Hello,
Thank you for the information. I am copying Chris Broadhurst who is the Ditch President. It was my understanding that
this side ditch did not continue on to any other parcels.
We can definitely amend the easement if that is what is required.
As the crew wants to get the foundation set before the weather turns, is there any way to approve the permit with the
condition that no deck piers will be constructed (the only structure in the current setback) prior to the easement
amendment?
Let us know how to start this process of amending and we will get right on it!

Hi Dana,
Please see our comments below regarding work in the ditch setback. The biggest issue is the existing recorded
easement, which does not allow us to approve permanent structures within that easement. The options are to relocate
the improvements out of the setback, or to amend the recorded easement.
The owners being served by the ditch downstream should be informed of the proposed improvements, and to amend
the recorded easement. Please direct additional questions or concerns to our planning department, either Kathy Eastley
or Tamra Allen.

Good thought Dave. There are I think 3 people the lateral serves on the opposite side of CR 112. The architect should
contact these folks. I believe the parcel numbers are 239323100363, 239323100364, and 239323100373.

Please see the response below regarding a letter from the ditch company for structures, crossings, and landscaping in
the easement. Perhaps the person the ditch serves may need to provide a letter regarding the crossings and landscape.
The recorded easement is still more restrictive, especially for the structure. Your thoughts are always welcomed.

The ditch you are showing on your drawings is a side ditch off of the Park Ditch we do not regulate anything after it
comes off of the Main Ditch. Let us know if you need anything else.

Thank you for your time yesterday. As discussed please find the site plan with some added dimensions for your
reference.
We will need a letter that says that landscaping, piers for wood decking, bridge over ditch (reusing existing piers) and a
roof overhang are acceptable in the 15'-0" easement for the ditch. Please give me a call if you have any questions.
