SEP 2 5 1985 County of Garfield ) ssfmoptien No. C52MILDRED ALSDORF, RECORDED GAFFIELD COUNTY, COLORADO At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, held in the Commissioners' Meeting Room, Garfield County Courthouse in Glenwood Springs on Monday the 23rd day of September A.D. 1985, there were present: Robert Richardson Larry Schmueser Flaven J. Cerise Don DeFord Mildred Alsdorf Roger Ludwig , Commissioner Chairman , Commissioner • Commissioner , County Attorney , Clerk of the Board , Administrative Assistant When the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 85-166 A RESOLUTION CONCERNED WITH THE APPROVAL OF A CONDITIONAL USE PERMIT APPLICATION BY BERNARD R. LONG. WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has received an application from Bernard R. Long for a Conditional Use permit for a mobile home as accessory use to a ranch operation on the following described tract of land: A tract of land located in NW 1/4 NE 1/4 and SW 1/4 NE 1/4, 32, T6S, R90W of the 6th P.M. Section WHEREAS, the Board conducted a meeting on the 3rd day of September, 1985, upon the question of whether the above-described Conditional Use permit should be granted or denied, at which meeting the public and interested persons were given the opportunity to express their opinions regarding the issuance of said Conditional Use permit; and, WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned meeting, has made the following determination of fact: 1. That the meeting before the Garfield County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearing. 2. That the proposed conditional use conforms to Section 5.03 of the Garfield County Zoning Regulations governing the approval or disapproval of a petition for a Conditional Use permit for a mobile home as an accessory use to a working farm or ranch operations. 3. That for the above stated and other reasons, the proposed Mobile Home Conditional Use permit is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. BOOK 676 mE178 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado that the Conditional use permit be and hereby is authorized permitting the use of the above described tract of land for a mobile home as an accessory use to a ranch operation upon the following specific conditions: 1. That the use of the tract of land comply with all regulations of Garfield County relating to the location, siting and use of a mobile home as an accessory use to a working farm or ranch, including but not limited to Section 5.03.01 of the Garfield County Zoning Resolution of 1978, as amended. 2. The applicant shall make application for the required County building and sewage disposal permits prior to issuance of the land use permit for the mobile home. The building, sewage disposal and land use permits shall be issued simultaneously. 3. The individual sewage disposal system and water supply system shall be available prior to occupancy of the mobile home. 4. The applicant shall submit an approved well permit from the State Division of Water Resosurces authorizing the well to service the two dwelling units. 5. That the mobile home make, year, list price/new purchase price and serial number be submitted to the Planning Department prior to issuance of the Mobile Home Conditional Use permit. 6. The applicants shall have 120 days from the date of the Resolution of Conditional Approval to meet all conditions set forth in the Resolution. The Conditional Use permit shall be issued when all conditions are met and shall be valid for a period of 120 days from the date of issuance and shall expire, unless construction or use has commenced within this period. 7. All representations of the applicant, either within the application or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval. 8. That an additional mobile home presently used for storage on the site be removed prior to the placement of the new accessory mobile home on the property.
