If a back hoe is
used, dig the backhoe hole 3 feet deep, with 2 steps or a ramp. Put a test hole 1-foot deep and 8 to 12
inches in diameter in the bottom. Installation of absorption areas (i.e. drywells) deeper than three 3 feet
require the permission of the Environmental Health Department. All dry wells shall be designed by an
Engineer registered in the State of Colorado.
Saturation with water will affect the percolation rate, and since the system will be expected to operate
when the soil is saturated with water, THE LOWER TEST HOLE MUST BE FILLED WITH WATER AT
LEAST 8 HOURS BEFORE THE TEST AND ALLOWED TO STAND. More water will be needed to
perform the percolation test, so AT LEAST 5 GALLONS OF WATER PER HOLE SHOULD BE ON HAND
WHEN THE TEST IS PERFORMED.
AN 8 FOOT PROFILE HOLE IN THE LEACH FIELD AREA IS REQUIRED BY THE STATE OF
COLORADO TO DETERMINE THE PROXIMITY OF GROUND WATER AND BEDROCK. (One soil
profile hole shall be dug to provide observation of the soil profile of the area of the soil absorption system.
The hole shall be prepared at least 8 feet deep. The hole may be terminated when ground water or
bedrock is encountered. The hole shall be prepared in such a way as to provide identification of the soil
profile 4 feet below the bottom of the soil absorption system.)
If ground water Is found in any perk or profile hole, an engineered systems is required. Percolation
rates faster than 5 minutes per inch or slower than 60 minutes per inch require engineered system
and/ or Board of Health approval.
