Cerise Earl Rhodes Mildred Alsdorf , Commissioner Chairman , Commissioner , Commissioner , County Attorney , Clerk of the Board when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 83-165 A RESOLUTION CONCERNED WITH GRANTING AN EXEMPTION FROM THE GARFIELD COUNTY SUBDIVISION REGULATIONS FOR THE LOS AMIGOS RANCH PARTNERSHIP. WHEREAS, Los Amigos Ranch Partnership has petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption from the definition of the terms "subdivision" and "subdivided land" under C.R.S. 1973, 30-28-101 (10)(a) -(d), as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted January 2, 1979, Sections 2.02.21 (d) and 3.02.01 for the division of a 14.63 acre tract described as follows: A parcel of land situated in part of Government Lots 6, 10 and 11 in Section 5, Township 5 South, Range 88 West of the Sixth Principal Meridian in the County of Garfield, State of Colorado into 2 tracts of approximately 7.315 acres each, more or less, which proposed divided tracts are more particularly described as follows: TRACT A: A parcel of land situated in part of Government Lots 6, 10 and 11 in Section 5, Township 7 South, Range 88 West of the Sixth Principal Meridian being more particularly described as follows: Beginning at the Northeast Corner of Section 8 in said Township and Range, a stone corner found in place and properly marked; thence N. 60°02'19"W. 1048.55 feet; thence S.89°05'04"W. 58.67 feet to the True Point of Beginning; thence S.89°05'04"W. 302.15 feet; thence S.72°41'46"W. 501.54 feet; thence N.15°30'40"W. 389.18 feet; thence N.72°37'24"E. 298.91 feet; thence N.57°46'36"E. 378.00 feet; thence S.32°13'24"E. 255.00 feet; thence S.25°56'05"E. 329.27 feet to the True Point of Beginning, containing 7.315 acres, more or less. TRACT B: A parcel of land situated in part of Government Lots 6, 10 and 11 in Section 5, Township 7 South, Range 88 West of the Sixth Principal Meridian, being more particularly described as follows: Beginning at the Northeast Corner of Section 8 in said Township and Range, a stone corner found in place and properly marked; thence N.60°02'19"W. 1048.55 feet, the True Point of Beginning; thence S.89°05'04"W. 58.67 feet; thence N.25°56'05"W. 329.27 feet; thence N.32°13'24"W. 255.00 feet; thence N.57°46'36"E. 611.84 feet; thence S.25°44'45"E. 539.32 feet to a point on the northwesterly right-of-way line of County Road 114; thence S.67°49'48"W. 103.37 feet along said right-of-way line; thence 352.79 feet along the arc of a curve to the left along said right-of-way line, having a radius of 554.35 feet and a chord which bears S.49°35'54"W. 346.87 feet; thence S.31°21'59"W. 102.51 feet along said right-of-way line to the True Point of Beginning, containing 7.315 acres, more or less. (in the State of Colorado and County of Garfield); and • • iaf1oK 631 i; -i -G€237 WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that the proposed division does not fall within the purposes of Part 1, Article 28, Title 30, Colorado Revised Statutes 1973, as amended, for the reason that there will be no increase in the density of the land use; and WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that there is a reasonable probability of locating domestic water on each of said tracts, that there is adequate ingress and egress to said tracts, that the location of a central sewage system has been permitted by the Colorado Department of Health, and does not fall within the general purposes and intent of the subdivision regulations of the State of Colorado and the County of Garfield, and should, therefore, be exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. 1973, 30-28-101 (10) (a) -(d), as amended; NOW, THEREFORE, BE IT RESOLVED that the division of the above described tracts "A" and "B" from the above 14.63 acre tract is hereby exempted from such definitions and said tract may be divided into tracts "A" and "B", all as is more fully described above, and said divided tract may be conveyed in the form of such smaller tracts without further compliance with the aforesaid subdivision statutes and regulations; provided, however, that this exemption is granted on the condition and with the express understanding and agreement of the Petitioners that no further exemptions be allowed on said tracts "A" and "B", and that a copy of the instrument or instruments of conveyance when recorded shall be filed with this Resolution.
