L ISSUE
The initial request for Exemption was heard by the Board at the regular meeting on January 13,
ZOO3. During the discussion of the application by the Board members, it was determined that the
6p5 minoral Jwro listid in the application was not notified. The Board made a motion to
approve the Exemption, with the agreement that the Applicant would provide to the Board an
uinaurrit from the one mineral owner in order to finalize the review process.
During the process of contacting the one mineral owner, it was discovered by the Applicant that
there are several other mineral owners that needed to be contacted. Due to this oversight, the
Applicant re-noticed, re-published and re-posted the property. Therefore, a new public hearing is
required.

information below in the memorandum has remained unchanged from the January 13,2003,
meeting
IL DESCRIPTION OF THE PROPOSAL:
A. Development Proposal: The Applicant proposes to subdivide approximately 4#?cres of

B. Site Description: Parcel e$is the.otiginal hornestoad site which is''improved'ru(tittr varbus
reaidential and,agri-cultural buildings. There is an existing driveway that serves this Parcel off of
County Road 31i. Parcels 2 & 3 are vacant with scattered vegetation and fencing. Thes€'Iofr
slopedownward west frorn County Road 311 toward East Divide Creek. Parcel 1 is fairly flat
*d li"r at the intersection of County Roads 3 1 1 and 313. It appears that hay is stored on this
proposed parcel. There is an existing access point off of County Road 311 which the Applicant is
proposing to improve as the driveway to serve Parcel 1.

well-defined drainages that traverse the proposed Parcels. One of these drainages is located
between Parcels I & 2. The vegetation on the subject property consists of wheat-grasses' sage
brush, pinion, juniper, and cottonwoods.
C. Zoning: It appears possible to meet the A/R/RD zoningrequirements on the proposed
new lots. A single family dwelling is a use by right in the A/R/RD zone district. Accessory uses
are allowed if they are agriculturally related uses.
D. Relationship to the Comprehensive Plan: The subject property is designated on the
"Proposed Land Use Districts, Saldy Al az &3" map in the Garfi.eld County Comprehensive
ptai of 2000, as "Outlying Residenial." The recomrnendoddansity in the Outlying R6Sidential
designdion is consisterit with the underlying zoning, which in the case of A / R / RD is a'
mini$um lot area of 2 acres. Three of the four proposed parcels are slightly greater than2 acres.
Parcel 4 consists of 421 acres. The subject property is located outside of the 2 mile sphere of
influence for the City of Rifle.

E Adjacent Land Uses: Similar agricultural uses and sparse residential land uses surround
the site.
F. Road/Access: All"of"the.proposed fourlots will take access off of,County Road,31I at

G. Applicabilitv: Section 8:10 allows the Board of County Commissioners (Board) the
discretionary power to exempt a division of land from the definition of subdivision and, thereby,
from the procedure in Sections 3:00, 4:00 and 5:00, provided the Board determines that such
exemption will not impair or defeat the stated purpose of the Subdivision Regulations nor be
detrimental to the general public welfare.
III. REVIEW AGENCY AND OTHER COMMENTS:
The application was referred to the following agency (ies) for comments. Comments that were
received have been integrated throughout this memorandum where applicable.
A. Garfield County Road and Bridge: Exhibit H
B. Garfield County Vegetation Management: Exhibit I
C. Burning Mountain Fire Protection District provided comments which were included with
the application.
IV. REVIEW CRITERIA FOR SUBDMSION EXEMPTION (SECTION 8:00)
The Board has the discretionary power to exempt a division of land from the definition of
subdivision, and thereby, from the procedure in these Regulations, provided the Board
determines that such exemption will not impair or defeat the stated pu{pose of Subdivision
Regulations nor be determined to be detrimental to the general public welfare. The Board shall
not approve an exemption unless the Applicant has satisfied the following criteria.
A. "No more than a total offour (4) lots, parcels, interests or dwelling units will be created
from any parcel, as that parcel was described in the records of the Garfi.eld County Clerk and
Recorder's Office on January l, 1973, and is not a part of a recorded subdivision; however, any
parcel to be divided by exemption that is split by a public right-of-way (State or Federal-highway,
County road or railroad) or natural feature, preventing ioint use of the proposed
ticts, and the division occurs along the public right-of-way or natural feature, such parcels
thereby created may, in the discretion of the Board, not be considered to have been created by

exemption with regard to thefour (4) lot, parcel, interest or dwelling unit limitation otherwise
applicable; For the purposes of definttion, all tracts of land thirty-five (j5) acres or greater in
size, created after January l, 1973, will count as parcels of land created by exemption since
January l, 1973."
Response: Copies of the Applicant's deeds and the deeds by which their predecessors took title
before January l,lg73,were provided with the application. The deeds indicated that no parcels
have been split from the property since January 1,1973, and was larger than 35 acres at that time.
B. All Garfield County zoning requirements will be meL
Response: The subject property is located in the A/R/RD zone district which requires a
minimum lot size of 2 acres. All four tracts to be created are larger than} acres. To staff s
knowledge all zoning requirernents have been met as part of this application.
C. All lots created will have legal access to a public right-of-way and any necessary access
easements have been obtained or are in the process of being obtained.
Response: Parcel 4, thehomestead, has access onto County Road 31 1 via an existing legal
driveway. Parcel I will be served by an individual driveway onto County Road 311 near the
intersection of County Roads 311 and 313. Parcels2 & 3 will have a shared driveway onto
County Road 31 1. A shared driveway is considered a public road in the County, however, the
repair and maintenance of the driveway is the responsibility of the Homeowners Association or
the property owners. Since Parcels 2 & 3 will share a driveway off of County Road 3l 1, the
driveway shall meet County street and roadway design standards outlined in Section 9:35 of the
Subdivision Regulations. The proposed driveway falls under the street I rcadway standard of
"Primitive Residential".
The Applicant shall obtain and receive approval from the Road and Bridge Department for
driveway permits to serve the three new lots prior to installation of the driveways.
D. Provision has been madefor an adequate source of water in terms of both the legal and
physical quality, quantity and dependability, and a suitable type of sewage disposal to serve each
proposed lot.
Response: T?rc Applicant indicated that individual wells are proposed for Paroels l, 2 & 3. Tho '
Apptieant included in the application well pennits issued for the new Parcels (#244017,
#244018, and#244019) September 12,2002. These permits indicate that "the use of ground
water from the well is limited to fire protection, ordinary household purposes inside not more
than three (j) singlefamily dwetlings, the irrigation of not more than one (1) acre of home

gardens and lawns, and the watering of domestic animals."
Pursuant to Section 8:42 of the ZoningResolution, prior to the signing of a plat, all physical
water supplies shall demonstrate the following:
1. That afour (4) hour pump test be performed on the well to be used;
2. A well completion report demonstrating the depth of the well, the characteristics
of the aquifer and the static water level;
3. The results of thefour (4) hour pump test indicating the pumping rate in gallons
per minute and information showing drawdown and recharge;
4. A written opinion of the person conducting the well test that this well should be
adequate to supply water to the number of proposed lots;
5. An assumption of an average of no less than 3.5 people per dwelling unit, using
100 gallons of water per person, per day;
6. If th; well is to be shared, a legal, well sharing declaration which discusses all
easements and costs associated with the operation and maintenance of the system
and who will be responsiblefor paying these costs and how assessments will be
madefor these costs;
7. The water quatity be tested by an independent testing laboratory and meet State
guidelines concerning bacteria and nitrates-
For water supplies based on the use of cistern, the tank shall be a minimum of 1,000
gallons.

Regulations, "proof of physical supply of waterfor the public meeting may be documentation
from the Division of Wite, Resources that demonstrates that there are wells within % mile of the

site producing at liast five (5) gallons/minnte. " The Applicant submitted a pump test conducted
on tle existing well, on Parcel 4, in 1990. This well is located approximately 1,000 feet
northwest of the center of Lot 2 and serves the existing homestead. It appears that in 1990, the
well produced 10.0 gallons per minute.
Prior to signing the Exemption Plat, it is Staff s opinion that the Applicant shall provide a new
pump test for the existing well in accordance to Section 8:42 of the ZoningResolution, outlined
ubor", to verifo the dependability of the well. In addition, updated water quality tests shall be
conducted to determine quality of water produced by the existing well.
The Applicant indicated that sewage disposal for the Parcels will be handled by Individual
Sewage Disposal Systerns (ISDS).
E. All state and local environmental health and safety requirements have been met or are in

the process of being met.
Response: The Applicant shall comply with all applicable local and state environmental health
and safety requirements.
F. Provision has been madefor any required road or storm drainage improvements.
Response: Jake'Nf;hll;Garfield koad and Bridge, provided comment which can be seen in more
detail in Exhibit H. Mr. Mall provided the following recornmendations which have been
inmr.pmffod as conditions of approvali
A. The Road and Bridge Departrnent will issue driveway access permits for the two
requested locations with specified conditions in the driveway permit applications
B. The driveway access permit for the shared driveway (Parcels 2 & 3) shall be in the
location agreed upon, with the conditions that the old fence be removed, and the brush
and trees be removed from the existing corner fence going south for a distance no less
than 640 feet. The brush and trees shall be removed back to the new fence line.
C. The driveway permit for the single lot (Parcel 1) will be in the location agreed to and
the brush and trees on both sides of the driveway shall be rernoved for a distance of
no less than 200 feet to the north and 300 feet to the south, and a distance of no less
thatl2 feet from the edge of County Road 311.
D. The Road and Bridge Department also requests that a 30 foot easernent from the
center line of County Road 311 be deeded to the County on both sides of Road the
entire length of the subdivision. All existing fences and structures that may be within
this easernent shall be rernoved at the sudividers expense. This easement shall have
not restrictions on continued maintenance or future upgrades of County Road 3 1 1.
The Applicant did not indicate that storm drainage improvements are anticipated as part of this
development. Any improvement shall comply with County regulations as applicable.
There are a couple of well-defined drainages that traverse the subject property near the proposed
new Parcels. Any new structures shall avoid areas of natural drainage. Natural drainages should
be preserved to the maximum extent possible.
G. Fire protection has been approved by the appropriatefire district.
Response: The subject property is located in and served by the BiiiniigModntaiirFir8
Prdg€tiop,$listrict: A letter dated October 18,2002, from Da'ttiU Y6well, Fire Chief, was
submitted with the application. Mr. Yowell indicated that that the building areas shall be

mitigated for wildfire protection prior to construction and that driveways be adequately designed
for iccess and egress of fi." equipment. The Fire Department has no issuss with the proposed
ffidivisiom. The Applicant asserted that in addition to the Mr. Yowell recommendations each
new residence will be constructed with an internal fire suppression sprinkler system.
H. Any necessary drainage, iruigation or utility easements have been obtained or are in the
process of being obtained.
Response: The Applicant has not indicated any need for drainage, irrigation, or utility
easements. However, all easements, existing and proposed, must be shown on the Exemption
plat and included o, ih. deeds for the proposed parcels where appropriate. All new utilities shall
be buried.
I. Schoolfees, taxes and special assessments have been patd'
Response: The Applicant asserted that there are no outstanding fees, taxes or special
assessments associated with the subject property. The Applicant is required to pay the applicable
school site acquisition fee, as adopted UV tt " County, for each newly created lot as part of the
subdivision exemption process according to the calculations / regulations in effect at the time of
submission for approva-l of the Final Plat. Pursuant to section 8:a2$) of the Subdivision
Regulation schoof fee, taxes and special assessments for each lot created is $200.00 per lot.
Y. ADDITIONAL CONSIDERATIONS FOR SUBDIVISION EXEMPTION
(SECTION 8:60)
In the evaluation of each petition for exemption, and in addition to the review criteria in Section
8:52, the Board shall consider the following additional considerations'
A. General conformation with the Garfield County Comprehensive Plan'
Response: The proposal does not appear to be inconsistent with the Garfield County
Comprehensive Plan.
B. Compatibility of the proposed exemption with existing land uses in the surrounding area.
Response: The subject property appears to be compatible with the land uses in the surrounding
area. The surrounding uses include a residential with customary agricultural uses.
C. Recommendations of any municipality within two (2) miles of the proposed exemption, or
within three (3) miles, if the municipality has a major street plan.

Response: Twin Creek Game Ranch is located outside of the Sphere of Influence for the City of
Rifle. This request as not referred to the City for comments'
D. Recommendations of any state or local agency or organization whose opinion the Board
determines is necessary or appropriate.
Response: Comments from applicable state or local agencies have been incorporated within this
memorandum as approPriate.
E. Suitability of soil, water, vegetation, geologic and topographic characteristics of the land
for the type of division ProPosed.
Response: According to the soil survey, from USDA Soil and Conservation Service, the soils on
the subject property consist of Kim loam - #41 (6 to 12 percent slopes), Torrifluvents #65 (nearly
level), irotts loam #54 (l to 3 percent slopes), Potts loam #55 (3 to 6 percent slopes), Potts loam
#56 (6to 12 percent slopes, and Torriorthents-Camborthids-Rock outcrop complex #66 (steep)'
The interpretation tables for these types of soils can be seen in greater detail in the application'
The issue of water and topography has been addressed previously in this memorandum. The
application does not addrlss geologic hazards on the subject property. All geologic hazards shall
be mitigated accordingly per County regulations.

more detail in Exhibit I. Mr. ,t rthory provided the following comments which have been
incorporated as conditions of approval:
A. The Applicant shall map and inventory the Parcels for any listed Garfield County
Noxious Weeds. Noxious weeds that may be found in the subject area include
Russian knapweed, hoary cress (whitetop), and houndstongue.
B. The Applicant shall provide a Weed Management Plan that is specific to the
inventoried noxious weeds.
F. Number of lots and/or multiple-dwelling units created by the proposed exemption.
Response: The Applicant is proposing four lots. Parcel 4 is already improved with various
struitures. only onl single-famiiy owetting unit is proposed on each new lot as a use-by-right'

Response: No open space is proposed as part of this exemption request.
H. Proposed density and provisions for adequate offstreet parking.
Response: All parking associated with the proposed lots will be handled on-site.
L Covenants and plat notes, restricting the lots to thefollowing:
l. One (l) dog wilt be allowedfor each residential unit within a subdivision and the
dog shall bi required to be confined within the ownerb property boundaries. The
requirements sialt be included in the protective covenants for the subdivision with
enforcement provisions allowingfor the removal of a dogfrom the area as afinal
remedy in worst cases;
2. No open hearth solid-fuelfi.replaces will be allowed anywhere within an exemption.
One (l) new solid-fuei burntng stove as defined by C.R.S. 25-7-401, et. seq., and the
regulations promilgated thereunder, will be allowed in any dwelling unit. All
dielling units will be allowed an unrestricted number of natural gas burning stoves
and appliances; and
3. Each subdivision shall have covenants requiring that all exterior lighting be the
minimum amount necessdry and that all exterior lighting be directed inward, towards
the interior of the subdivision, except that provisions may be made to allowfor safety
lighting that goes beyond the property boundaries.
Response: The Applicant shall comply with these restrictions. They shall also be included in
the Protective Covenants and as plat notes on the Exernption Plat.
VI. OTHER
1. Mineral Riglrts: The Applicant provided a list of mineral owners in the application.
Since pot*tiA for-mineral exploration may exist, a disclosure to all potential lot owners must be
included in the covenants, plat notes, and at the time of closing'
VII. STAFF FINDINGS:
l. proper posting and public notice was provided as required for the meeting before the
Board of County Commissioners.
2. The meeting before the Board of County Commissioners was extensive and complete,
that all pertinent facts, matters and issues were submitted and that all interested
parties were heard at that meeting'

County.
4. The application has met the requirements of the Garfield County Subdivision
Resolution of 1984, Section 8:00, Exernption'
V[I. RECOMMENDATION:

l. All representations made by the Applicant, either within the application or stated at the
meeting before the Board of Coun^ty Commissioners, shall be considered conditions of
approval;
2. The Applicant shall have 120 days to present an F,xemption Plat to the Commissioners
for signatpre from the date of conditional approval of the exemption;
3. The 1978 Garfield County ZoningResolution standards shall be complied with'
4. The Colorado Department of Health standards shall be complied with.
5. A Shared Access Driveway Agreement shall be filed for Parcels 2 &3, with appropriate
signatures, with the Exemption Plat.
6. The Applicant shall comply with the recommendations of the Burning Mountains Fire
Protection District which include:
A. New residences shall be constructed with an internal fire suppression sprinkler
sYstem.
B. Building areas shall be mitigated for wildfire protection prior to construction.
C. Driveways shall be adequately designed for access and egress of fire equipment'
7. The Applicant shall comply with the recommendations of the Garfield County Road and
Bridge DePartment as follows:

A. The Applicant shall obtain and receive approval of driveway access permits for the
new driveways prior to installation.
B. In the location of the shared driveway for Parcels 2 & 3, the old fence shall be
rernoved and the brush and trees shall also be rernoved from the existing corner of the
fence going south for a distance of no less than 640 feet. The brush and trees shall be
rernoved back to the new fence line.
C. For parcel 1, the brush and trees on both sides of the proposed driveway shall be
removed for a distance of no less than 200 feet to the north and 300 feet to the south,
and a distance of no less than 12 feet from the edge of County Road 3 1 1 '
D. A 30 foot easernent from the centerline of County Road 311 shall be deeded to the
County on both sides of the Road the entire length of the subdivision. Al1 existing
fences and/or structures located within this easernent shall be rernoved at the expense
of the subdivider. This easement shall have no restrictions on continued maintenance
or future upgrades of County Road 31 1.
Due to the potential for mineral exploration on the subject Parcels, the Applicant shall
provide disclosure to all potential lot owners via the Protective Covenants, as a note on
the Exemption Plat and at the time of closing.
Prior to the finalization of the Exernption Plat, the Applicant shall:
A. provide to the County Vegetation Management Department a map and inventory of
any listed Garfield County Noxious Weeds on the project area. A Weed Management
plan shall be submitted to the County that is specific to the inventoried noxious weeds
for review and approval by the Vegetation Management Department.
B. provide a new pump test for the existing well, as outlined in 9(C) below, to veriff that
dependabillty of tne well. An updated water quality test shall also be conducted and
submitted to determine the quality of water produced from the existing well.
C. A11physical water supplies shall dernonstrate the following:

The following information shall be delineated on the Exernption Plat:
A. A 30 foot easement, dedicated to the County, measured from the center line of County
Road 3l I on both sides of the Road the entire length of the subdivision, where
appropriate.
That the following plat notes shall appear on the Exernption Plat:
A. Existing and proposed easements for utilities, driveway, and irrigation. These
easernents shall be included on the deeds for the proposed lots, where appropriate.
All new utilities shall be buried.
B. Atl new structures or uses shall avoid areas of natural drainage to the maximum
extent possible.
C. One (1) dog will be allowed for each residential unit and the dog shall be required to
be confined within the owner's property boundaries.

D. No open hearth solid-fuel fireplaces witl be allowed anywhere within an exemption'

I. DESCRIPTION OF THE PROPOSAL:
A. Development ProLosal: The Applicant proposes to suMivide approximately 429 acres of
land into four (a) parcels consisting of the following lot areas:

B. Site Description: parcel4 is the original homestead site which is improved with various
residential and ugrrr.rlt*ul buildings. There is an existing driveunay that serves this Parcel offof
County Road 31i. Parcels} &,3 are vacant with scattered vegetation and fencing. These lots
slope downward west from County Road 31 1 toward East Divide Creek. Parcel I is fairly flat
*d lim at the intersection of County Roads 3 1 1 and 3 13. It appears that hay is stored on this
proposed parcel. There is an eristing access point off of Cotrnty Road 3l I which the Applicant
is proposing to improve as the driveway to serve Parcel 1.
The Applicant designated "approximate" building sites on the site map for Parcels 1,2, &,3.
rnese truitaing sites are locaied on fairly level areas of the proposed Parcels. There are a couple
well-defined drainages that traverse the proposed Parcels. One of these drainages is located
between Parcels | &,2. The vegetation on the subject property consists of wheat-grasses, sage
brush, pinion, juniper, and cottonwoods.
C. Zoning: It appears possible to meet the A/RIRD zoning requirements on the proposed
,rr* lotr. A rirgle family dwelling is a use by right in the A/R/RD zone district. Accessory uses
are allowed if they are agriculturally related uses.
D. Relationshio to the Comprehensive Plan: The subject property is designated on the
.?ropos"d Land Ur" bistricts, Study Area2 &3" map in the Garfield County Comprehensive
plan of 2000, as .'Ogtlying Residential." The recommended density in the Outlying Residential
designation is consistent with the underlying zoring,which in the case of A / R / RD is a
minimum lot area of 2 acres. Three of the four proposed parcels are slightly greater than2 aores.
parcel4 consists of 421acres. The subject properly is located outside of the 2 mile sphere of
influence for the City of Rifle,
E. Adjacent Land Uses: Similar agricultural uses and sparse residential land uses surround
the site.
F. Road/Access: All of the proposed four lots will take access offof County Road 311 at
different points. fot + currently hasan existing driveway off of CR 311. Lots 2 &.3 will have a
shared driveway offof CR 3tt. t-ot 1 will have an access driveway offof CR 311 near the
intersection of CR 311 and 313.
G. Apglicabilitlr: Section 8:10 allows the Board of County Commissioners (Board) the
discretionary porn"ito exempt a division of land from the definition of subdivision and, thereby,
from the pro..d*. in Sections 3:00,4:00 and 5:00, provided the Board determines that such
exemption will not impair or defeat the stated purpose of the Subdivision Regulations nor be
detrimental to the general public welfare,

m REVTEW CRTTERIA FOR SUBDTVISION EXEMPTION (SECTION 8:00)
The Board has the discretionary power to exemp a division of land from the definition of
subdivision, and thereby, fromihe procedure in these Regulations, provided the Board
determines that such e*emption wiil not impair or defeat the stated purpose of Subdivision
Regrrlations nor be determined to be detrimintal to the general public welfare. The Board shall
not approve an exemption unless the Applicant has satisfied the following oriteria.
A. ,,No more lhan a lotal of four (4) lots, parcels, inleresls or dwelling units will be created
from any parcel, as that parc"iiot described in the records of the Garfield County Clerk and

Response: Copies of the Applicant's deeds and the deeds by which their predecessors took title
before January 1, 1973, were provided with the application. The deeds indicated that no parcels
have been split from the property since January l, !g73,and was larger than 35 acres at that
time.

Response: The subject property is located in the AIR/RD zone district which requires a

C. Ail lots created will have legal access to a public right-of-way and any necessary access
easements have been obtained or are in the process of being obtained.
Response: Parcel 4, the homestead, has access onto County Road 31 1 via an existing legal

County Road 31 1. Ashared driveway is considered a public road in the County, however' the
repair and maintenanoe of the driveway is the responsibility of the Homeowners Association or
the property owrers. Since Parcels 2 &, 3 will share a driveway off of County Road 3 I 1' the
drivlwav.irull *r.t County street and roadway design standards outlined in Section 9:35 of the

The Applicant shall obtain and receive approval from the Road and Bridge Department for
driveway permits to serve the three new lots prior to installation of the driveways.

Response: The Applicant indicated that individual wells are proposed for Parcels 1,2 & 3. The

Parcel 4 wilt be served by an existing well. Pursuant to section 8:a2p) of the Subdivision

'site protlucing at leastfive (5) gullons/minute." The Applicant submitted a pump test conducted
o1th. existing well, on Parcel 4, in 1990. This well is located approximately 1,000 feet
northwest of the center of Lot 2 andserves the existing homestead. It appears that in 1990, the
well produced 10.0 gallons per minute.
Prior to signing the Exemption Plat, it is Staff s opinion that the Applicant shall provide a new
pump test-for the existing well in accordance to Section 8:42 of the ZoningResolution, outlined
ubor", to verify the depe;dability of the well. In addition, updated water quality tests shall be
conducted to determine quatity of water produced by the existing well'
The Applicant indicated that sewage disposal for the Parcels will be handled by Individual
Sewage Disposal Systems [SDS).
E. All state ancl local environmental health und saJbty requirements huve been met or are in
the process o/'being met.
Response: The Applicant shall comply with all applicable local and state environmental health
and safety requirements.
F. Provision has been made Jbr uny required road or storm drainage improvements.
Response: Jake Mall, Garfield Road and Bridge, provided comment which can be seen in more
detail in Exhibit H. Mr. Mall provided the following_recommendations which have been
incorporated as conditions of approval:
A. The Road and Bridge Department will issue driveway access permits for the two
requested locations with specified conditions in the driveway permit applications.

B. The driveway access permit for the shared driveway (Parcels 2 &,3) shall be in the
location agreed upon,with the conditions that the old fence be removed, and the
brush andJrees be removed from the existing corner fence going south for a distance
no less than 640 feet, The brush and trees shall be removed back to the new fence
line.
C. The driveway permit for the single lot (Parcel 1) will be in the location agreed to and
the brush *O trr.r on both sides of the driveway shall be removed for a distance of
no less than 200 feet to the north and 300 feet to the south, and a distance of no less
than 72 feet from the edge of County Road 3 1 1.
D. The Road and Bridge Department also requests that a 30 foot easement from the
center line of County Road 311 be deeded to the County on both sides of Road the
entire length of the subdivision. All existing fences and structures that may be within
this easement shall be removed at the sudividers expense. This easement shall have
not restrictions on continued maintenance or future upgrades of County Road 311.
The Applicant did not indicate that storm drainage improvements are anticipated as part of this
development. Any improvement shall comply with County regulations as applicable.
There are a couple of well-defined drainages that traverse the subject property near the proposed
new parcels. Any new structures shall uroiO areas of natural drainage. Natural drainages should
be preserved to the maximum extent possible.
G. Fire protection has been apprutved by the appropriate fire district.
Response: The subject property is located in and served by the Burning Mountain Fire
protection District.

letteidated Octoher 18,2002,from David Yowell, Fire Chief, was
submitted with the application. Mr. Yowell indicated that that the building areas shall be
mitigated for wildfire'potection prior to construction and that driveways be adequately designed
for Jccess and egress of frr. equipment. The Fire Department has no issues with the proposed
subdivision. The Applicant asierted that in addition to the Mr. Yowell recommendations each
new residence will be constructed with an internal fire suppression sprinkler system'
H. Any necessary drainage, irrigation or utility easements have been obtained or are in the
process of being obtained.
Response: The Applicant has not indicated any need for drainage, irrigation, or utility
easements. However, all easements, existing and proposed, must be shown on the Exemption
plat and included on the deeds for the proposed parcels where appropriate. A11 new utilities
shall be buried.

Response: The Applicant asserted that there are no outstanding t'ees, taxes or special
assessments associated with the subject property. Since this request is an Exemption from the
definition of subdivision, according to Senate Bill 15, the Applicant is not required to pay the
school impact fee of $200.000 for each lot created as required in Section 8:a2(I) of the
Subdivision Regulations.
IV. ADDITIONAL CONSIDERATIONS FOR SUBDTVISION EXEMPTION
(SECTION 8:60)
In the evaluation of each petition for exemption, and in addition to the review criteria in Section
8:52, the Board shall consider the following additional considerations.
A. General confbrmation with the Gar/ield County Comprehensive Plun.
Response: The proposal does not appear to be inconsistent with the Gartleld County
Comprehensive Plan.
B. Compatibility t{'the proposed exemption with existing lancl uses in the surrouruling areu.
Response: The subject property appears to be compatible with the land uses in the surrounding
area. The surrounding uses include a residential with customary agriculfural uses.

Response: According to the soil suvey, from USDA Soil and Conservation Service, the soils on
the subject property consist of Kim loam - #41(6 to 12 percent slopes), Torrifluvents #65 (nearly
level), Fotts toam #54 (1 to 3 percent slopes), Potts loam #55 (3 to 6 percent slopes), Potts loam
#56 (6to 12 percent slopes, and Torriorthents-Camborthids-Rock outcrop complex #66 (steep).
The interpretation tables for these types of soils can be seen in gteater detail in the application.
The issue of water and topography has been addressed previously in this memorandum. The
application does not address geologic hazards on the subject property^ All geologic hazards shall
be mitigated accordingly per County regulations.
Steve Anthony, Director of Vegetation Management, provided comments which can be seen in
more detail in Exhibit L IvIr. Anthony provided the following comments which have been
incorporated as conditions of approval:
A. The Applicant shall map and inventory the Parcels for any listed Garfield County
Noxious Weeds. Noxious weeds that may be found inthe subject area include
Russian knapweed, hoary cress (whitetop), and houndstongue.
B. The Applicant shall provide a Weed Management Plan that is specitic to the
inventoried noxious weeds.
F. Number of lots and/or multiple-dwelling units created by the proposed exemption.
Response: The Applicant is proposing four lots. Parcel 4 is already improved with various
structures. Only one single-family dwelling unit is proposed on each new lot as a use-by-right.
Accessory dwelling units require special use approval.
G. Provision/br open space within the proposed exemption.
Response: No open space is proposed as part of this exemption request.
H. Proposecl density ancl provisions Jbr adequate o/l-street purking.

1. Mineral Rishts: The Applicant provided a list of mineral owners in the application.
Since potential for mineral exploration may exist, a disclosure to all potential lot owners must be
included in the covenants, plat notes, and at the time of closing.
VI. STAFF FINDINGS:
1. Proper posting and public notice was provided as required for the meeting before the
Board of Counff Commissioners.
2. The meeting before the Board of County Commissioners wuts extensive and complete,
that all pertinent facts, matters and issues were submitted and that all interested
parties were heard atthatmeeting.
3. The proposed exemption has been determined to be in the best interest of the health,
safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield
County.

4. The application has met the requirements of the Garfield County Subdivision
Resolution of 1984, Section 8:00, Exemption.
VII. RECOMMENI}ATION:
Staff recommends that the Board APPROVE the Langegger Exemption, subject to the following
conditions:
l. All representations made by the Applicant, either within the application or stated at the
meeting before the Board of County Commissioners, shall be considered conditions of
approval;
2. The Applicant shall have llQjgyg to present an Exemption Plat to the Commissioners
for signature ttom the date of conditional approval of the exemption;
3. The 1978 Garfield County ZoningResolution standards shall be complied with.
4. The Colorado Department of Health standards shall be complied with.
5. A Shared Access Driveway Agreement shall be filed for Parcels 2 & 3, with appropriate
signahres, with the Exemption Plat.
6. The Applicant shall comply with the recommendations of the Burning Mountains Fire
Protection District rvhich include:
A. New residences shall be constructed with an internal fire suppression sprinkler
system.
B. Building areas shall be mitigated for wildfire protection prior to construction-
C. Driveways shall be adequately designed for access and egress of fire equipment.
7. The Applicant shall comply with the recommendations of the Garflreld County Road and
Bridge Department as follows:
A. The Applicant shall obtain and receive approval of driveway access permits for the
new driveways prior to installation.

B. In the location of the shared driveway for Parcels 2 &.3,the old fence shall be

Courty on both sides of the Road the entire length of the subdivision. All existing
fences andlor structures located within this easement shall be removed at the expense
of the subdivider. This easement shall have no restrictions on continued maintenance
or future upgrades of County Road 31 1.
Due to the potential for mineral exploration on the subject Parcels, the Applicant shall
provide disclosure to all potential lot owners via the Protective Covenants, as a note on
the Exemption Plat and at the time of closing.
Prior to the finalization of the Exemption Plat, the Applicant shall:
A. Provide to the County Vegetation Management Department a map and inventory of
any listed Gartield County Noxious Weeds on the project area. A Weed Management
plan shall be submitted to the County that is specific to the inventoried noxious
weeds for review and approval by the Vegetation Management Department'
B. Provide a new pump test for the existing well, as outlined in 9(C) below, to verify
that dependaUiiity of tn. rvell. An updated water quality test shall also be conducted
and submi6ed to determine the quality of water produced from the existing well.
C. All physical water supplies shall demonstrate the following:
1) That a four (4) hour pump test be performed on the well to be used.
Z) Awell completion report demonstrating the depth of the well, the characteristics
of the aquifer and the static water level.
3) The results of the four (4) hour pump test indicating the pumping rate in gallons
per minute and information showing drawdown and recharge.

4) A written opinion of the person conducting the well test that this well should be
adequate to supply water to the number of proposed lots.
5) An assumption of an average of no less than 3.5 people per dwelling unit, using
100 gallons of water per person, per day.
6) If the well is to be shared, a legal, well sharing declaration which discusses all
easements and costs associated with the operation and maintenance of the system
and who will be responsible for paying these costs and how assessments will be
made for these costs.
7) The water qualrty shall be tested by an independent testing laboratory and meet
State guidelines concerning bacteria and nitrates.
8) For water supplies based on the use of cistern, the tank shall be a minimum of
1000 gallons.
The following information shall be delineated on the Exemption Plat:
A. A 30 foot easement, dedicated to the County, measured from the center line of
County Road 311 on both sides of the Road the entire length of the subdivision,
where appropriate.
11. That the following plat notes shall appear on the Exemption Plat
A. Existing and proposed easements for utilities, driveway, and irrigation. These
easements shall be included on the deeds for the proposed lots, where appropriate.
All new utilities shall be buried.
B. All new structures or uses shall avoid areas of natural drainage to the maximum
extent possible.
C. One (1) dog will be allowed for each residential unit and the dog shall be required to

E. All extenor lighting will be the minimum amount necessary and all exterior lighting
will be directed inward, towards the interior of the subdivision, except that provisions
may be made to allow tbr sat'ety lighting that goes beyond the property boundaries.
F. No further divisions by exemption from the rules of Subdivision will be allowed.
G. Slopes exceeding 40% shall be restricted from development. Areas of disturbance
shall bc rcvcgctatcd with appropriatc vcgctation. Cut and fill arcas shall bc kcpt in
balance and to a mirumum. Disturbance of the existing vegetative cover shall be
minimized.
H. Geologic Hazards on the Parcels shall be mitigated per County regulations.
l. Foundations and lndividual Sewage Disposal Systems shall be engineered by a
Professional Registered Engineer within the State of Colorado.
J. Colorado is a "Right-to-Farm" State pursuant to C.R.S. 35-3-101, et seq.
Landowners, residents and visitors must be prepared to accept the activities, sights,
sounds and smells of Garfield County's agricultural operations as a normal and
necessary aspect of living in a County with a strong rural character and a healthy
ranching sector. All must be prepared to encounter noises, odor, lights, mud, dust,
smoke chemicals, machinery on public roads, livestock on public roads, storage and
disposal of manure, and the application by spraying or otherwise of chemical
fertilizers, soil amendments, herbicides, and pesticides, any one or more of which
may naturally occur as a part of a legal and non-negligent agricultural operations.
K. Atl owners of land, whether ranch or residence, have obligations under State law and
County regulations with regard to the maintenance of fences and inigation ditches,
controlling weeds, keeping livestock and pets under control, using property in
accordance with zoning, and other aspects of using and maintaining properly.
Residents and landowners are encouraged to learn about these rights and
responsibilities and ast as good neighbors and citizens of thc County. A good
introductory source for such information is "A Guide to Rural Living & Small Scale

f Oe-forrlorthents-Camborthids-Bock outcrop com'- plex, steep. This broadly defined unit consists of ex--posed
sandstone and shale bedrock, loose stones, and
soils that are shallow to deep over sandstone and shale
bedrock and stony basaltic alluvium. This complex
occurs throughout the survey area. The soils and out'
crops are moderately steep to very steep. Slope ranges
from 15 to 70 Percent.
Torriorthents make up about 45 percent of the com-
plex, Gamborthids make up 20 percent, and Rock out-
crop makes up 15 percent. The Torriorthents are on
tooihitts and rirountainsides below Rock outcrop. The
moderately steep Camborthids are on lower toe slopes
and concave open areas on foothills and mountainsides.
Torriorthents are shallow to moderately deep. They
are generally clayey to loamy and contain variable
amounts of lravel, cobbles, and stones. The surface is
normally covered with stones weathered from the higher-
lying Rock outcrop. South of the Colorado River, basaltic
stones and cobbles are on the surface.
Camborthids are shallow to deep. They are generally
clayey to loamy and have slightly more clay in the sub-
soil tiran in th6 surface layer. The surlace layer is light
colored. The profile is normally free of stones, but scat-
tered basalt stones, cobbles, and sandstone lragments
are on the surface.
The Rock outcrop is mainly Mesa Verde sandstone
and Wasatch shale. Some areas are covered with basal-
tic boulders and stones' Small areas of limestone out-
crops and exposed gypsum are in the eastern part of the
survey area.
lnciuded in mapping are small, isolated areas of llde-
fonso, Lazeat, Ansari, Begay, Heldt, and Dollard soils.
These intermittent areas make up 10 to 20 percent of
this map unit.
This complex is used for grazing, wildlife habitat, and
recreation.
The stones on the surface and the steep slopes make
this complex unsuitable for crops. Some areas can be
reseeded to pasture by broadcast seeding- Other plant-
ing methods are made ditficult by the stones and slopes'
The native vegetation includes wheatgrasses, blue-
grasses, lndian iicegrass, needlegrasses, bitterbrush,
irountainmahogany, sagebrush, and an overstory of
pinyon and iuniPer.' fne value of grazing is fair. The vegetation should be
managed to maintain wood production and limited graz-
ing. Selectively thinning the pinyon and junper improves
grizing and provides firewood and posts. Steep slopes,
iroderate to severe erosion hazard, and slow regroMh
of trees affect harvesting and management.
Most of this complex is a prime wintering area for
deer. Rabbits, coyote, and a few elk also find food and
cover on this comPlex'
Building is limited by steep slopes and stoniness.
These limitations can be overcome by appropriate
design and construction.
