HomeMy WebLinkAbout3.0 Director's DeterminationA, Garfield County I BUILDING & PLANNING DEPARTMENT May 7, 2010 Jon Fredericks LandWest 345 Colorado Ave. #106 Carbondale, CO 81623 DIRECTOR DETERMINATION - Floodplain Development Permit TCI Lane Ranch PUD — Garfield County File Number FDPA6264 Dear Jon, This letter is provided regarding the Director Determination of a request for a Floodplain Development Permit for TCI Lane Ranch PUD. This request is to allow for: • The construction of a pedestrian bridge over the Roaring Fork River, commencing at the southeastern portion of the TCI Lane Ranch development to the Roaring Fork Transit Authority Trail located on the south side of the river. The construction would require an abutment as well as placement of a bridge pier in the Floodway; and • To allow for fill on residential lots located within the Flood Fringe which provides for 1.5 feet distance of the lowest finished floor above the 100 year Base Flood Elevation. The Director hereby approves the permit subject to the following conditions: 1. All representations of the applicant within the application shall be considered conditions of approval unless otherwise modified by the Director Determination. 2. Prior to issuance of the Final Plat for TCI Lane Ranch PUD the Applicant shall provide a copy of the conditional FIRM and floodway map revision approved through FEMA. 3. No alterations of the floodplain may be made other than the specific improvements noted in the application and shown on drawings by James Brzostowicz, P.E., as labeled "General Layout Pedestrian Bridge" and "Floodplain Site Plan Lots" Sheets 1 and 2 attached hereto as Exhibit B. 4. All new construction or substantial improvements shall be designed (or modified) and adequately anchored to prevent flotation, collapse or lateral movement of the structure resulting from hydrodynamic and hydrostatic loads, including the effects of buoyancy. 5. All new construction or substantial improvements shall be constructed by methods and practices that minimize flood damage. 7. All new construction or substantial improvements shall be constructed with electrical, heating, ventilation, plumbing, and air conditioning equipment and other service facilities that are designed and/or located so as to prevent water from entering or accumulating within the components during conditions of flooding. 8. All new and replacement water supply systems shall be designed to minimize or eliminate infiltration of flood waters into the system. 9. New and replacement sanitary sewage systems shall be designed to minimize or eliminate infiltration of flood waters into the system and discharge from the systems into flood waters. 10.0n -site waste disposal systems shall be located to avoid impairment to them or contamination from them during flooding. 11. No disturbance of a regulated wetland shall be allowed. Notice will be provided to the Board of County Commissioners pursuant to §4- 104B. regarding "Reconsideration of Director's Decision or Call-up by the Board of County Commissioners'. A call-up would require that the Board file a written request within 10 days of this decision. You will be contacted if a written request is made for reconsideration. If no call-up for Board review if requested, the Land Use Change Permit to allow for development within the floodplain will be issued with the above conditions. Sincerely, i Fred A.
