Langegger (hereinafter the Declarant), owner in fee ofthat real property described as Lot
2 andlot 3 ofthe Twin Creek Game Farm Subdivision Exemption, Garfield County,
Colorado.
RECITALS
The Declarant is the owner and subdivider oftwo tracts of land known as Lot 2 and Lot
3, Twin Creek Game Farm Subdivision Exemption, Garfield County, Colorado and, by
this Declaration, intend to grant and dedicate joint and common rights to the use of a
private driveway serving the Lots, and impose on the Parcels, as covenants running with
the land, the obligation to jointly maintain the driveway.
ROAD EASEMENT
SECTION 2.OI
The Declarant hereby grant and dedicate unto the owners oflot 2 and Lot 3, Twin Creek
Game Farm Subdivision Exemption Plat, their heirs, successors and assigns, a non-
exclusive easement upon, over and across that, portion of said Lots, designated as a
driveway easement on the final plat of the Twin Creek Game Farm Subdivision
Exemption as recorded in the office ofthe Garfield County Clerk and Recorder, at
Reception No for use by the owners of the respective Lots, their
successors, assigns, agents, employees, tenants, guests and invitees, for a private access
road, and utility purposes, subject to the terms, conditions and provisions hereinafter set
forth.
SECTION 2.02
The term ofthe road easement herein granted shall be perpetual

SECTION 2.03
The cost of repair, maintenancg clearing, trash removal, snow plowing, and other
expenses of upkeep and preservation ofthe easement shall be the sole responsibility of
said Lot 2 andlot 3, Twin Creek Game Farm Subdivision Exemptiorq and such costs
shall be shared by the owners of the respective lots, one-half (l/2) to Lot 2 and one-half
(lt2)tolot 3. Routine repairs, paving clearing, trash removal and snow plowing will be
conducted from time to time, as deemed necessary by the Lot owners.
EI\TFORCEMENT
This Agreement and the terms, conditions and provisions hereof may be enforced by the
owner of either of the Lots, their successors and assigns, and in the event legal
proceedings are brought against any party for the purpose of such enforcement, the
prevailing pa^rty or parties shall recover from the non-prevailing party or parties all costs
associated therewit[ including but not limited to, reasonable attorney's fees.
The owner of each Lot agrees tha! upon request of any of the other owner, will certiS
from time to time to any person designated whether there are any breaches of this
agreement. If any party fails to respond to such request within ten (10) days of the date
of the request, any existing breach of the agreement shall be deemed waived by the non-
respondent.
EASEMENT SERVICE AREA
Use of the easement shall be restricted to access to and from the respective Lots. The
easement may not be used for the parking or storage of vehicles or equipment. The road
easement is subject to the dedication of utility easements set forth on the recorded plat of
the Twin Creek Game Farm Subdivision Exemption..

UTILITMS
The owners of the Lots have ganted on the final plat of the Twin Creek Game Farm
Subdivision Exemption, a perpetual, non-exclusive easement to use the road easement for
the purpose of providing utility service to the Lots or for the repar, maintenance, removal
or replacement of said utilities. All instrumentalities, lines, or facilities placed in the road
easement shall be maintained in a safe condition by the respective utility company or
governmental agency. No grantee of a utility easement under the final plat shall in the
use, construction, operation, maintenance, or repair of any utility in any way
unreasonably obstruct or delay the use of the roadway easement granted herein.

SPECIAL USES
Under no circumstances shall road or access be denied to or from any Lots over and
across the road easement for emergency vehicleg maintenance equipment, and
government officials while on official business.

SUBSEQIIENT OWI\IERS
The easement granted herein is appurtenant to the respective Lots in the Twin Creek
Game Farm Subdivision Exemption and such easement may not be transferred, assigned
or @nveyed apart or separately from the respective Lots which benefit from the
easement.
AII provisions of this agreement, including all benefits and burdens, shall run with the
respective Lots subject hereto and shall be binding upon and shall inure to the benefit of
the heirs, assigns, successors and personal representatives ofthe Declarant, subject to the
provisions hereof.
IN WITNESS WHEREOF, the Declarant has executed this Declaration as of the day and
year first set forth.

I visited Mr. Langeggar's property on June 11,2003. The area is relatively weed free with the exception
of a few burdock plants on the south end of the project area. Mr. Langeggar indicated that he would take
care of those, so I have no further concerns or issues with noxious weeds at this time regarding this special
use permit.

Dear Ms. Pregl:
Attached herewith are three copies of the Exemption Plat and supplemental information
as listed in you letter of February 18, 2OO3. Following review and comment by the
County Surveyor, signed mylars will be provided. Following is an item by item
response to the elements listed in your letter.
1. No submission required.

5. A shared driveway agreement is attached herewith.
The three recommendations the Fire District have been included as notes on the
Exemption Plat.
7. Recommendations A, B & C have been implemented and the Garfield County
,.rDriveway Permits are attached herewith. Recommendation D has been
incorporated on the Exemption Plat.
8. A note regarding mineral rights has been added to the Exemption Plat.
Currently no covenants are proposed for the properties.
9. A: Mr. Langegger has an ongoing weed control program at the Twin Creek
Game Farm and noxious weeds are full under control on the property.

a list of comments or corrections to be made prior to approval for survey content and

annotated on the plat. If it is dedicated land then it should not be referred to as an
easement.
2. Surveyors certificate should reflect the year 2003.
